SUBJECT: Public Hearing Item – Proposed Changes to Zoning Ordinance 480 as a Result of
Revisions to Regulations Governing Solicitation/Outdoor Sales and Mass Gathering
Activities.

Purpose of the
Public Hearing
Item: Provide a recommendation to City Council regarding proposed amendments to
Zoning Ordinance 480 as a result of revisions to regulations governing solicitation,
outdoor sales and mass gathering activities.
Background: The Planning and Zoning Commission reviewed the proposed changes to the
zoning ordinance as a discussion item at its January 8, 2004 meeting. During that
meeting staff presented an overview of the proposed changes to the Solicitors
Ordinance and the Zoning Ordinance.
Changes to the
Ordinance: The following changes have been made to the draft ordinances sections distributed
to the Planning and Zoning Commission on December 30, 2003:
Section 3.8 (page 3)-added the "Board of Adjustment
APPLICATIONS FOR AMENDMENTS TO THE ZONING ORDINANCE,
ZONING REQUESTS, CONCEPT PLANS, DEVELOPMENT PLANS, SITE
PLANS, DEVELOPMENT PLANS, SPECIFIC USE PERMITS, BOARD OF
ADJUSTMENT AND OTHER ZONING ORDINANCE RELATED REQUESTS
An application will not be submitted to the Planning and Zoning Commission,
City Council, or Board of Adjustment until the Administrative Official determines
the application is complete.
Section 21.2.9 (page 1) –deleted the following.
Christmas tree sales beginning one week before Thanksgiving and extending through
December 31st of each calendar year (outdoor display permitted). Note: Christmas
trees sales proposed to be regulated as an outdoor sales item.

Section 34.1 gg (page 5) – added the following (item #3).
Mass gathering events. This activity is authorized as an accessory use if it occurs:
1. in a permanent structure designed, constructed and approved by the Fire Marshal for
the occupancy load of the event, with sufficient permanent sanitary facilities, as
required by the Uniform Building Code and sufficient parking facilities as required by
this ordinance;
2. on a tract of land which is at least 10 acres in size, and the mass gathering area is at
least 200 feet from the adjacent property, and the site will accommodate the required
parking of cars of attendees on-site; or
3. if the event is attended by less than 1,000 people in a single day and an application
containing the following information has been submitted to the Director of Public
Safety (Name, Address, Telephone Number, Type of Event, Start and Finish time for
the Event, the Number of People Expected to be in attendance, and the location for
parking).
