BACKGROUND INFORMATION
OWNER: PKB Enterprises, LTD
APPLICANT: Bury & Partners-DFW, Inc.
PURPOSE: The purpose of this request is to receive approval of a final plat for the
creation of 33 lots for the construction of single-family, attached residences
(brownstones).
PROPERTY SITUATION: The property is located east of the intersection of Main Street and Central
Avenue and north of the intersection of Summit Avenue and E. Southlake
Boulevard.
LEGAL DESCRIPTION: Being a portion of Tract 2A5, situated in the R. Eads Survey, Abstract No.
481.
LAND USE CATEGORY: Mixed Use
CURRENT ZONING: “DT” Downtown District

CITY STAFF HAS REVIEWED THE ABOVE REFERENCED PROJECT RECEIVED BY THE CITY ON 07/06/04 AND WE
OFFER THE FOLLOWING STIPULATIONS. THESE STIPULATIONS ARE HEREBY MADE CONDITIONS OF PLAT
APPROVAL UNLESS SPECIFICALLY AMENDED BY THE CITY COUNCIL. IF YOU HAVE ANY QUESTIONS OR

1. Correct the discrepancy between the current property owner and the deed record volume and page in
the preamble. The owner is identified as Brownstones at Town Square, L.P., but the deed record
refers to PKB Enterprises, LTD.
2. Two intervisible boundary corners of the site must be geo-referenced by state plane coordinates in
accordance with section 8.03(B) of the Subdivision Ordinance No. 483 upon submittal of the final
plat, and, prior to acceptance of the subdivision by the City, a digital computer file of the subdivision
must be provided in accordance with Section 8.04 of Ordinance No. 483. This requirement applies
to final plats of 10 lots or more.
3. Show and label the 8’ pedestrian access easement on Lot 4, Block 5R, Southlake Town Square,
Phase 1.
4. Label Block 22 on the plat. Show the 32’ setback line and a 10’ utility easement adjacent to E.
Southlake Blvd.
5. Staff recommends that this plat not be filed until the public infrastructure has been constructed and
substantially approved by the City.
INFORMATIONAL COMMENTS
* Setbacks provide that are not dictated by the zoning ordinance are not enforceable by the City. There
is no maximum for rear yards and there is no minimum for side yards adjacent to a street.
* Please submit a revised blueline "check print" prior to submitting blackline mylars with original
signatures.

* A Developers Agreement is required prior to construction of any public infrastructure. The
Developer's Agreement for this addition should consider streets, drainage, park dedication
requirements and fees, off-site sewer extensions, off-site drainage and utility easements and impact
fees.
* It appears this property lies within the 65 LDN D/FW Regional Airport Overlay Zone, requiring
construction standards in compliance with the Airport Compatible Land Use Zoning Ordinance No.
479.
* A “Certificate of Taxes Paid” indicating that there are no delinquent taxes owed on the subject
property from each taxing authority must be provided to the City prior to filing this plat in the
County records. A copy of this information may be obtained from the Tarrant county Tax
Assessor/Collector’s Office located at 100 E. Weatherford St. in Ft. Worth (across from the old red
courthouse). There is a service charge of $10 per account for this certificate. For more information

* Original signatures and seals will be required three blackline mylars prior to filing the plat. Also
required are two sets of owner's dedications and notaries (8.5" x 11" or 14" paper) with original
signatures and seals on each. Mylars will not be accepted if any erasures or original ink, other than
signatures or seals, appear on the plat.
