memo & attachments 483-K R1 City of Southlake Department of Planning MEMORANDUM March 11, 2005 TO: Planning and Zoning Commission FROM: Ken Baker, AICP, Planning Director SUBJECT: AMENDMENTS TO THE SUBDIVISION ORDINANCE NO. 483, as amended, as it pertains to street and lot design criteria (Proposed Ordinance 483-K) ________________________________________________________________________________ REQUESTED ACTION: Consider Ordinance 483-K and hold a public hearing on the proposed revisions to Ordinance 483, as amended, to the following sections, as these sections pertain to the following: Article V, Section 5.01(F), Private Streets Article V, Section 5.02(A), Right of Way Requirements Article VIII, Section 8.01 (A) Street Frontage Requirements Article VIII, Section 8.01 (D) Lot Design APPLICANT: City initiated. The Department of Public Safety would prefer that a public street be constructed in these situations, in particular, any subdivisions containing more than four lots. In an effort to eliminate variances and Department of Public Safety concerns staff is proposing the following: 1) Allow a reduced right-of-way and street cross-section requirements for subdivisions containing no more than ten (10) lots; 2) Allow subdivisions containing no more than (4) four lots to front on a common access easement; 3) Eliminate flag lot designs which attempt to go around the street frontage requirements. Attachment B – Proposed Ordinance Changes to Article VIII 2 Attachment A STREET AND RIGHT-OF-WAY REQUIREMENTS The following general requirements are to be applied in any subdivision that involves one or more streets of any classification. Section 5.01 General: F. Private Streets: Private streets shall not be permitted within any new subdivision. However, subdivisions containing no more than four (4) lots may be permitted to front on a Common Access Easement constructed to City street standards and meeting the requirements of the City Fire Code, as amended, and the owners of property within an existing residential subdivision may petition the City to convert the public streets in the subdivision to private streets in accordance with Section 5.04. Subdivisions containing private streets must comply with the private street standards in Section 5.05. (As amended by Ord. No. 483-E, Section 5.02 Right-Of-Way Requirements: A. No. 483-A) A. Every lot shall abut on a public street or a private street, except as provided for elsewhere, within this ordinance. B. All lots, regardless of zoning or whether or not zoned, that are not served by a public or quasi-public community sewer system, shall contain a minimum lot area as required in the Zoning Ordinance to support a private septic tank and leach field. A subdivision may, at the discretion of the Council, be deemed to be served by a public sewer system if a Developer Agreement has been executed with the City outlining provisions for extending public sewer service to the development and providing for payment by the development of all required approach main, connection and impact fees necessary to acquire the service. (As amended by Ord. No. 483-D) C. Double fronted residential lots shall not be allowed. However, lots which are backed up to an arterial street shall be allowed when there is no access allowed from these lots to the arterial street. Access may also be limited to collector streets for lots which have double frontage. (As amended by Ord. No. 483-G) D. All side lot lines shall be perpendicular to the ROW lines or radial in the case of a cul-de-sac or curvilinear design. “Panhandle” shape lots shall not be permitted. (As amended by Ord. No. 483-D) 4
