BACKGROUND INFORMATION
OWNER/APPLICANT: Wyndham Properties II Ltd.
PROPERTY SITUATION: The property is located on the east side of N. Nolen Drive between State
Highway 114 and E. Southlake Boulevard.
LEGAL DESCRIPTION: A portion of Block 2, Gateway Plaza Phase II
LAND USE CATEGORY: Mixed Use
CURRENT ZONING: “S-P-2” Generalized Site Plan District
HISTORY: -A preliminary plat was approved by Council on May 16, 2000.
-A zoning change from, “AG” to “S-P-2” with a concept plan was approved by
City Council on June 6, 2000.
-A zoning change from “S-P-2” to “S-P-2” with a concept plan was approved
by City Council on April 1, 2002 creating a second option for the development
of Gateway Plaza Phase 2.

CITY STAFF HAS REVIEWED THE ABOVE REFERENCED PROJECT RECEIVED BY THE CITY ON 12/20/04 AND WE
OFFER THE FOLLOWING STIPULATIONS. THESE STIPULATIONS ARE HEREBY MADE CONDITIONS OF PLAT
APPROVAL UNLESS SPECIFICALLY AMENDED BY THE CITY COUNCIL. IF YOU HAVE ANY QUESTIONS OR NEED

1. This final plat is subject to all conditions of approval for the controlling Preliminary Plat. A revised
preliminary plat must be approved by the City Council following a recommendation from the
Planning and Zoning Commission before approval of this final plat may occur. The revised
Preliminary Plat for this site will be considered by the City Council on January 4, 2005.
2. The following changes are needed regarding easements:
a. Provide easements for franchise utilities, water, sewer and/or drainage in compliance with
drainage, utility & construction plans as approved. Placement of utilities and easements must
consider location of existing trees to be preserved. A drainage easement of adequate with to
contain the required 100 year storm water flow must be provided along the eastern boundary.
Any off-site utilities or drainage facilities needed in conjunction with development of this
property must be dedicated to the City by a separate dedication instrument and filed in the
County real property records. An easement for off-site portion of the sewer serving this site
must be provided.
b. Provide bearings, distances and dimensional ties along lot lines to all easements that are not
parallel off-sets from an identified boundary. No easements have been dimensioned.
c. Provide Common Access Easements in compliance with the approved concept and site plans.
Easements are not correctly shown.
d. Correct the filing information for the 5’ Sanitary Sewer easement on the east side of the
property line between Lot 1 & Lot 2. The plat for Lot 1, could not dedicate the easement.
3 Remove note #5 from the face of the plat. It is the same as note #1.

4. All lots must comply with the underlying zoning regulations on the property in accordance with the
City’s Comprehensive Zoning Ordinance No. 480, as amended. A reciprocal parking, access and
maintenance agreement running with the land in perpetuity must be provided due to the lot boundaries
established by this plat not containing the required parking in accordance with the underlying zoning
and approved plans.
Informational Comments:
* All development must comply with the City’s Drainage Ordinance No. 605.
* It appears this property lies within the D/FW Regional Airport Overlay Zone, requiring construction
standards in compliance with the Airport Compatible Land Use Zoning Ordinance No. 479.
* Please submit a revised blueline "check print" prior to submitting blackline mylars with original
signatures.
* A “Certificate of Taxes Paid” indicating that there are no delinquent taxes owed on the subject
property from each taxing authority must be provided to the City prior to filing this plat in the County
records. A copy of this information may be obtained from the Tarrant county Tax
Assessor/Collector’s Office located at 100 E. Weatherford St. in Ft. Worth (across from the old red
courthouse). There is a service charge of $10 per account for this certificate. For more information

* Original signatures and seals will be required on three blackline mylars prior to filing the plat. Also
required are two sets of owner's dedications and notaries (8.5" x 11" or 14" paper) with original
signatures and seals on each. Mylars will not be accepted if any erasures or original ink, other than
signatures or seals, appear on the plat.
* A Developers Agreement is required prior to construction of any public infrastructure. The
Developer's Agreement for this addition should consider streets, drainage, park dedication
requirements and fees, off-site sewer extensions, off-site drainage and utility easements and impact
fees.
