Item 6C - Attachment A - Ordinance No. 1275Ordinance No. 1275 Page 1 ORDINANCE NO. 1275 AN ORDINANCE DEDICATING A PERMANENT EASEMENT TO TRI-COUNTY ELECTRIC COOPERATIVE, INC, FOR PLACEMENT OF ELECTRICAL EQUIPMENT ON CITY OWNED PROPERTY DESCRIBED AS BEING PART OF A TRACT OF LAND IN THE CITY OF SOUTHLAKE, TARRANT COUNTY, TEXAS, A PART OF LOT 30, BLOCK 1, KIRKWOOD HOLLOW, PHASE II, RECORDED IN CABINET A, SLIDE 6045, PLAT RECORDS OF TARRANT COUNTY, TEXAS; DECLARING THAT SUCH EASEMENT IS NECESSARY FOR USE BY TRI-COUNTY ELECTRIC COOPERATIVE, INC; AUTHORIZING THE MAYOR TO EXECUTE THE EASEMENT DEDICATION DOCUMENTS; PROVIDING A SEVERABILTY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Southlake, Texas (“City”) is a home rule city acting under its power adopted by the electorate pursuant to Article XI, Section 5 of the Texas Constitution and Chapter 9 of the Local Government Code; and WHEREAS, the City Council of the City, after careful study and consideration, has determined that granting a permanent easement to Tri-County Electric Cooperative, Inc. (the “Tri-County Easement”) of 0.124 acres, located in the City of Southlake, is necessary for installation and maintenance of electrical equipment to be constructed to the benefit of the public; and WHEREAS, the City Council of the City has determined that there is a public need for a 0.124 acre permanent Tri-County Easement on City-owned property recorded in Cabinet A, Slide 6045, Plat Records of Tarrant County, Texas (P.R.T.C.T.). NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS, THAT: SECTION 1 The City Council approves dedicating a 0.124 acre Tri-County Easement located in the R.D. Price Survey, Abstract No. 1207 in the City of Southlake, Tarrant County, Texas and being out of a tract of land within the plat of the Kirkwood Hollow, Phase II Addition, Lots 30, Block 1 in the City of Southlake in Tarrant County, Texas, according to the plat filed in Cabinet A, Slide 6045, Plat Records of Tarrant County, Texas (P.R.T.C.T.), and said 0.124 acre tract of land being more particularly described by metes and bounds in Exhibit “A.” The easement records, dedicating the Tri-County Easement to Tri-County Electric Cooperative, Inc. in perpetuity, are attached hereto and incorporated herein as Exhibit A. SECTION 2 Ordinance No. 1275 Page 2 The Mayor of the City is hereby authorized and empowered to execute the aforementioned Tri-County Easement to permit the placement of electrical equipment. SECTION 3 A copy of the Tri-County Easement shall be presented for filing with the County Clerk of Tarrant County, Texas, by the office of the City Secretary. SECTION 4 It is hereby declared to be the intention of the City Council that the phrases, clauses, sentences, paragraphs, and sections of this Ordinance are severable, and if any phrase, clause, sentence, paragraph, or section of this Ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs, and sections of this Ordinance, since the same would have been enacted by the City Council without the incorporation in this Ordinance of any such unconstitutional phrase, clause, sentence, paragraph, or section. SECTION 5 This Ordinance shall be in full force and effect from and its passage, and it is so ordained.
