Subject: 2nd Reading, Ordinance No. 1028-A, amending Chapter 10 "Health and
Sanitation" Article III "Food Establishments" of the City of Southlake Ordinances
Action
Requested: Conduct a Public Hearing and consider 2nd Reading approval of Ordinance No.
1028-A, amending Chapter 10 "Health and Sanitation" Article III "Food
Establishments" of the City of Southlake Ordinances.
Background
Information: Tarrant County provides food establishment and public swimming pool and spa
inspection program services for several cities in the county, including the City of
Southlake. Tarrant County provides these services through an Interlocal
Agreement, as authorized in Chapter 791 of the Texas Government Code. At
Tarrant County Public Health's request, City Council considered and approved
an updated Interlocal Agreement with Tarrant County on December 5, 2023, to
reflect changing fees and regulatory requirements. The updated ILA establishes
city responsibilities, including the adoption of selected chapters of the Texas
Health and Safety Code and Texas Administrative Code, which necessitates
updates to Southlake's Ordinance No. 1028 pertaining to food establishments.

Financial
Considerations: None. Health permit fees are paid by permit applicants directly to Tarrant County
Public Health. These fees fully fund program costs.

Board Review: Due to the limited scope of this request, this item was not presented to SPIN or
the Corridor Planning Committee.
Legal Review: The City Attorney has reviewed the ordinance.
City Council: December 5, 2023; 1st Reading Approved on Consent (7-0).
Alternatives: City Council may approve, modify, or deny the proposed amendments.
