Action Requested: Approve an Encroachment and Joint Use Agreement for a wood and iron fence within the drainage easement being located at 1165 E Dove Road. Background Information: The Developer of 1165 E Dove Road is requesting to construct a 7’ wood fence on top of a 1’ iron fence within a drainage easement located along the east side of the property. There are no City utilities within this easement. The purpose of this item is to seek City Council approval of an Encroachment and Joint Use Agreement for the installation of a 7’ wood fence on top of a 1’ iron fence within the drainage easement at 1165 E Dove Road. This agreement will allow the developer to place the fencing along the rear of the property. The drainage easement was dedicated to allow for cross lot drainage. Per the drainage exhibit prepared by Kellie Engineering, the proposed fencing will not impede the drainage flow. Staff is requesting City Council to consider the proposed drainage easement encroachment for the proposed improvement to the development at 1165 E Dove Road.
