BACKGROUND INFORMATION

PURPOSE: The purpose of this request is to receive approval of a preliminary plat.
PROPERTY SITUATION: The property is located on the north east corner of Brumlow Avenue and
State Hwy. 26.
LEGAL DESCRIPTION: Tract 1, Brumlow Industrial District, Phase 1 and Tracts 1B3, 1B3A, 1B1B,
1B1B1, & 4B1, out of the H. Decker Survey, Abstract No. 438
LAND USE CATEGORY: Industrial
CURRENT ZONING: “I-1” Light Industrial District and “I-2” Heavy Industrial District
HISTORY: -A final plat for Brumlow Industrial District, Phase 1 was approved by the
City on May 1, 1979.
-A change of zoning from ‘I-1’ to ‘I-2’ was approved for Tract 1, Brumlow
Industrial District, Phase 1 on December 5, 1989.
-A change of zoning from ‘AG’ to ‘I-1’ was approved for the proposed
Mustang Business Park on April 16, 2002.

CITY STAFF HAS REVIEWED THE ABOVE REFERENCED PROJECT RECEIVED BY THE CITY ON 10/06/03 AND WE
OFFER THE FOLLOWING STIPULATIONS. THESE STIPULATIONS ARE HEREBY MADE CONDITIONS OF PLAT
APPROVAL UNLESS SPECIFICALLY AMENDED BY THE CITY COUNCIL. IF YOU HAVE ANY QUESTIONS OR

1. Correct the discrepancies in the metes and bounds description and the graphic labels for calls 3, 15,
16, and 18. Call #15 is missing the word ‘west’ at the end of the chord bearing.
2. The following changes are needed with regard to adjacent properties within 200’ to include
properties across any adjacent R.O.W.:
a) Show and label the name of the record owner & corresponding deed record (volume & page)
for all unplatted tracts or the lot & block numbers, street names, existing easements,
subdivision name and plat record (cabinet & slide) for all platted properties within 200 feet
of this property. Show and label the properties within 200 feet across Brumlow Avenue.
b) Correctly label existing zoning and Land Use Designation (LUD = ) on all adjacent
properties within 200’. The correct zoning classifications are “I-1” or “I-2”, not “L1” or
“L2”. The properties to the west of the survey line have a land use designation of ‘Mixed
Use’. The properties across Brumlow Avenue have a land use designation of ‘Medium
Density Residential’.
c) Show and label the width and type of pavement on existing adjacent roadways to include
Brumlow Avenue and Mustang Drive on the north side of S.H. 26.
3. Correct the Abstract numbers of the Surveys as labeled on the survey line. The J. Gibson Survey is
Abstract No. 591 and the H. Decker Survey is Abstract No. 438.
4. Although the subdivision ordinance requires general utility easements along the perimeter boundary
of the site where adjoining easement do not already exist, staff recommends that easement be located
only where needed for public or franchise utilities and that they be located in a manner that best
benefits tree preservation on the site.
5. Correct the label of the turnaround easement to read: “Turnaround Easement 60’ Radius”.

INFORMATIONAL COMMENTS
* A Developers Agreement is required prior to construction or acceptance of any public infrastructure.
The Developer's Agreement for this addition should consider streets, drainage, park dedication
requirements and fees, off-site sewer extensions, off-site drainage and utility easements and impact
fees. Any unresolved environmental issues regarding the existing roadway proposed for dedication
must be resolved prior to final plat approval.
