Subject: Approve an Encroachment and Joint Use Agreement for a
combination of wood and wrought iron fences within the
drainage easement being located at 900 Stacy Drive.
Action
Requested: Approve an Encroachment and Joint Use Agreement for a
combination of wood and wrought iron fences within the drainage
easement being located at 900 Stacy Drive.
Background
Information: The Developer of 900 Stacy Drive, Holmes Builders, is requesting to
construct wood and wrought iron fences within a drainage easement
located along the rear of the property.
The purpose of this item is to seek City Council approval of an
Encroachment and Joint Use Agreement for the installation of wood
and wrought iron fences within the drainage easement at 900 Stacy
Drive. This agreement will allow the developer to place a wood
fence along the side yard and a wrought iron fence along the rear
of the property. There are no City utilities or infrastructure within
this easement. The drainage easement was dedicated for the
adjacent creek, a tributary of Big Bear Creek, located west of the
property within the neighboring subdivision. Per the signed and
sealed engineered drainage memo prepared by Cardinal
Strategies, the proposed fence will not impede the drainage flow.
This is a no cost agreement.
Staff is requesting City Council to consider the proposed drainage
easement encroachment for the proposed improvements within 900
Stacy Drive.

Considerations: This is a no cost agreement.
