(TNP) for additional engineering design, easement, and construction phase services related to the Morgan Road Drainage Improvements Project in an amount not to exceed $140,000. Action Requested: Approve Supplement Agreement No. 1 for an Engineering Services Agreement with Teague Nall and Perkins, Inc. (TNP) for additional engineering design, easement, and construction phase services related to the Morgan Road Drainage Improvements Project in an amount not to exceed $140,000. Background Information: This supplement will provide additional engineering services, additional topographic survey, Subsurface Utility Engineering (SUE), Construction Phase Engineering services, easement document preparation and support for easement acquisition for the Morgan Road Drainage Improvements Project. The additional scope included in this supplement is to re -design the ditch along the west side of Cedar Court, along with items to address a portion of Sleepy Hollow, if it is determined during design that this is necessary. Stormwater generally drains from west of Morgan Road to the northeast along Cedar Court and Sleepy Hollow Trail, ultimately discharging into Higgins Branch. The original ESA focused on improvements along Morgan Road and within the existing channel between Morgan Road and Cedar Court. The existing earthen channel is currently being maintained by City crews. The flowline has been reestablished at least twice since 2020. During design and after discussing with residents in the area, it was determined that additional effort would be necessary to alleviate ponding near the southern boundary of 1725 Sleepy Hollow Trail and ensure the improved channel between Morgan Road and Cedar Court can outfall as designed. Additionally, there is an area of ponding on the west side of Cedar Court necessitating drainage Page 1 of 3 Item 4H improvements. During the design effort it was discovered that a portion of the earthen channel appears to not be fully located within the existing easement. The agreement amount for these services is not to exceed $140,000 and includes $17,385 in contingency for any additional engineering services. The existing drainage system is not working as originally designed due to multiple iterations of maintenance performed and requires a re -design to improve efficiency and reduce the risk of damage to infrastructure and properties along the flow path. This is why the decision was made to move forward with the original ESA that was approved March 8, 2023 by the City Manager's Office (CMO). This ESA was recommended by City Staff and within CMO approval authorization and within the project budget. The design of this project is currently expected to be completed by Spring 2025 and is projected to begin construction in Summer 2025, dependent on upcoming CIP budget approval. This project is aligned with the Sustainability Master Plan as Objective 10.6. Financial Considerations: This supplement is not to exceed $140,000. Funding for this supplement agreement No. 1 is budgeted in the approved FY 2022 - 2024 Stormwater Utility System District Funds. This award is within the project budget. On March 8, 2023, an ESA for design services totaling $49,955 was executed. These services included engineering design services, surveying services and direct expenses. Legal Review: The proposed agreement is a standard agreement that the City Attorney has reviewed and approved. Alternatives: The City Council may approve or deny the contract.
