Case No. ZBA23-0016 REVISED S T A F F R E P O R T September 22, 2023 CASE NO: ZBA23-0016 PROJECT: 1002 Dominion Drive – SEU for an Accessory Building Greater than the Size Permitted EXECUTIVE SUMMARY: On behalf of Mohammed Ahmed and Ambreen Butt, Taylor Meyers is requesting approval of a Special Exception Use per Ordinance No. 480, Section 44.12(2) for an accessory structure of a size or aggregate size greater than the size permitted on property described Lot 2, Block 2 of The Dominion, an addition to the City of Southlake, Tarrant County, Texas, and located at 1002 Dominion Drive, Southlake, Tarrant County, Texas. REQUEST: The purpose of this request is a Special Exception Use to permit an aggregate total of 680 square feet of accessory building area, exceeding the maximum permitted square footage of 600 square feet. There is an existing shed on the site of 80 square feet. The new detached covered kitchen area is proposed to be 600 square feet. The combined buildings will exceed the permitted accessory building lot coverage by 80 square feet or approximately 13%. The structure meets all other zoning requirements. To maintain the overall consistency, integrity and property values of the neighborhood we believe homeowners should be required to follow city guidelines or limits for structures and/or building on properties. If they have exceeded their limit,they should be required to shrink the footprint of the new addition or if they are requesting a zoning use which is not currently approved or allowed,they should not be granted exception. Rules and ordinances were put in place for a reason by city community planners and likely include reasons that homeowners are not aware of that could affect the neighborhood.This also creates a precedent for other homeowners to be granted exceptionally uses. It is also unclear if or to what use the already existing ADU was approved for when built. Although current homeowners may use for personal use,future homeowners may attempt to use additions for purposes that create more blight,traffic and street parking. The shed and additional building already in place(that are both visible from the street)block line of sight of greenery and create an already over built aesthetic.Additionally, current homeowners do not maintain the front of their property appropriate to the scope of the neighborhood and have also recently requested un-sightly exceptions to the HOA guidelines.We realize these are HOA issues and not city but it demonstrates a pattern of current owners not willing to maintain the exceptional standards and quality of living in Southlake and may abuse their exception. We believe the only reason to grant use or lot exceptions should be for extraordinary circumstances or situations that clearly present no possible downside. Neither seems to be the case here. We very recently purchased a home in Southlake at the height of the market and paid the premium to live here because we believe the city of Southlake has strict standards to maintain the quality of property values and community life.
