CALL TO ORDER: 6:00 P.M. 2. Executive Session: Pursuant to the Open Meetings Act, Chapter 551, Texas Government Code, Sections 551.071. Refer to posted list attached hereto and incorporate herein. Executive Session may be held, under these exceptions, at the end of the Regular Session or at any time during the meeting that a need arises for the Planning and Zoning Commission to seek advice from the City Attorney as to the posted subject matter of this Planning and Zoning Commission meeting. Section 551.071: Consultation with attorney. No Executive Session was held. 3. Recap of the City Council’s action and discussion on Planning & Zoning recommended cases. 4. Adjournment. Director of Planning and Development Services Dennis Killough noted that the Corridor Committee will be getting an invitation for a meeting in early September. When notification is received, please respond regarding your attendance. 4. CHAIRMAN COMMENTS Chairman Kubiak gave an overview of the meeting process. Noted that this would be Commissioner Springer’s 21st year serving on the Planning & Zoning Board. 5. CONSIDER: APPROVAL OF THE MINUTES FOR THE PLANNING AND ZONING COMMISSION MEETING HELD ON JUNE 6, 2024. A motion was made to approve Item 5 on the agenda. Highland Ave. Current Zoning: “CS” Community Service District. SPIN Neighborhood #3. PUBLIC HEARING Director Dennis Killough provided a brief presentation of Item 6 per Chairman Kubiak’s request. Questions were asked. Applicants Andrew Oxley, 911 Houston Street, Ft. Worth and Darren Andrews, 3917 Berry, Flower Mound came forward. Questions were asked. Chairman Kubiak opened the public hearing. Richard and Christina Schultz, 1204 Blythe Lane came forward with concerns. A motion was made to approve Item 6, ZA24-0011 subject to Staff Report dated August 8, 2024, and subject to Plan Review Summary No 2 Revised dated August 8, 2024, noting the applicant will review widening the ingress/egress point located on the west side of the building, and consider relocating the dumpster enclosure to the west side of the property, and noting denial of the variance requested for the stacking depth. A motion was made to approve Item 7, ZA24-0029 subject to the Staff Report dated August 2ndt, 2024, and subject to the Concept Plan Review Summary No. 1. dated July 12, 2024, noting the applicants wish to include a circle drive with a private gate, and noting the applicant’s willingness to meet the requirements related to the private gate, also noting the applicant’s willingness to either install or escrow the appropriate funds regarding the sidewalk.
