Southlake Blvd., Suite 130. Current Zoning: "S-P-2" General Site Plan Zoning District. SPIN Neighborhood #8. REQUEST DETAILS: Bavesh Patel is requesting approval for a Specific Use Permit for Kennels, which will be associated with grooming services, to be located at 2600 E. Southlake Blvd., Suite 130. Kennel is defined by the Zoning Ordinance as "A commercial establishment (with indoor and/or outdoor pens and runs) in which dogs, cats, or domesticated animals are housed, boarded, groomed, bred, trained, or sold all for a fee or compensation." The facility will have a maximum of 11 employees and a maximum of 12 dogs at any given time, with typically 9 dogs at the grooming stations and 3 awaiting in the kennels for their turn to be groomed. Overnight boarding, extended kenneling, and doggie daycare services will not be offered within the facility. (ZA00-032 ) o City Council approved a zoning change from "AG" and "C-2" to "S-P-2" Generalized Site Plan District with "C-3" General Commercial District uses and a concept plan on June 6, 2000. (ZA00-020). o The Planning and Zoning Commission approved the final plat for Lot 1, Block 1, Gateway Plaza Phase II on July 6, 2000. (ZA00-076) o The City Council approved the zoning change request from "AG" Agricultural district and "S-P-2" Generalized Site Plan District with "C-3" General Commercial District uses to "S-P-2" Generalized Site Plan District with "C-3" General Commercial District uses on April 1, 2003. (ZA03-008) o The City Council approved the site plan for Gateway Plaza Phase II on April 1, 2003. (ZA03-012) o The City Council approved the plat revision for Lots 1 R1 — 1 R5, Block 1, Gateway Plaza Phase 11 on April 15, 2003. (ZA03-004) o The commercial permit for the shell building was issued on April 17, 2003. PLANNING AND ZONING COMMISSION ACTION: November 9, 2023; APPROVED (7-0), subject to the Staff Report dated November 3, 2023, and SUP Review Summary No. 2 dated October 27, 2023. STAFF COMMENTS: Attached is Revised Specific Use Permit Review Summary No. 2, dated October 27, 2023. The following are considerations that should be taken when considering the Case No. Attachment A ZA23-0062 Page 1 granting of a Specific Use Permit. 45.4 GENERAL REQUIREMENTS Any use permitted hereunder shall meet the minimum requirements provided in the district in which it is located. A specific use permit shall automatically expire if a building permit is not issued, and construction begun within six (6) months of the granting of the specific use permit or if the use shall cease for a period of six (6) months. 45.5 FACTORS TO BE CONSIDERED - In granting or denying an application for a specific use permit, the City Council shall take into consideration the following factors: a. Safety of the motoring public and of pedestrians using the facility and the area immediately surrounding the site. b. Safety from fire hazard, and measures for fire control. c. Protection of adjacent property from flood or water damage. d. Noise producing elements; and glare of vehicular and stationary lights and effect of such lights on established character of the neighborhood. e. Location, lighting and type of signs; and relation of signs to traffic control and adverse effect on adjacent properties. Street size and adequacy of pavement width for traffic and reasonably expected to be generated by the proposed use around the site and in the immediate neighborhood. g. Adequacy of parking, as determined by requirements of this chapter for off-street parking facilities for similar uses; location of ingress and egress points for parking and off-street loading spaces; and protection of the public health by all-weather surfacing on all parking areas to control dust. h. Such other measures as will secure and protect the public health, safety, morals and general welfare.
