Action Requested: Authorize expenditures with Freese and Nichols for consulting services for the Lead and Copper Rule Revisions compliance program in an amount not to exceed $97,563. Background Information: The purpose of this item is to authorize expenditures with Freese and Nichols for consulting services for the Lead and Copper Rule Revisions compliance program in an amount not to exceed $97,563. Since 1991, the Environmental Protection Agency (EPA) has revised the original Lead and Copper Rule to strengthen drinking water standards to protect public health. Lead is not naturally occurring in drinking water, and enters drinking water when plumbing materials containing lead corrode. The most common sources of lead in drinking water are lead pipes, faucets, and fixtures. The most recent revisions published in 2021 significantly increased the requirements of public water systems, including new action levels, school and childcare monitoring, customer communications, lead service line inventory, and service line replacement plan. The most pressing of these requirements is the establishment of a lead service line inventory, which is due by October 2024. As a public water system, the City of Southlake is required by the Safe Drinking Water Act to comply with all aspects of the Lead and Copper Rule Revisions. Because of the extensive requirements of the Lead and Copper Rule Revisions, the City has collaborated with Freese & Nichols to create a scope to comply with the updated regulation. The requested action includes phase 1 and 2, which includes: Item 4H Page 2 of 2 • Development of an initial service line inventory through desktop and field analysis • Development of inventory of schools and childcare facilities • Assessment of water quality data to understand potential for lead detections above the LCRR trigger and action levels • Development of proposed schedule and level of effort for service line inventory completion Future funding to address the remaining requirements of this rule will be requested in future fiscal years. Financial Considerations: Funding for the proposed services is budgeted in the approved FY 2023 Utility Fund operating budget.
