Subject: Approve an Encroachment and Joint Use Agreement for a
driveway bridge crossing within the drainage easement being

Action

Harbor Refuge.
Background
Information: The Developer of 2905 Harbor Refuge is requesting to construct a
driveway bridge crossing within a drainage easement located along
the rear of the property.
The purpose of this item is to seek City Council approval of an
Encroachment and Joint Use Agreement for the installation of a 3'
tall bridge crossing the existing creek, consisting of 3 - 42-inch
culverts with a retaining wall on either side, within the drainage
easement at 2905 Harbor Refuge. This agreement will allow the
developer to place the bridge crossing to provide vehicular access to
the proposed detached garage. The property owner will be
responsible for all necessary maintenance on the bridge crossing,
including the 3 — 42-inch culverts, retaining walls, traffic rails, and
pavement. The encroachment agreement outlines the maintenance
responsibilities. Currently the property owner is working to obtain an
earth disturbance permit to begin grading and excavation. A building
permit for the property has not been applied for yet, however, to be
proactive in the process the property owner is looking to obtain
approval of their encroachment agreement now to not hold up the
future building permit processes.
Staff is requesting City Council to consider the proposed drainage
easement encroachment for the proposed improvements to the
development at 2905 Harbor Refuge.
