Subject: Ordinance No. 1275, 1st Reading, adopt an ordinance to
dedicate an electrical easement to Tri-County Electric at
Kirkwood/Sabre Linear Park for the North White Chapel
Boulevard – Kirkwood Branch Roadway, Bridge, Sidewalk and
Water Line Improvements Project.
Action
Requested: Ordinance No. 1275, 1st Reading, adopt an ordinance to dedicate
an electrical easement to Tri-County Electric at Kirkwood/Sabre
Linear Park for the North White Chapel Boulevard – Kirkwood Branch
Roadway, Bridge, Sidewalk and Water Line Improvements Project.
Background
Information: The purpose of this item is to present an ordinance to grant Tri-
County Electric an electrical easement at Kirkwood/Sabre Linear
Park. The existing power lines are in conflict with the upcoming
bridge improvements required for the North White Chapel Boulevard
– Kirkwood Branch Roadway, Bridge, Sidewalk and Water Line
Improvements. Due to the adjacency of the U.S. Army Corps
property, the power lines are proposed to be relocated adjacent to
North White Chapel Boulevard within the Kirkwood/Sabre Linear
Park Property.
The North White Chapel roadway at the Kirkwood Branch culvert
crossing was damaged by a significant flood event in September
2018. The road was closed until a repair project was completed in
early 2019 with the understanding that a permanent improvement
would be undertaken in the future. Halff Associates, Inc. was
selected as the design consultant to provide preliminary and final
design/engineering and construction phase services to replace the
repaired crossing and a smaller, existing crossing at South Fork
Kirkwood Branch.
Tri-County Electric, upon being notified about the project to confirm
if there is a conflict with their equipment, requested an easement on
the City’s Kirkwood/Sabre Linear Park. The proposed 0.124 acre
easement will be used to relocate existing power poles parallel to the
existing right-of-way line of North White Chapel Boulevard.

The easement will enable Tri-County to construct, maintain and
repair its facilities if the need arises and the City to eliminate two low
water crossings (critical drainage structures 2 & 3), and install a
sidewalk to connect the with the proposed capital improvement
project. The Tri-County facilities deliver electricity to power local
homes, businesses, and parks, including Clariden Ranch, The
Clariden School, Bob Jones Park and other properties to the north.
Financial
Considerations: The dedication of this easement will be at no expense to the City.

Infrastructure and Development and Objective F2: Investing to
provide & maintain high quality public assets.
Citizen Input/
Board Review: The Parks & Recreation Board considered this easement at their
February 13, 2023 meeting, approving the easement contingent on
compliance with the Comprehensive Landscape/Tree Plan. The
proposed Easement language was revised to meet these
requirements.
Legal Review: The proposed agreement is a standard agreement that the City
Attorney has reviewed and approved. City Attorney has also
reviewed and approved the proposed easement document to be
recorded with Tarrant County.
Alternatives: The Council may approve the dedication of this easement or deny it.
