FORUM SUMMARY:
Property Situation: 240 N. Carroll Ave. – Located approximately across the street from Main
St. and Southlake Town Square.
Development Details:
• Proposing a mixed used development that would feature one two-story office building
and 28 residential properties described as luxury villas.
• The two-story office building will front N. Carroll Ave with access to the villas on the
northeastern side of the property with a private gate.
• The two-story office building will either be a high-end restaurant or luxury retail store on
the first floor with the second story reserved for executive offices.
• A percentage of the second story offices have been already designated to
predetermined businesses.
• The luxury villas floor plan will range for 3,000 to 5,300 square feet.
• The luxury villas will be gated on the western side fronting the office building and N.
Carroll.
• Southlake Emergency Services have required that an emergency access gate be
installed on the western side of the property connecting with Cross Lane.
• Developer has stated this gate on Cross Lane will only be accessible in the case of
emergency by Southlake Emergency Services only.
• A small cul-de-sac will be installed prior to the emergency gate on Cross Lane to assist
the Foxborough neighborhood with their ongoing struggle with turn around on the dead-
end street.
• The property line around the residential villas will be screened with an 8-foot-tall
masonry wall.
• A detention pond will be installed on the southwestern corner of the property to improve
drainage in the area.
• Landscaping will feature trees and greenery to match the aesthetics of the neighboring
developments.
Presentation:

Question: Are you pre-leased on the office building?
Answer: Yes, a percentage of the office building has been pre-leased.
Question: What is the difference between these villas and a multi-family development?
Answer: These villas will not be multi-family units. It will be one house for one family on one lot.
Question: Is there a Traffic Study?
Answer: Yes, we are conducting a private traffic study and will compare our study to the traffic
study done by the city around 6 years ago and present those finding to the city for review as a
part of the development requirements for potential development.
Question: Where do you stand on your property acquisition?
Answer: We are under contract for the property dependent on the approval of the development
by the City of Southlake.
Question: Regarding the masonry screening walls, how can you ensure that the HOA for the
villas take responsibility for maintenance of the walls?
Answer: As a part of the zoning of the property we can have it written into the ordinance that
the masonry walls must be maintained by the HOA.
Question: What will the emergency gate look like and how can you guarantee that is will only
be used for emergencies?
Answer: We will create the gate in a design that is pleasing to both the development and the
Foxborough neighborhood to make is not only safe but aesthetically appealing. The gate will be
locked and only accessible by Southlake Emergency Services. No other entity will have access
to the gate.
Question: Why is access not being added onto the office properties to the south?
Answer: The owner to that property has expressed his refusal to allow any access to the
residential part of this development on his property.
Question: What is the difference between installing the emergency access gate off of the office
buildings to the south and installing the gate on Cross Lane?
Answer: The office park to the south has fire lanes that are required by the city. The city cannot
require him to allow an emergency access gate on his property as it already meets the fire code.
When Cross Lane was developed years ago it was with the idea the road would one day
connect back into the N. Carroll Ave which is why the road was left as a dead-end street instead
of installing a cul-de-sac as the fire code requires. As such to not only protect the residents of
the Villas but also those residents on Cross Lane the gate is being proposed on Cross Lane as
the Fire Marshall has required.
Question: How do you believe this development will impact the traffic on N. Carroll?
Answer: It is our belief that this development will have little change to the traffic on N. Carroll.
Question: Will you be maintaining or adding trees to assist with screening the property?
Answer: We will be maintaining any of the current trees on the property as we can and be
adding any additional tress as needed.
Question: How are you going to insure the privacy of not only this development but the current
subdivisions?
Answer: The houses will be sufficiently screened by landscaping and the masonry wall and we
will make sure that when the villas are built the backyard will not be able to be visible to other
neighbors.
Question: Has a drainage study be performed?
Answer: Yes, a preliminary drainage study has been performed and will be submitted to the city
as a part of the development case for approval.
Question: Would it be possible to revise the layout of the building to move lot 17 and lot 28 off
of the property line and move the alleyway to where those villas were?
Answer: Yes, we will investigate the possibility of that revision.

make sure it is being done in a way that doesn't negatively
affect our street, our neighborhood and our Southlake
community. This land Is directly next to our Foxborough
neighborhood and at the end of our street (Cross Lane). Based
on Mr Franks' present proposal, I have significant concerns
First, his proposed plan Is not In line with the City of Southlake
Future Land Use Plan, adopted by the City Council on
February 7th, 2023. The Future Land Plan specifically mentions
this particular parcel of land and makes the following
recommendations/policy regarding It: 1) "This land should
retain medium density residential land use designation", 2)
"Any future connection of Cross Lane to Carroll Ave is not
intended", 3) "Any office development along Carroll Ave should
have cross access back to the traffic signal at FM 1709/Tower
Plaza as well as to the office properties to the South of access
the existing drive cut on Carroll Ave", 4) "A new drive cut at
Carroll Ave and Main Street is not recommended due to
existing traffic conditions/volumes at this intersection and the
close proximity to the light." Based on what Mr. Franks has
shared thus far, his proposed development violates all of these
recommendations/policies
Second, I believe this development as currently planned will
have a significant impact on worsening traffic on an already
busy Carroll Ave and at one of our busiest intersections (Carroll
Ave & Southlake Blvd) With no exit to Southlake Blvd like the
Future Land Plan recommends, the only entry and exit points
are on and off Carroll Ave This presents a major issue.
Third, the developer presented to our neighborhood his plan to
install an "emergency gate" between Cross Lane and his
residential villas This again violates the Future Land Use Plan,
which clearly states "any future connection of Cross Lane to
Carroll Ave is not intended " In addition, it is my belief that if Mr.
Franks requires an additional entry and exit point for
emergency vehicles, that access point should be into the
medical office parking lot that connects to Southlake Blvd at
Tower Plaza. These medical offices are owned by Dr. Mendez
who is selling the land to Mr Franks. Therefore, I believe Mr.
Franks should negotiate access rather than putting the burden
upon the residents of Cross Lane and Foxborough.
Fourth, the current residential plan of 28 villas will require Mr.
Franks to seek rezoning to "high density residential" which
again would violate the Future Land Use Plan
recommendations of retaining medium density land use
designation. In addition, this level of density would not be In
keeping with the surrounding residential neighborhoods of
Southview and Foxborough Both Southview and Foxborough
have home lot sizes ranging from 20,000-25,000 sgft.

Lastly, I want to point out my concerns about the responsibility
of maintenance of the stone walls he hopes to Install between
his commercial and residential land use and the homeowners
in Southview and Foxborough. He claims the new Villa HOA
will be responsible for the maintenance of the stone walls, but I
question the enforceability of this claim. Based on City of
Southlake Ordinances, he would be required to maintain a wall
or fence between his commercial business and the residential
homeowners on the other side. However, walls and fences
between residents are a civil matter and there are not City
Ordinances that can protect the homeowners In Southview and
Foxborough from being liable to contribute to the maintenance
of a brick wall between the developments How would the
liability be enforced legally so that the homeowners of
Southview and Foxborough and their respective HOAs are not
liable for maintenance of stone walls and/or fences between
Mr Franks residential and commercial properties?
In light of these concerns, I ask Mr. Franks to revise his plan
accordingly so that he respects and honors the neighbors of
Southview and Foxborough, so that he adheres to the Future
Land Use Plan of Southlake, and so that he takes into account
the larger concerns of our Southlake community like traffic and
congestion concerns.

Question or Comment I would consider this high density housing and would ask that
city council vote no to this proposal (if it gets that far). The
developer is asking to build 6 villas per acre (There is 43,560
square feet in an acre and they want to use 7,000 for each
villa). High density developments mean more vehicles and
traffic to an already congested area of Southlake.

I would attend, however, our household is sick
This is a project I will be monitoring closely as I am concerned
about the traffic from adding the residential Villas and an office
space on an already very Busy Carroll Ave.
Villas - with my understanding, 28 villas Villas - built on 7000
square feet, so 6 villas in a one acre lot. I live in Triple C
Ranch, I have 1.3 acres that my home sits on - so this seems

With a quick Google search - the definition of High Density is
"High density means those residential zoning districts in which
the density is equal to or greater than one dwelling unit per
8,000 square feet of property."
Now the developers are smart with putting the villas just under
the 8,000 square foot - but this is just the same trick up all
developers they try to pull every single year Please make no
mistake that the citizens of Southlake will consider this high
density.
Traffic and congestion
If they get their request of 28 units - 28 x 4 people per family =
112 residents. Usually, each family has a minimum of 2 cars -
so that is 52 cars for the villas The number of cars can go up if
they have more than two drivers. Are we prepared for this many
cars in this area? This does not even Include the office space
Office Space - In my personal opinion we do not need any
more offices, as you can drive up and down Carroll Ave and
see the multiple "for lease" signs. But we the citizens do not
own the property, the developers do. We cannot tell them what
to do with the land they're purchased The builder wants a
26,000 square foot two story office building - who in their right
brain would buy a luxury villa staying at an office building? But I
digress, that is me?
Loose math - 26,000 square. If we gave Everton one 150
square feet in that office building that is 173 people working in
these offices.
So now, we have 225 cars running in and out of Carroll daily.
This seems high density and our traffic pattern (in rush hour)
will be horrendous
Please Members of City Council, say no to this Everyone on
City Council runs on the Low -Density platform. This proposal
sounds the opposite, and a dangerous environment for
Walkers/Bikers and drivers.
While I cannot be at this meeting, I will be at all others to
ensure the citizens supporting low density, voices are heard.

This project Is a terrible Idealll Traffic on Carrol Is already very
busy. At certain time of the day the stop light at Carrol and
Southlake Blvd backs up way beyond where the exit to this new
development would be located. Entrance and exit to and from
the Southvlew and Foxborough neighborhoods on Carrol Ave Is
already tough and dangerous at times. Whoever thought that
area can sustain more traffic safely needs to drive by there at 9
AM and 5 PM every day for a month and they will reconsider.

Most properties on Ownby lane have the backyards and
bedroom windows facing towards that property. The proposed
development would have 2-3 story building just feet away from
these backyards.

2 There are several taller trees that back up to our fence. We
noticed one of the older, very tall trees behind our fence, but
still on our property, was marked over the summer with a ribbon
by who I thought was a city employee. We assumed it was
marked by the city for some reason but not with the intention of
being removed, as perhaps is the plan with this new
development I would hope there would be planned

Question or Comment 1 There are several animals that use that land as sanctuary
There is a large pond back there and it is such a valuable water
source for the wildlife All of the open spaces immediately
around us have been developed over the past ten years
leaving just that spot for a refuge, in the immediate area. I know
there are raccoons, bobcats, coyotes, opossoms, owls, and a
few hawk families that exist here because of that land. I wonder
if there is any chance a park or city owned preserved wetland
could be considered for that plot instead? Part of the allure of
Southlake has been that we've had more open spaces,

We will definitely have to plan to be more animal aware if this
plan goes through as a lot of critters will be seeking out new
homes and food sources when It all starts, until its settled.
When the land across 1709 was being worked on we had a
huge influx of bobcats, coyotes and other critters coming into
our yard and neighborhood.

5.) Builder makes profit by selling $400 / square foot with no
home less than 5,000 sq ft

My primary objections:
1 the land should remain medium density (not high density) as
referenced in the city land us plan.
2. entry/exit from Carroll Ave is also not in keeping with the city
plan and will add more traffic hazards to an already congested
area. And, in order to travel northbound on Carroll, a u-turn
must be accomplished at Southlake Blvd which also adds
greater hazard.
3 high density use on small lots could affect property values for
the adjacent homes in Southview and Foxborough.

3) additional cut-throughs to the median on Carrol Ave adjacent
to the parcel under consideration Carrol traffic already is a
tremendous problem and the earlier addition of medians on
both Carrol Ave and 1709 has rendered egress/ingress to the
Foxborough neighborhood an ultra -hazardous undertaking
(Specifically, attempting to exit Foxborough via Ownby to travel
North on Carrol or via Foxborough Ln to travel East on 1709
requires crossing multiple lanes of traffic in very short distances
to make a highly hazardous U-turn across other multiple lanes
of traffic, attempting to enter Foxborough when traveling North
on Carrol or East on 1709 requires similarly hazardous U-
turns.) Adding more cut-throughs on Carrol adjacent to this
parcel would exacerbate both the traffic volume and complexity
on Carrol Ave.

As a resident of Cross Lane, we do not want an emergency
gate or gate of any kind Installed between Cross Lane and the
new proposed development (which Is currently being
proposed). The entrance/exit to this development should be
1709 as stated in the referenced Plan above. Cross Lane, while
a short street, Is home to 17 young children who often play
outdoors. Any additional traffic or gate would be a danger to our
kids and many of us purchased our homes knowing this would
not be a through street of any kind. As such, in accordance with
the Plan, no future connections of any kind should be allowed
on Cross Lane to the future development.
In addition, the current traffic volumes on Carroll Avenue are a
concern. Many residents of Foxborough and Southview
currently use the exit at Ownby Lane to enter Carroll Avenue.
There is constantly a great deal of traffic, especially during rush
hours, where there can be a backup of cars on Carroll Avenue
all the way from Southlake Boulevard to Ownby Lane. Per
review of the City of Southlake adopted budget FY 2023, the
Strategic Direction section notes that areas of focus for the city
include Safety and Security and Mobility This proposed
development, as noted above, would not be an improvement
toward these focused goals and would not be in line with the
Plan
Please maintain the proposed requirements, as stated for this
land in the Future Land and Use Plan, in connection with the
proposed development

lived on Cross Lane for 20 years and am happy that a
development is coming While I would prefer a version that puts
a cul-de-sac at the end of Cross Lane, if the 28 villa concept is
approved, my concern is ensuring we have a visually pretty
"gate" to continue to keep Cross Lane a dead end. There are
dozens of children who play in the front yards of our street, and
a through street is not desired, as it would harm the spirit of our
neighborhood and very active street.

would appreciate it if they would move forward with that design.
It would be preferred that the gate that provides privacy to

The traffic on N Carroll Avenue is very congested. By adding a
high density community as well as an office building on N
Carroll Avenue would only make the congestion far worse. The
traffic on N Carroll Avenue during peak times is often backed
up from Southlake Blvd to Ownby Avenue where there is an
entrance to the Southview Community. A different access route
from Tower Blvd (north side of Southlake Blvd) would appear to
be less of an Issue A traffic light already exists at that
intersection.

husband, Michael Wayson, will be In attendance to voice our
concerns In this matter.
My name is Leslie Wayson and I live at 809 Cross Ln, the
property directly adjacent to the land with which development Is
being proposed While I support the idea that the land in
question needs to be developed, I have the following concerns
with regards to the specific proposal being made:
1 ) M r Franks has proposed the tear -down of the brick wall and
fencing that surrounds the existing Foxboro ugh/Southview

communities. He has made verbal guarantees that the new
developments' HOA will be financially responsible for the
construction cost and maintenance of a new 8ft. stone wall that
will surround the development How will this be guaranteed? Is
there some type of legal protection that can be provided to the
Foxborough/Southview HOAs and residents that border the
new development? I am speaking specifically to the ongoing
maintenance costs of the wall
2.) 1 do not support an emergency gate being built at the end of
Cross Ln allowing cut-thru access from the proposed
development Into Foxborough. I believe this type of access
would be far better for both communities if routed to Southlake
Blvd via the commercial properties on the South side of the
proposed development We currently have 17 children between
the ages of 18 months and 15 years old residing in homes on
Cross Ln I believe it is imperative to maintain the quiet nature
of our street in order so that these children have a place to
safely play and grow.
3 ) To my previous point, I believe direct access for the
proposed development to Southlake Blvd. will help reduce
congestion for this high -density residential/commercial
community dumping entirely out onto Carroll Ave Traffic on
Carroll Ave. Is already congested Adding yet another
shopping/dining complex in addition to a high -density
residential complex is only going to worsen the matter.
If Mr. Franks (Willow Tree) will amend their proposal taking into
account the feedback provided and adhere to what is best not
only for their new community but all those surrounding it, then
he (they) will have my support.
Mr Franks told us verbally that he would include a turnaround
at the end of Cross Ln for large trucks I support this
wholeheartedly as it's very much needed at the end of our
street for the Special Needs school bus that currently has to
navigate a difficult 3-point turn using our driveway in addition to
the many large delivery trucks that navigate the street every
day. This specific aspect of the proposal demonstrates a level
of care for the larger surrounding community beyond just the
proposed development.

Question or Comment I am the homeowner at 809 Cross Ln that directly borders the
proposed development, and I have some significant concerns.
1 Maintenance of the stone wall surrounding the development
The stone wall proposed to surround the development will be
very expensive to maintain. It has been stated that the HOA of
the new development will be responsible for maintenance, but
this needs to be enforceable so that the residents of Southvlew
and Foxborough do not share responsibility for maintenance of
such an expensive wall. It Is unclear how this can be enforced,
but this is a potentially significant Impact to Individual

homeowners when the wall begins to deteriorate in time. Their
HOA covenants must reflect their responsibility for the wall and
cannot change in the future. Any other Instrument to affect this
must be considered.
2. Adding a turnaround at the end of Cross Ln, which Is
currently a dead end street with no cul-de-sac.
There is nowhere for large trucks to turn around at the end of
Cross Ln, so most pull into residents' driveways to turn around,
causing cracking overtime. Larger trucks reverse the entire
way down Cross Ln, causing a significant safety issue for the
many children that play on the street. The developer has
indicated that they will not finish a cul-de-sac for Foxborough,
so there needs to be at least a turnaround added at the end of
the street to alleviate damage to driveways and Improve safety
for children
3 Traffic on Carroll Ave
A 2-story office complex, potentially with valet parking for a
restaurant and a high density villa complex will add a
tremendous amount of traffic to an already difficult area to
navigate. Residents leaving Southvlew must either make a left
hand turn with no light or U-turn to get to TX-114, which Is
already difficult The additional traffic from the proposed
development will make the situation much worse There needs
to be a connection from the development to Southlake Blvd in
addition to the access to Carroll Ave to alleviate significant
congestion.
4. Location of the emergency fire gate.
It has been proposed to add an emergency gate at the end of
Cross Ln If a turnabout is added at the end of Cross Ln, then
the stone wall should be built around the turnaround with no
gate. An emergency gate should be added with access from
the medical office complex Instead of a neighborhood.

Question or Comment Traffic at the corner of Carroll and Southlake Blvd is already a
huge mess, particularly on any Friday, holiday season or during
rush hour. Who hasn't sat, at that corner, and silently cursed
previous urban "planners?l" Additional development at this
corner including "luxury villas'' seems to be irresponsible,
another attempt to bring smaller footprints to Southlake (read:
apartments/condos) to an already congested area and simply a
"greed" grab The adjacent strip center is almost abandoned at
this point, primarily in my opinion, because the traffic makes it
so hard to get into that location.

This construction is going to directly abut our neighborhood. I
am aware of other construction that this builder did in
Southlake that caused huge drainage issues for the resident
beside the construction site. He has never repaired these
issues and it cost the homeowner in excess of $20,000 of their
own money so far, and they still have huge drainage issues.
The builder built up the property he was working on so that the
ground was much higher than the homeowners Consequently,
all the run off from that sizable property ends up in the
backyard of the neighbor. With so little regard for the people
next to his site, I am very nervous for our fellow Foxborough
residents on Cross Lane I also am concerned about the
