Item 5 - ZBA23-0009 - Staff ReportCase No. ZBA23-0009 S T A F F R E P O R T April 21, 2023 CASE NO: ZBA23-0009 901 La Salle Lane – SEU for Accessory Building Setback Reduction EXECUTIVE SUMMARY: REQUEST: Santosh George, on behalf of Pradeep Bodige, is requesting a Special Exception Use, per Ord. No. 480, as amended, Section 44.12(6) for a reduction in the required setback from property lines for a residential accessory structure, to be located at Lot 29, Block 9, Carillon Phase 5A, an addition to the City of Southlake, Tarrant County, Texas, and located at 901 La Salle Lane, Southlake, Tarrant County, Texas. The purpose of this request is to seek approval of a Special Exception Use to permit a rear yard setback of approximately 5’ when 10’ is required, for an open-air pool cabana. The reduction for the setback is approximately 50% of the required rear yard setback for the accessory structure. From what is understood by staff, the structure was not built at the time of the application for this SEU in March. However, due to miscommunication between the homeowner and contractor, the structure has since been constructed. Pictures and an email are attached to this report. The structure is approximately 17x14 in size and approximately 8’ 9” in height per zoning definition, topping out at approximately 9’ 6” at its peak. ACTION NEEDED: 1) Conduct a public hearing. 2) Consider approval of the requested Special Exception Use. At this time, staff contacted the contractor to advise of the 10’ setback. -A ZBA application was submitted on March 27, 2023, related to the setback. -The contractor contacted the city on April 10, 2023, advising the structure was built without a permit, and stated the work was completed while the owner was out of town. STAFF COMMENTS: The application and exhibits are provided in this Staff Report. The findings necessary for the Board to approve a Special Exception Use Permit are below: 1)No special exception shall be granted unless the Board finds that the requested exception is specifically permitted by the zoning ordinance; 2)That the location of the proposed activities and improvements is clearly defined on the concept plan or plot plan, and 3)That the special exception is wholly compatible with the use and permitted development of adjacent properties either as filed or subject to such limitations and requirements as the board deems to be necessary to protect adjacent properties. It was an honest coordination lapse with folks in the know on vacation and could not check vendor from installation. We can have the structural engineer meet the City Inspector and provide all detail or information need and pay fines/fees associated. Company wide we have taken precaution that without a signed drawing with permit at site no installation shall take place.
