Item 8 - Staff ReportCase No. ZBA23-0020 REVISED S T A F F R E P O R T September 22, 2023 CASE NO: ZBA23-0020 901 La Salle Lane – SEU for Accessory Building Setback Reduction EXECUTIVE SUMMARY: REQUEST: Pradeep Bodige, is requesting a Special Exception Use, per Ord. No. 480, as amended, Section 44.12(6) for a reduction in the required setback from property lines for a residential accessory structure, to be located at Lot 29, Block 9, Carillon Phase 5A, an addition to the City of Southlake, Tarrant County, Texas, and located at 901 La Salle Lane, Southlake, Tarrant County, Texas. The purpose of this request is to seek approval of a Special Exception Use to permit a reduction in the rear yard setback by permitting a portion of an eave to encroach into the required setback. Eaves on accessory structures may only encroach into a setback by one (1) foot. The applicant is requesting that a small portion of a corner encroach as much as two (2) feet. Detailed renderings are provided showing this additional one foot encroachment in red. The applicant came before the board for an SEU in April. (ZBA23-0009) However, the applicant withdrew the item and has been working with the Building Inspections department through the permitting process. The applicant proposes this new design which brings the structure much closer to conformance. The original proposal was for a setback reduction from ten (10) feet to five (5) feet. At that time the structure was already constructed and will be altered upon the ZBA’s decision in this case. Due to Zoning Standards for roof eave encroachments, a clear motion is needed to distinguish the roof from the rest of the structure. If the ZBA is amenable to the request, staff requests that a specific motion be made to only allow the roof of the structure to be as close as 8’ to the property line as shown in the renderings provided, and any other portion of the structure shall not encroach into any required setback. At this time, staff contacted the contractor to advise of the 10’ setback. - A ZBA application was submitted on March 27, 2023, related to the setback. - The contractor contacted the city on April 10, 2023, advising the structure was built without a permit, and stated the work was completed while the owner was out of town. - An SEU request was presented to the ZBA on April 27, 2023 requesting a setback reduction from 10’ to 5’. The item was tabled and was subsequently withdrawn. (ZBA23-0009) STAFF COMMENTS: The application and exhibits are provided in this Staff Report. The findings necessary for the Board to approve a Special Exception Use Permit are below: 1) No special exception shall be granted unless the Board finds that the requested exception is specifically permitted by the zoning ordinance; 2) That the location of the proposed activities and improvements is clearly defined on the concept plan or plot plan, and 3) That the special exception is wholly compatible with the use and permitted development of adjacent properties either as filed or subject to such limitations and requirements as the board deems to be necessary to protect adjacent properties.
