EXECUTIVE
SUMMARY: Jeff Polk with Polk Design Build, on behalf of Murray Starkel, are requesting
approval of a Plat Revision, on property described at Lot AR2, Block 1, Burger
Addition, City of Southlake, Tarrant County, Texas, and located at 1355 N.
Peytonville Ave., Southlake, Texas. Current Zoning: “SF-1A” Single Family
Residential District. SPIN District #5
DETAILS:
The purpose of this request is approval of a plat revision to add the remainder of
an adjacent roadway easement tract to the current Lot AR2.

LEGAL DESCRIPTION: Lot AR2, Block 1, Burger Addition, City of Southlake, Tarrant County,
Texas.

HISTORY: The properties were annexed by Ordinance No. 87 in 1957.
A portion of the property was platted and recorded December 5, 1980
(ZA80-035)
A portion of the property was zoned SF1-A June 15, 1993 under ZA93-
019 and Ord. 480-86.
An amended plat was approved October 19, 1993 and recorded in the
County on November 5, 1993 for a portion of the property (ZA93-062).
The remaining portion of this property was zoned SF-1A August 1, 200
under ZA00-053 and Ord. 480-348.
A Plat revision for this property was approved March 19, 2002 and
recorded in the County March 22, 2002 (ZA01-141).
SOUTHLAKE
COMPREHENSIVE PLAN: Consolidated Future Land Use Plan
The future land use designation for the site is “Low Density Residential”.
Purpose and Definition: Purpose: The purpose of the Low Density
Residential land use category is to provide for and to protect low intensity
detached single-family residential development that promotes the
openness and rural character of Southlake.
Definition: The Low Density Residential category is for detached single-
family residential development at a net density of one or fewer dwelling
units per acre. Net density is the number of dwelling units per net acre,
which excludes acreage in all rights-of-way, easement, and lots
designated for public or private streets. Other suitable activities are those
permitted in the Public Parks / Open Space and Public / Semi-Public
categories. The Low Density Residential category encourages the
openness and rural character of the City of Southlake.

1. The following changes are needed according to the Subdivision Ordinance, as amended,
Sections 3.01, 3.03, & 8.01.
2. Place the City case number ZA24-0035 in the lower right-hand corner of the plat.
3. Given the property is under an individual single ownership, change “We” to “I” in the dedication
statement.
4. Add a lienholder statement and signature block with notary to the plat. If there is/are no
lienholder(s) then add a statement to this effect. The standard language for these statements
is attached.
5. Add the following notes to the face of the plat:
a. Compliance with the provisions of the City’s Storm Drainage Policy does not relieve
a person of the responsibility of complying with all other applicable laws, including,
but not limited to, Section 11.086, Texas Water Code.

6. Provide an application fee payment in the amount of $435.00. Cash or check payments can
be made at the Utility Billing window, Suite 200 in Town Hall. Credit card payments may be
made online by following the steps below:
• Go to https://www.cityofsouthlake.com/
• Click on the "Online Permits" green rectangle.
• Click on "Pay Invoices" in the black strip.
• Enter the invoice number (not the case number) in the search box: INV-0002774.
• Click on the blue 'Pay Now" tab at the bottom right of the screen.

* In accordance with Sections 4.01 and 4.06 of the Subdivision Ordinance No. 483 as amended,
a Plat Revision requires consideration by the Planning and Zoning Commission following a
public hearing and final consideration by the City Council. This item will be placed on the August
8, 2024 Planning and Zoning Commission agenda to begin at 6:30 PM and the August 20, 2024
City Council agenda to begin at 5:30 PM. Both meetings are to be held in the City Council
Chambers of Southlake Town Hall at 1400 Main Street, Southlake, Texas. The owner or
authorized representative must be present to represent the item.
* All plats filed must have an original signed and stamped Tax Certificate submitted with it from
each taxing unit with jurisdiction of the real property, indicating that no delinquent taxes are owed
and that taxes for the current year have been paid. After September 1st, a certificate showing
that the taxes for that year are paid, but that the taxes for the upcoming year have yet to be
calculated is required. (House Bills 1563 & 3101). A copy of this information may be obtained
from the Tarrant County Tax Assessor/Collector’s Office located at 100 E. Weatherford St. in Ft.
Worth (across from the old red courthouse). There is a service charge of $10 per account for
this certificate. For more information contact the Assessor/Collector’s office at 817-212-6847.
* The applicant should be aware that prior to issuance of a building permit, all required fees must
be paid. This may include but not be limited to the following fees: Park Fee, Roadway Imapct
Fee, Water & Sewer Impact and Tap Fees, and related Permit Fees.
* In addition to the City of Southlake impact fees, please be aware that through the wholesale
water customer contract with the City of Fort Worth, all new water connections are required to
pay the City of Fort Worth impact fee. The City of Fort Worth impact fee assessment is based
on the final plat recordation date and building permit issuance. The applicant is encouraged to
review the City of Fort Worth's assessment and collection of Impact Fees Guide to determine
the fee amount.
* For Tarrant County filing, original signatures and seals will be required on one 24” x 36”
blackline paper copy prior to filing the plat. The copies will not be accepted if any erasures or
original ink, other than signatures or seals, appear on the plat. The paper copy must have a
minimum ½ inch space between the paper edge and border.
* A Developers Agreement is required prior to construction of any public infrastructure. The
Developer's Agreement for this addition should consider streets, drainage, park dedication
requirements and fees, off-site sewer extensions, off-site drainage and utility easements and
impact fees.
* All development must comply with the Drainage Ordinance No. 605 and the Erosion and
Sediment Control Ordinance No. 946, as amended.
