Be it known, that the City of Southlake, herein after referred to as "City," and its franchised Utility Companies,
herein referred to as "Utilities," do consent and agree to permit the following
Daniel Nawar , herein after referred to as "Applicant," to use an easement, situated on or
abutting LOT 7 , BLOCK 1 , OF Shady Lane IN THE CITY OF
SOUTHLAKE, TEXAS, as described on the attached Exhibit No. 1, depicted graphically on the attached EXHIBIT
No. 2 and consented to by the public utility companies as listed on the attached EXHIBIT No. 3, to be used for the
purposes of replace existing 2 story residence with a new single 2 story residence.
and being subject to the following conditions:
I.
That the Applicant, his successors or assigns shall maintain in good condition all of the easement area and the
improvements situated thereon; and, that City and Utilities shall not become responsible for such maintenance at
any time in the future.
II.
That the Applicant shall and does hereby agree to indemnify and hold harmless the City and the Utilities from any
and all damages, loss or liability of any kind whatsoever by reason of injury to property or third person occasioned
by its use of the easement or act of omission, neglect or wrong doing of Applicant, his officers, agents,
employees, invitees or other persons, with regard to the improvements and maintenance of such improvements;
and the Applicant shall, at his own cost and expense, defend and protect City and Utilities against any and all
such claims and demands.
III.
That the Applicant shall arrange for all activities and improvements in the easements to be discontinued and / or
removed within thirty (30)days of written notification, at the discretion of City, for:
(1) Lack of maintenance to the easement;
(2) Failure to provide access to the City or its designees; or
(3) Compliance with a City Council directive that use of the easement by the Applicant be
discontinued and the cost associated with the discontinuing of such activities, and the removal of
such improvements, as well as property adjacent to the easement necessitated by such
discontinuation of the easement, shall be borne by the Applicant.
IV.
That the Applicant, his successors or assigns shall not seek compensation from City or Utilities for loss of the
value of the improvements made hereunder when such improvements are required to be removed by Applicant.

V.
This agreement shall be filed of record in the Deed Records of Tarrant County, Texas, and shall bind all future
owners of this lot and shall for all purposes be considered a covenant running with the land.

Dear Mr. Nawar:
I am writing in response to your request for approval to tear down and reconstruct the
subject residence within Government reserved flowage easement in order to cure the
Notice of Encroachment recorded in the Real Property Records, Tarrant County, Texas
under Document No. D219010961.
The Government acquired flowage easement on Tract A-39 at Grapevine Lake, Texas
up to elevation 572 feet National Geodetic Vertical Datum. As shown on the attached
licensed survey, the current stone and frame house is located above the Government's
flowage easement interest. Any future alterations made to the house within the area above
the flowage easement does not require U.S. Army Corps of Engineer (USACE) approval.
However, construction or placement of any other structures below this elevation requires
USACE approval prior to the activity. Please submit an after-the-fact request for all
structures below the flowage easement elevation depicted in the survey. Please provide
your request to the Grapevine project office within 60 days for review. Once a consent has
been fully executed by the Real Estate Contracting Officer and filed in the county records, a
release of the above mentioned Notice of Encroachment will be issued referencing the
executed consent.

WHEREAS, the United States has acquired a perpetual flowage easement over
Tract No. A-39E, Grapevine Lake, Texas, which is recorded in Deed Records, Volume
2362, Page 190, of Tarrant County, Texas:
WHEREAS, said easement grants to the United States the right of prior approval
for any structure to be located within the easement area, which area is under the
administrative control of the Fort Worth District, U.S. Army Corps of Engineers.
WHEREAS, the United States has been requested to give consent to construct,
operate and maintain a pool with jacuzzi, outdoor kitchen, concrete driveway, concrete
parking area, barn, fire pit and pond on the above-identified tract.
NOW THEREFORE, the United States hereby gives consent to
Daniel and Monica Nawar, 1033 Hatch Court, Texas 76092, to construct, operate and
maintain a pool with jacuzzi, outdoor kitchen, concrete driveway, concrete parking area,
barn, fire pit and pond, at the location shown on EXHIBITS A and B attached hereto;
PROVIDED HOWEVER, that this consent is subject to the following conditions:
1. All activities conducted on the Premises shall comply with all applicable
Federal, state, county and municipal laws, ordinances and regulations wherein the
premises are located.
2. The giving of this consent does not in any way subordinate the United States
prior easement rights. The United States shall in no case be liable for any damage or
injury to the structures herein consented to, which may be caused by any action of the
United States under its easement, or that may result from future operations undertaken
by the United States, and no claim or right to compensation shall accrue from such
exercise of the United States' easement rights.
3. The United States shall not be responsible for damages to property or injuries
to persons which may arise from or be incident to the exercise of the consented activity.
Any such damages shall be the sole responsibility of the Grantee.

4. This instrument is effective only insofar as the rights of the United States in the
premises are concerned; and the Grantee shall obtain such permission as may be
required on account of any other existing rights. It is understood that this consent does
not eliminate the necessity for obtaining any Department of the Army permit which may
be required pursuant to the provisions of Section 10 of the Rivers and Harbors Act of 3
March 1899 (30 Stat. 1151; 33 U.S.C. § 403), Section 404 of the Clean Water Act (33
U.S.C. § 1344), Section 408 (33 U.S.C. § 408) or any other permit or license which may
be required by Federal, state, interstate or local laws in connection with the use of the
premises.
5. No fill material will be brought in from above elevation 572 feet, mean sea
level, unless an equivalent amount has been excavated. Our intent is to preserve and
maintain flood storage capacity.
6. No area lying within the flowage easement shall be elevated above the 572
feet National Geodetic Vertical Datum contour, nor shall the elevation be altered in any
manner.
7. A master cutoff switch for all electric lines shall be maintained above the 572
feet National Geodetic Vertical Datum. The Grantee shall be responsible for
de-energizing the line during periods of rising waters.
8. All electrical installations shall be performed and maintained in accordance
with the requirements of the National Electric Safety Code and the National Electric
Code.
9. All pumps and electrical lines shall be located on private property.
10. Structures shall not be: 1) designed with utilities, segregated rooms, or any
other amenities that make the structure easily used or convertible for human habitation,
2) used for permanent or temporary habitation, 3) made habitable, 4) used to house any
structures, vehicles, or vessels, capable of being used for permanent or temporary
habitation, including but not limited to; RV's, boats, campers, trailers, mobile homes and
tiny homes.
11. The Grantee is responsible for ensuring that the fully executed consent
is officially recorded and filed in the county of record, and a copy is provided to
the undersigned Real Estate Contracting Officer within 30 days of receipt.

RE: Professional Opinion concerning drainage of 1033 Hatch Ct., a proposed single family residential
improvement to The City of Southlake,Tarrant County,Texas.
Dear Mr. Cohan.
I am licensed by the State of Texas as a registered Professional Engineer(#93675)and am actively engaged in the
practice of engineering. I obtained a Bachelor of Science degree in Hydrology Engineering from Tarleton State
University in 1998 and a Master of Engineering degree in Civil Engineering from the University of Texas at
Arlington in 1999. I am also a Certified Floodplain Manager ("CFM") in the State of Texas (#0474- 03). I am
currently President of G.A. Dixon Associates, LLC, a Registered Texas Engineering Firm (#15836) since 2014. My
professional engineering experience includes the evaluation and design of numerous projects involving storm
water,sewer, paving, grading, drainage, as well as providing Professional Engineering opinions as requested.
We have been retained to review the drainage concerns associated with the development of 1033 Hatch Ct. in
Southlake.
1. Development of 1033 will not impact drainage on the adjacent properties. Developments at 1033 Hatch Ct
are at a lower elevation (573.00) than the existing adjacent residence. The existing adjacent residential
structure at 1037 is at elevation 578.00. The majority of this property drains onto 1033 Hatch Ct. The existing
adjacent residential structure at 1029 Hatch Ct is at an elevation approximately 576.00. Per our Drainage
Plan water from from the adjacent properties onto the subject property at 1033 Hatch Ct.
2. We have calculated the impacts of impervious surfaces on the Proposed Drainage Plan. Based on the
increased footprint of the proposed structure and the removal of the existing barn the increase in impervious
surface from existing 21,832 sf, to Post project impervious surface 23,293 sf, results in an increase of
stormwater run off from 10.65 to 10.98 cfs per 100 yr. frequency storm.
3. Proposed development of 1033 Hatch Ct will not alter the Existing Base Flood Elevation. FEMA FIRM
48439C0105K, effective date 9/25/2099 shows the upstream elevation of the 100yr base flood elevation
upstream of 1033 Hatch Ct as 565.00. When the 565.00 elevation from the FEMA panel, is compared with
more recent NCTCOG LIDAR the footprint of the proposed structure is clearly above the 566.00 If we compare
the NCTCOG contours to the Floodplain line, it is clear the map was drawn utilizing older topographic data,
as floodplain lines should not cross topographic contours perpendicularly. In addition, the floodplain
encroachment on 1033 Hatch is the same AE Zone as Lake Grapevine which has a 100 yr. base flood elevation
of 565.00.Construction of a single-family structure at 573.00 will not impact the base flood elevation of Lake
Grapevine as the structure does encroach into the 100 yr.floodplain.
