ORDINANCE NO. 1281
AN ORDINANCE VACATING AN EASEMENT ON CALLED 25.12
ACRE TRACT OF LAND CONVEYED TO DALLAS MTA, L.P. OF
THE TARRANT COUNTY RECORDS, LOCATED IN THE CITY OF
SOUTHLAKE; DECLARING THAT THE ENTIRETY OF SUCH
EASEMENT IS UNNECESSARY FOR USE BY THE PUBLIC;
AUTHORIZING THE MAYOR TO EXECUTE QUITCLAIM DEEDS
RELEASING PUBLIC INTEREST OF THESE EASEMENTS;
PROVIDING A SEVERABILTY CLAUSE; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the City of Southlake, Texas ("the City") is a home rule city acting under its
power adopted by the electorate pursuant to Article XI, Section 5 of the Texas
Constitution and Chapter 9 of the Local Government Code; and
WHEREAS, the City Council of the City of Southlake, after careful study and
consideration, has determined that the entirety of the easement, located in the City of
Southlake, recorded in D213036552 is not being used by, nor useful or convenient to the
public in general; therefore, it would be better served and benefited by its vacation; and
WHEREAS, in order to remove any question as to the continued interest in the
easements, the City desires to execute a quitclaim deed releasing all title and control in
said easement to the owners of the property.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF SOUTHLAKE, TEXAS:
SECTION 1
The entirety of the 15-foot sanitary sewer utility easement located on called 25.12
acre tract of land conveyed to Dallas MTA, L.P. more specifically described in the
county records in D213036552. The easement records attached hereto and incorporated
herein for all purposes, are not being used by, nor useful or convenient to the public in
general and the public would be better served and benefited by their vacation as public
easements.
SECTION 2
The Mayor of the City of Southlake, Texas, is hereby authorized and empowered
to execute quitclaim deed for the above mentioned property in Section 1 to the following
entity: Cellco Partnership, d/b/a Verizon Wireless.

SECTION 3
Copies of said quitclaim deeds shall be presented for filing with the County Clerk
of Tarrant County, Texas by the office of the City Secretary.
SECTION 4
It is hereby declared to be the intention of the City Council that the phrases,
clauses, sentences, paragraphs and sections of this ordinance are severable, and if any
phrase, clause, sentence, paragraph or section of this ordinance shall be declared
unconstitutional by the valid judgment or decree of any court of competent jurisdiction,
such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences,
paragraphs and sections of this ordinance, since the same would have been enacted by the
City Council without the incorporation in this ordinance of any such unconstitutional
phrase, clause, sentence, paragraph or section.
SECTION 5
This Ordinance shall be in full force and effect from and its passage, and it so
ordained.

Being a 0.391 acre (17,040 square feet) tract of land situated in the J. B. Martin Survey, Abstract
No. 1134, City of Southlake, Tarrant County, Texas, and being a portion of a called 25.12 acre
tract of land conveyed to Dallas MTA, L.P. by Special Warranty Deed dated February 12, 2013
and recorded in Instrument No. ❑213036552 of the Official Public Records of Tarrant County,
Texas, and subsequently distributed to Cellco Partnership, dlbla Verizon Wireless, by Cellco
Partnership Assistant Secretary's Certificate dated January 14, 2019 and signed by Karen M.
Shipman, Assistant Secretary, said 0.391 acre (17,040 square feet) tract of land also being all of
an existing 15' Sanitary Sewer Utility Easement granted to the City of Southlake as recorded in
Volume 16245, Page 349 of said Official Public Records of Tarrant County, Texas, said 0.391
acre (17,040 square feet) tract of land being more particularly described by metes and bounds as
follows:
COMMENCING at a 518 inch iron rod cap stamped "GORRONDONA" found for corner at the
intersection of the northeast line of SH 114 (a variable width right-of-way) with the southwest line
of said called 25.12 acre tract of land and the northwest line of Lot 1, Block 1 of Solana Addition,
an addition to the City of Southlake, Tarrant County, Texas as recorded in Instrument No.
❑202371425 of said Official Public Records of Tarrant County, Texas, said 518 inch iron rod cap
stamped "GORRONDONA" being the beginning of a non -tangent curve to the left having a radius
of 4,843.00 feet, a delta of 03 degrees 45 minutes 20 seconds and whose chord bears North 26
degrees 18 minutes 07 seconds West, a chord distance of 317.39 feet; THENCE Northwesterly,
with the northeast line of said SH 114, an arc distance of 317.45 feet to a 518 inch iron rod cap
stamped "GORRONDONA" found for corner; THENCE South 61 degrees 49 minutes 13 seconds
West, with the northeast line of said SH 114, a distance of 12.00 feet to a 518 inch iron rod cap
stamped "GORRONDONA' found for the beginning of a non -tangent curve to the left having a
radius of 4,831.00 feet, a delta of 06 degrees 33 minutes 55 seconds and whose chord bears
North 31 degrees 27 minutes 45 seconds West, a chord distance of 553.26 feet; THENCE
Northwesterly, with the northeast line of said SH 114, an arc distance of 553.56 feet to a calculated
