EXECUTIVE
SUMMARY: On behalf of James Brown, Thomas Powell from Wood Bend Homes is requesting
approval of a Special Exception Use per Ordinance No. 480, Section 44.12(2) for an
accessory structure of a size or aggregate size greater than the size permitted on
property described Lot 8, Block 1, Vermilion Addition, an addition to the City of
Southlake, Tarrant County, Texas, and located at 128 Vermilion Court, Southlake,
Tarrant County, Texas.
REQUEST: The purpose of this request is a Special Exception Use to permit an aggregate total of
1,490 square feet of accessory building area, exceeding the maximum square footage
of 3% or 1,300 square feet.
There is an existing pool cabana on site of approximately 210 square feet. The
proposed detached garage will be approximately 1,280 square feet, therefore bringing
the total square footage to 1,490. This will exceed the permitted maximum square
footage of permitted accessory building area of 1,300 square feet by 190 square feet,
or approximately 14%.
The building meets all other zoning requirements. The building will be approximately
16’ in height and will have generous side and rear yard setbacks.
ACTION NEEDED: 1) Conduct a public hearing.
2)Consider approval of the requested SEU.

HISTORY: -The property was annexed into the City in 1957.
-A Final Plat for the Vermillion Addition was filed on January 29, 2003.
-A Plat Revision for lots 14R1 and 14R2 was approved by City Council on
February 18, 2003.
- A permit for the current principal residence totaling approximately 4,800
square feet was issued February 11, 2005.
-A permit for the existing pool cabana was issued on July 1, 2015.
STAFF COMMENTS: The application and exhibits are provided in this Staff Report.
The findings necessary for the Board to approve a Special Exception Use are
below:
1)No special exception shall be granted unless the Board finds that the
requested exception is specifically permitted by the zoning ordinance;
2)That the location of the proposed activities and improvements is
clearly defined on the concept plan or plot plan, and
3)That the special exception is wholly compatible with the use and
permitted development of adjacent properties either as filed or subject
to such limitations and requirements as the board deems to be
necessary to protect adjacent properties.
