2000-06-26 CC Packet June Retreat City of Southlake, Texas MEMORANDUM June 23, 2000 TO: Honorable Mayor and Members of City Council FROM: Billy Campbell, City Manager SUBJECT: Agenda Item Comments for City Council June Retreat, June 26 & 27, and Other Items of Interest. Thank you all for agreeing to take time out of your schedule to meet on Monday. June 26 and Tuesday, June 27 for the annual June Retreat. As we have mentioned to you in previous correspondence, this year's retreat will follow a different format than in years past. The following information is provided to assist you in preparing for the retreat. Day One Monday, June 26, has been structured as a business meeting, allowing you to formally act on the posted items. We will begin promptly at 4:00 p.m. and will immediately go into an extended Executive Session. We anticipate that the Executive Session will last about two hours, which will give us the time we need to fully acclimate new councilmembers to current legal issues as well as provide for a full discussion of each item. The expected outcome of this session is Council understanding of the issues related to each item, and clear direction to staff on how to proceed with each. The following is a brief description of each Executive Session item: • Executive Session la. Pioneer Concrete. Council hired Brent Ryan, an Austin-based attorney with specialization in administrative law, to represent our interests before the Texas Natural Resource Conservation Commission (TNRCC), through which Pioneer Concrete is seeking a permit renewal. Brent has done an excellent job of slowing the process through the TNRCC. Without his intervention, it is likely that the matter would have been handled very quickly through the TNRCC staff, and very little attention would have been given to the concerns raised by Southlake residents living in the vicinity of Pioneer Concrete. The latest information we have at this time is that the Honorable Mayor and Members of City Council Agenda Item Comments for City Council June Retreat for June 26 & 27. 2000 Page 2 of 11 TNRCC staff intends to forward the application for the Commission to review. It will be four to six weeks before the Commission will be able to take up the matter. It is our intent to discuss the details of this case with you so that all of our options are considered within the context of Pioneer Concrete's history in Southlake. As we have previously noted. TNRCC permitting is only one issue. Council may wish to consider this issue in the context of land use and zoning. Please contact Shana Yelverton or Karen Gandy if you have any questions on this item. Executive Session lb. Marylyn Miles property. We want to familiarize the Council with Ms. Miles' development options. with particular emphasis on access issues. She has recently indicated to staff that she is ready to begin developing her property. As such, your familiarity with the legal issues is important so that we are ready to respond when, and if, she decides to submit an application to the Planning Department. Please contact Shana Yelverton or Kevin Hugman if you have questions on this item. Executive Session lc. Pearson Property. You will recall discussing this item at your June 6 Council meeting. We plan to go back through the material with you and listen to your thoughts on how you would like to approach selling the property. Let Shana Yelverton know if you have any questions on this item. Executive Session Id. Common law doctrine of incompatibility. The Attorney General issued an opinion on May 22. 2000 on this subject. once again dealing with the issue of whether an individual with appointing power may appoint himself to another office or position, e.g., an advisory board. Staff asked our attorneys to review the opinion to determine whether the ruling could have any impact on the City of Southlake boards that have Council participation. In summary, our attorneys have determined that that common law doctrine of incompatibility has been superseded by statutory law with regard to Southlake's affected boards. Therefore, it is appropriate for the City Council to appoint its own members to these boards. A copy of the city attorney's opinion is included in your Honorable Mayor and Members of City Council Agenda Item Comments for City Council June Retreat for June 26 & 27, 2000 Page 3 of 11 packet for review. Allen Taylor will be prepared to answer questions on the opinion. should you desire to discuss it. Executive Session le. Southlake Commons Appeal. While most of you are familiar with this issue, Allen Taylor plans to give you the latest update. Please contact Karen Gandy if you have questions prior to the meeting. Executive Session 2a, Land acquisition for public works improvements. It is anticipated that we also will ask you to authorize us to enter into contracts for the purchase of ROW at the intersection of White Chapel Boulevard and SH 114, since our negotiations are almost complete. Agenda Item No. 4A. ZA 00-061, Revised Site Plan for Kirby's Steakhouse. This property is located at the southeast corner of SH 114 and FM 1709, south of Texas National Bank. The plan proposes approximately 500 square feet of new dining area on the north side of the existing Kirby's restaurant and revises the north elevation. Results of these changes include an increase in the interior landscape plantings required with the additional square feet, and compliance with building articulation in the Corridor Overlay Zone. Although there is a decrease in the impervious coverage on the site, it is still within ordinance requirements. There is no significant impact on driveways and no additional parking is needed. The applicant is seeking relief on the requirement of planting one additional canopy tree on the site. and from horizontal articulation on the north wall, only. The new wall exceeds the maximum length allowed by approximately 3'. The previously approved elevations were in compliance with articulation. On June 22, 2000. the Planning and Zoning Commission recommended approval (7 - 0) subject to Staff Review Summary No. 2, dated June 16, 2000. and granting relief on the additional canopy tree planting and the horizontal articulation on the north wall. The commission concurred with the Honorable Mayor and Members of City Council Agenda Item Comments for City Council June Retreat for June 26 & 27. 2000 Page 4 of 11 applicant's evaluation of the site that there is no room on the site to place the additional canopy tree. At the meeting, the applicant indicated it was adding, additional accent trees on site. Contact Karen Gandy or Dennis Killough regarding this item. Agenda Item No. 5A. Ordinance No. 480-346, 1" Reading, ZA 00-47, Rezoning, tracts 4G1 and 4H. J.J. Freshour Survey, 4.0 acres. This property is located on Johnson Road. approximately 660' east of North Pearson Lane, west of and adjacent to Vista Trails Subdivision. This request is for "SF-1A" zoning from "AG." The property is currently undeveloped and heavily treed. This request is consistent with the Land Use Plan. The following item (Z400-38) is the associated plat. Please see the issues associated with the plat. On June 22, 2000, the Planning and Zoning Commission recommended approval (7-0). Contact Karen Gandy or Dennis Killough regarding this item. Agenda Item No. 5B. ZA 00-038, Plat Showing for Lots 9 & 10, J.J. Freshour No. 521 Addition. This property is located on Johnson Road, approximately 660' east of North Pearson Lane, west of and adjacent to Vista Trails Subdivision. This is a request to plat two residential lots from an existing tract currently configured as a '`flag lot." Each proposed lot contains approximately 2 acres. The property is currently undeveloped and heavily treed. This case is associated with the zoning case (ZA 00-037) above. The property is bound on the east by 10 developed residential lots of the platted Vista Trails subdivision. There are three adjacent residences on the west side of the property, on two platted lots and one unplatted tract. The issue is that this is a "flag lot" with limited street frontage on Johnson Road. The lots are configured such that they provide a long narrow driveway approximately 700' from Johnson Road, Honorable Mayor and Members of City Council Agenda Item Comments for City Council June Retreat for June 26 & 27, 2000 Page 5 of 11 to the proposed house locations. The applicants have worked with the Fire Marshall to address fire protection and emergency access and will comply with those applicable city ordinances, including fire lane and fire hydrant requirements. The applicant indicated the homes will be constructed with fire sprinkler systems. The applicant is requesting relief on the Subdivision Ordinance requirement to provide 100' of lot width at the minimum front building line. On June 22, 2000, the Planning and Zoning Commission recommended approval (7-0) and granted relief on the lot width requirement. There was a good deal of discussion regarding emergency access and construction of same. The applicant and staff assured P&Z that ample research went into the review of the access and the applicant must comply with all applicable code requirements at the time of building permit. Contact Karen Gandy or Dennis Killough regarding this item. Agenda Item No. 5C. Ordinance No. 480-347, 1" Reading. ZA 00-040, Rezoning and Site Plan for Georgetown Park, Phase III. This property is located on Southlake Boulevard approximately 700' east of South Kimball Avenue and 700' south of East Southlake Boulevard, northeast of the Meadow Oaks Subdivision. This request is for "O-1" zoning from "C-2." The property is currently developed with an office building, per a previously approved site plan. The applicant is rezoning to the "O-1" district in order to seek a Specific Use Permit for the addition of a carport. The SUP request will be forwarded to the Council at 2nd reading of the zoning, if approved. In order to seek a rezoning in the Corridor Overlay Zone, the applicant must present a site plan with any proposed improvements. Therefore you have a site plan showing the car port location but the details of the carport are a product of the SUP which is not up for consideration at this time. Contact Karen Gandy or Dennis Killough regarding this item. Agenda Item No. 5D. Mid-Year Budget Review. Sharen Elam has prepared a mid-year financial review for the first eight months of the fiscal year 2000. The mid year review focus on receipts from October 1999 through May 2000 and how the total relates to the amount budgeted. Included in this report is a copy of the General Fund Statement of Revenues, Expenditures and Changes in Fund Balance for the period ended May 2000. Also, included is the Water and Sewer Enterprise Fund Comparative Statement of Revenues and Expenses for the period ended May 2000. If you have any questions regarding this item please contact Sharen Elam. Agenda Item No. 5E. Ordinance No. 756-A, 1" Reading, Revisions to the FY 99-00 Budget. Ordinance No. 756-A is presented to the Council to reflect the proposed mid-year changes to the Adopted FY 1999-2000 Budget. There are only 3 divisions proposing an increase as outlined in Sharen's memo, however, in total the proposed FY 1999-2000 budget reflects a decrease in revenues and expenditures of $134.853 and $630,965, respectively. It is anticipated that fund integrity will be maintained, as the expenditure adjustments reflect the general fund balance at 15.3 %. This is within the adopted Fund Balance Policy, which states a minimum balance of 15% and an optimum balance of 25%. However, during the June Retreat we will discuss the FY2000-2001 budget challenges the City is facing due to starting the fiscal year with the minimum fund balance reserve and increasing debt service payments. If you have any questions please contact Sharen Elam. Day Two (Solana Education Center) Day Two will begin promptly at 8:30 a.m. with breakfast. We plan to spend the morning discussing Council goals for the upcoming year, working through your priority rankings to achieve consensus on how to proceed with the list of projects (note that your packet includes the results of City Council Honorable Mayor and Members of City Council Agenda Item Comments for City Council June Retreat for June 26 & 27, 2000 Page 7 of 11 rankings). and working on how to improve communications between staff and Council. Note that we will be bringing in a facilitator for the session to ensure that we stay on track and focused and to ensure maximum participation by all councilmembers. At lunch, the directors will join us for a roundtable discussion on operational issues. We have been compiling a list of topics based on your input and will be ready to cover all of those items with you. Suggested topics include things like the capital improvement plans for public works and parks, the neighborhood sewer program. easement acquisition procedures, our new DPS staffing initiatives, planning issues (outside storage, gasoline station regulations, and the unified development code), and other items. While we are preparing for discussion of these items, the planned informality of the roundtable discussion will allow you to bring up anything you wish. Other Items of Interest Multi-way stop sign at East Continental and South Carroll. The Public Works staff recently received a Multi-way Stop Warrant Study for the intersection of South Carroll and East Continental. Our traffic engineer, Lee Engineering, did the warrant study. The study looked at the three warrants required for the installation of a multi-way stop sign and found that the intersection met two of the three warrants: number of preventable accidents, and the amount of traffic on each leg of the intersection. Based upon this study the Public Works Department will install additional stop signs at this location within the next two weeks. Staff has received compliments and thanks for the installation of the additional stop signs at Byron Nelson and Continental. Observations of traffic at this intersection do not reveal any extensive delay for through traffic. Honorable Mayor and Members of City Council Agenda Item Comments for City Council June Retreat for June 26 & 27, 2000 Page 8 of 11 Attorney representation at P&Z meetings. I feel there is a need to reallocate our attorney's time at the P&Z meetings. Some options would be to 1) have an attorney there during times for issues we have identified early on that would require the attorney's attention; 2) have an attorney at every meeting, but only for the first session to answer any questions for the remaining sessions; and 3) we always recommend, if P&Z has questions for the attorney, that they forward them to us and we will ensure they are answered in a timely fashion. I would be interested to hear your thoughts on this matter. New Chamber Logo/City Logo. I have talked with Greg Last. who attends the majority of the Chamber meetings, about the Chamber's involvement on the logo issue. By now we are all familiar with Brad Bradley's push to change the City logo. The City's entire aesthetic and physical makeup has been built around the current logo. It is on all printed materials, city vehicles, embroidery work on DPS uniforms, and every uniform furnished by the city has this logo either embroidered or embossed on it. Each one of you can decide whether this logo symbolizes the city of Southlake. There may be a time that we would want to look at other design alternatives, but it would be my suggestion that if there is a change, it would not be made in budget year 2001. It would be prudent of us to let the Chamber know early on what the City's standpoint is on this issue so that they will know how to proceed. Please let me know how you wish to handle this issue. Future Dreams statute. Tony Eubanks called and stated that the gentleman who has the mold for the Future Dreams statute wants to know what to do with it. Evidently it is in his way, and we have already paid for it. If you will recall, we visited about a year ago on the status of the statute without coming to any serious conclusion. I think our options are to A) adopt it in it's original form with the possibility of placing a larger statue in or around Town Hall as originally planned; B) adopt it in some other form, which would require additional cost for redesign; or C) bring the project to a conclusion and not spend any further money. There may be other alternatives that you would wish us to explore and I would like your thought on this issue. I will briefly touch on this at the retreat. I told Mr. Eubanks that I would get back with him on Wednesday with some direction. We should be Honorable Mayor and Members of City Council Agenda Item Comments for City Council June Retreat for June 26 & 27, 2000 Page 9 of 11 mindful that these molds do not age well; there is a certain amount of deterioration over time and eventually the mold will not be useable. Change in Term for Judge. Judge Bradley will probably contact each of you to discuss both the change in term of office and other issues surrounding the Southlake judgeship. It is my understanding that he would like to resign as the elected judge and then be appointed (as the new law states) as the Municipal Court of Record Judge for the City of Southlake and also gain employment in other cities as their judge. These issues are outside the purview of the City Manager's office. However, in order to conduct City business, we would like to adopt the ordinance that was discussed at your last meeting, as dictated by state law. The ordinance allows you as the Council to establish two- or four-year terms at your discretion. We should adopt this ordinance early so that we can have all business matters in place at the end of the term for the current judge, but you do not have to take any action on who you want to appoint as city judge until the current term expires in May 2001. Extension of FM 1938. Mayor Stacy and I met with various representatives of our contiguous cities and Metroport Transportation Committee members to discuss the extension of FM 1938 from FM 1709 to SH 114. As most of you know, I try to allow political bodies to bring forth those issue that are important to them and then have staff work toward a successful conclusion. In this particular case, I would like to emphasize the importance of this project. I believe it is imperative that we work as a group to extend this roadway. I feel that there are a lot of advantages (that I will illustrate in a later memo) in working collectively for this expansion. The advantages are not for the sole benefit of our contiguous cities: Southlake's traffic management plan needs this north-south road. I would like to bring forward a resolution that encourages our dedication to this project. As you will recall the last time this plan came forward, various individuals in Westlake were adamant that this project not go forth. Those bridges have been crossed and the Town of Westlake has acquired all of its needed right-of-way. If we go forward with this project, the county will likely acquire the Southlake and Keller portion of the right-of-way needed. Our fiscal participation may be limited to contributing to engineering design work with the cost of that being funded by the various Honorable Mayor and Members of City Council Agenda Item Comments for City Council June Retreat for June 26 & 27, 2000 Page 10 of 11 municipalities, Metroport Cities, and private corporations such as Sabre. Fidelity, and Maguire Partners. I am unable to explain the full financial impact due to the fact that we have not received engineering figures or talked with the corporate partners. As I bring the resolution forward, I will illustrate methods for funding, probable city participation, and other pertinent information such as daytime population of Fidelity and Sabre and the current and future impact on Davis Boulevard and on our minimal number of north-south roads. We currently have this impact today without the extended road: we will double or triple our count. which will create more cut-through traffic through our neighborhoods. This road extension also will serve as a viable solution for Southlake in regard to Trophy Club's traffic problems. This issue has been raised because the Attorney General issued an opinion May 22, 2000, on this subject. Attorney General's Opinion No.JC-0225 The new opinion, No. JC-0225, concerned whether the city council of the City of San Antonio could appoint one of its members to the Board of Directors of the Greater Kelly Development Authority ("GKDA"). It is significant to the opinion that the GKDA is a separate political subdivision created under Chapter 378, Local Government Code. The Attorney General ruled in this case that the "common law doctrine of incompatibility" prevented the city council members from appointing themselves to this board. This ruling is consistent with previous Attorney General rulings that an individual with appointing power may not appoint himself to another office or position. Nevertheless,the Attorney General recognized in Opinion No.JC-0225 that the common law doctrine of incompatibility may be superseded by other law. In fact, in previous opinions the Attorney General has ruled that a home rule city may exercise its legislative authority to except city officers from the common law doctrine of incompatibility under certain circumstances,thus allowing the city council to appoint its members to city boards. In Opinion JC-0225, however,the previous opinions recognizing the authority of city officers in a home rule city to appoint themselves within the city structure were distinguished from the San Antonio situation. Since the GKDA is a separate political subdivision,the Attorney General does not consider it to be within the city structure. The ruling in Opinion No.JC-0225 stands for the proposition that a home rule city may not exempt itself from the common law doctrine of incompatibility when it comes to appointments to boards of other political subdivisions. Only the Legislature has that authority. f Applied to Specific Boards How this opinion and other Attorney General opinions affect the appointments to boards in the City of Southlake,depends on relevant statutes,the city charter,and ordinances of the city. You have asked that I look at two of the city's boards to determine whether council members may properly be appointed to them. The first board you inquired about is the Southlake Park Developmen t Corporation board of directors. This board is created pursuant to Section 4B, Article 5190.6, Texas Vernons Civil Statutes(the Development Corporation Act). Subsection(c)of Section 48 of the Act provides for a board of seven members and states the following: Three directors shall be persons who are not employees, officers, or members of the governing body of the eligible city. This provision has been interpreted as authority for a city council to appoint up to four of its own members as members of the 4B board of directors and supersedes the common law doctrine of incompatibility. For this reason city council members may serve on the board of directors of the Southlake Park Development Corporation. You also asked about the board of the Southlake Reinvestment Zone. This board was created pursuant to Section 311.009, Texas Tax Code. This section establishes the eligibility requirements for members of the board. In addition to this codified section of the Tax Increment Financing Act,there is an uncodified section which was enacted by the Legislature in 1999 and is included as a statutory note in the published version. This provision reads as follows: Nothing in this Act is intended to prohibit a member of a governing body of a taxing unit that levies taxes on real property in the reinvestment zone from serving as a member of the board of directors of a reinvestment zone under the Tax Increment Financing Act (Chapter 311,Tax Code). This language clearly indicates that the Legislature intended that members of a governing body could appoint themselves to the reinvestment zone board. In addition, city Ordinance No. 761 provides that a member of the board"who is a member of the City Council shall cease to be a member at the time he or she ceases to be a member of the City Council." This stipulation is within the authority of the city as a corollary to the requirement that board members serve at the pleasure of the city council. Summary In the case of the two city boards to which the city council has appointed its own members, the common law doctrine of incompatibility has been superseded by statutory law. These revisions are based on the comments from the Southlake staff that we received on May 16, 2000. In conjunction with this site plan amendment, we are requesting three variances. The first and second have to do with city's articulation requirements. As I expressed in our initial submittal letter dated May 1, 2000 to Lisa Sudbury, the need for these variances is based on the seating constraints within the restaurant. The third variance is in regards to the city's landscape requirements. Due to the 498 square foot expansion, we are required to provide an additional canopy tree, an additional ornamental tree, and six additional shrubs. The crape myrtle highlighted in the lower right hand corner of the attached landscape plan will be added per the city's requirements. In addition, the 2 crape myrtles adjacent to the restaurant that are highlighted will be relocated to accommodate the expansion. The six shrubs will be used to accent the expansion. We are however asking not to have to provide the additional canopy tree. As you can see from the attached landscape plan, the site is heavily landscaped today. We feel that an additional canopy tree with it's 20' - 30' wide canopy will only crowd out the existing trees on the property and only provide minimal benefit to the site. WHEREAS, the City of Southlake, Texas is a home rule City acting under its Charter adopted by the electorate pursuant to Article XI, Section 5 of the Texas Constitution and Chapter 9 of the Texas Local Government Code; and, WHEREAS, pursuant to Chapter 211 of the Local Government Code, the City has the authority to adopt a comprehensive zoning ordinance and map regulating the location and use of buildings, other structures and land for business, industrial, residential and other purposes, and to amend said ordinance and map for the purpose of promoting the public health, safety, morals and general welfare, all in accordance with a comprehensive plan; and WHEREAS, the hereinafter described property is currently zoned as "AG" Agricultural Case No. Agenda Item Attachment C ZA00-037 5A Page 1 District under the City's Comprehensive Zoning Ordinance; and WHEREAS, a change in the zoning classification of said property was requested by a person or corporation having a proprietary interest in said property; and WHEREAS,the City Council of the City of Southlake, Texas, at a public hearing called by the City Council did consider the following factors in making a determination as to whether these changes should be granted or denied: safety of the motoring public and the pedestrians using the facilities in the area immediately surrounding the sites; safety from fire hazards and damages; noise producing elements and glare of the vehicular and stationary lights and effect of such lights on established character of the neighborhood; location, lighting and types of signs and relation of signs to traffic control and adjacent property; street size and adequacy of width for traffic reasonably expected to be generated by the proposed use around the site and in the immediate neighborhood; adequacy of parking as determined by requirements of this ordinance for off-street parking facilities; location of ingress and egress points for parking and off-street loading spaces, and protection of public health by surfacing on all parking areas to control dust; effect on the promotion of health ad the general welfare; effect on light and air; effect on the over-crowding of the land; effect on the concentration of population, and effect on transportation, water, sewerage, schools,parks and other public facilities; and, WHEREAS, the City Council of the City of Southlake, Texas, further considered among other things the character of the districts and their peculiar suitability for particular uses and the view to conserve the value of the buildings, and encourage the most appropriate use of the land throughout this City; and, WHEREAS, the City Council of the City of Southlake, Texas, does find that there is a public necessity for the zoning changes, that the public demands them, that the public interest clearly Case No. Agenda Item Attachment C ZA00-037 5A Page 2 requires the amendments, and that the zoning changes do not unreasonably invade the rights of those who bought or improved property with reference to the classification which existed at the time their original investment was made; and, WHEREAS, the City Council of the City of Southlake, Texas, does find that the changes in zoning lessen the congestion in the streets, helps secure safety from fire,panic, and other dangers, promotes the health and the general welfare, provides adequate light and air, prevents the over- crowding of land, avoids undue concentration of population, and facilitates the adequate provision of transportation, water, sewerage, schools, parks and other public requirements; and, WHEREAS, the City Council of the City of Southlake, Texas, has determined that there is a necessity and need for the changes in zoning and has also found and determined that there has been a change in the conditions of the property surrounding and in close proximity to the tract or tracts of land requested for a change since the tract or tracts of land were originally classified and therefore feels that the respective changes in zoning classification for the tract or tracts of land are needed, are called for, and are in the best interest of the public at large, the citizens of the city of Southlake, Texas, and helps promote the general health, safety and welfare of the community. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS: SECTION 1. That Ordinance No. 480, the Comprehensive Zoning Ordinance of the City of Southlake, Texas, passed on the 19th day of September, 1989, as originally adopted and amended, is hereby amended so that the permitted uses in the hereinafter described areas be altered, changed and amended as shown and described below: Being Tracts 4G1 and 4H situated in the J. SECTION 2. That the City Manager is hereby directed to correct the Official Zoning map of the City of Southlake, Texas, to reflect the herein changes in zoning. SECTION 3. That in all other respects the use of the tract or tracts of land herein above described shall be subject to all the applicable regulations contained in said Zoning Ordinance and all other applicable and pertinent ordinances for the City of Southlake, Texas. All existing sections, subsections,paragraphs, sentences, words, phrases and definitions of said Zoning Ordinance are not amended hereby, but remain intact and are hereby ratified, verified, and affirmed. SECTION 4. That the zoning regulations and districts as herein established have been made in accordance with the comprehensive plan for the purpose of promoting the health, safety, morals and the general welfare of the community. They have been designed, with respect to both present conditions and the conditions reasonably anticipated to exist in the foreseeable future; to lessen congestion in the streets; to provide adequate light and air; to prevent over-crowding of land; to avoid undue concentration of population; and to facilitate the adequate provision of transportation, water, sewerage, drainage and surface water, parks and other commercial needs and development of the community. They have been made after a full and complete hearing with reasonable consideration among other things of the character of the district and its peculiar suitability for the particular uses and with a view of conserving the value of buildings and encouraging the most appropriate use of land throughout the community. That this ordinance shall be cumulative of all other ordinances of the City of Southlake, Texas, affecting zoning and shall not repeal any of the provisions of said ordinances except in those instances where provisions of those ordinances are in direct conflict with the provisions of this ordinance. SECTION 6. That the terms and provisions of this ordinance shall be deemed to be severable and that if the validity of the zoning affecting any portion of the tract or tracts of land described herein shall be declared to be invalid, the same shall not affect the validity of the zoning of the balance of said tract or tracts of land described herein. SECTION 7. Any person, firm or corporation who violates, disobeys,omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this ordinance shall be fined not more than Two Thousand Dollars ($2,000.00) for each offense. Each day that a violation is permitted to exist shall constitute a separate offense. SECTION 8. All rights and remedies of the City of Southlake are expressly saved as to any and all violations of the provisions of Ordinance No. 480, as amended, or any other ordinances affecting zoning which have accrued at the time of the effective date of this ordinance; and, as to such accrued violations and all pending litigation, both civil and criminal, whether pending in court or not,under such ordinances, same shall not be affected by this ordinance but may be prosecuted until final disposition by the courts. SECTION 2. That the City Manager is hereby directed to correct the Official Zoning map of the City of Southlake, Texas, to reflect the herein changes in zoning. SECTION 3. That in all other respects the use of the tract or tracts of land herein above described shall be subject to all the applicable regulations contained in said Zoning Ordinance and all other applicable and pertinent ordinances for the City of Southlake, Texas. All existing sections, subsections, paragraphs, sentences, words, phrases and definitions of said Zoning Ordinance are not amended hereby, but remain intact and are hereby ratified, verified, and affirmed. SECTION 4. That the zoning regulations and districts as herein established have been made in accordance with the comprehensive plan for the purpose of promoting the health, safety, morals and the general welfare of the community. They have been designed, with respect to both present conditions and the conditions reasonably anticipated to exist in the foreseeable future; to lessen Case No. Agenda Item Attachment G ZA00-040 5C Page 4 congestion in the streets; to provide adequate light and air; to prevent over-crowding of land; to avoid undue concentration of population; and to facilitate the adequate provision of transportation, water, sewerage, drainage and surface water, parks and other commercial needs and development of the community. They have been made after a full and complete hearing with reasonable consideration among other things of the character of the district and its peculiar suitability for the particular uses and with a view of conserving the value of buildings and encouraging the most appropriate use of land throughout the community. SECTION 5. That this ordinance shall be cumulative of all other ordinances of the City of Southlake, Texas, affecting zoning and shall not repeal any of the provisions of said ordinances except in those instances where provisions of those ordinances are in direct conflict with the provisions of this ordinance. SECTION 6. That the terms and provisions of this ordinance shall be deemed to be severable and that if the validity of the zoning affecting any portion of the tract or tracts of land described herein shall be declared to be invalid, the same shall not affect the validity of the zoning of the balance of said tract or tracts of land described herein. SECTION 7. Any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this ordinance shall be fined not more than Two Thousand Dollars ($2,000.00) for each offense. All rights and remedies of the City of Southlake are expressly saved as to any and all violations of the provisions of Ordinance No. 480, as amended, or any other ordinances affecting zoning which have accrued at the time of the effective date of this ordinance; and, as to such accrued violations and all pending litigation, both civil and criminal, whether pending in court or not, under such ordinances, same shall not be affected by this ordinance but may be prosecuted until final disposition by the courts. SECTION 9. The City Secretary of the City of Southlake is hereby directed to publish the proposed ordinance or its caption and penalty together with a notice setting out the time and place for a public hearing thereon at least ten (10) days before the second reading of this ordinance, and if this ordinance provides for the imposition of any penalty, fine or forfeiture for any violation of any of its provisions, then the City Secretary shall additionally publish this ordinance in the official City newspaper one time within ten (10) days after passage of this ordinance, as required by Section 3.13 of the Charter of the City of Southlake. SECTION 10. This ordinance shall be in full force and effect from and after its passage and publication as required by law, and it is so ordained. This discussion of revenues will focus on receipts from October 1999 through May 2000 and how the total relates to the amount budgeted. Included in this report is a copy of the General Fund Statement of Revenues, Expenditures and Changes in Fund Balance for the period ended May 31. 2000 with comparative actual amounts for the period ended May 31, 1999. Also included is the Water and Sewer Enterprise Fund Comparative Statement of Revenues and Expenses for the period ended May 31. 2000 and May 31. 1999. These reports reflect the final audited amounts for FY1998-99 as reported in the City's Comprehensive Annual Financial Report. GENERAL FUND REVENUES PROPERTY TAX. In the General Fund, $5.514.843 of $6,562.798 or 84.0%. of budgeted property tax has been collected. Since property tax bills are delinquent as of February 1. most tax collections are received in the first four months of the fiscal year. Although this collection percentage is slightly lower when compared to last year it is anticipated that collections will meet projections. Tarrant County has collected the City's taxes since 1982. FRANCHISE FEES. Franchise fees include amounts received for use of public rights of way from TU Electric, Tri-County Electric, Southwestern Bell Telephone, General Telephone. and Charter Cable. The FY1999-2000 budget estimated a 15% increase over actual FY1998-99 receipts, unless there was a set contract amount, such as that for Southwestern Bell. To date the City has received $1.045,747 of $1.288,296 budgeted. Electric utility franchise receipts are below the budget amount by $61,556. Cable franchise fees are $29.572 ahead of estimates. The Gas franchise collected is below the budgeted amount by $45,797. For two quarters, $137,482 has been collected from GTE and Southwestern. Bell; another $155,000+ is expected for the remainder of the year. It is anticipated that revenues from Franchise Fees will fall below the budgeted amounts by approximately $102,000. FINES/FORFEITURES. Revenues from Fines and Forfeitures are $649,445, which is 77.7% of the $835,798 budgeted. This revenue source depends on many variables, such as the number of citations issued, warrants issued and collected, plus the number of cases assigned to deferred adjudication. Citation volume is expected to remain consistent, and revenues from fines are anticipated to meet or slightly exceed budget. CHARGES FOR SERVICES. This category includes revenue from ambulance transport, recreation class fees, and amounts received from the Cities of Grapevine, Colleyville, Trophy Club and the Grapevine/Colleyville and Carroll School Districts for participation in the Teen 5D-1 Court program. Revenues to date total $230,658, compared with $348,371 last year. Recreation fees make up the greatest part of the amounts collected to date, $198,408. It is anticipated that revenues from Charges for Services will be within budgeted amounts. SALES TAX. Sales tax (1%) budgeted for Fiscal Year 1999-2000 is $3,569,839. which is an increase of 16.3% over last year's actual collections of$3,067,546. For October 1999 through May 2000, (eight months collections) the City has collected $2,389,927 in sales tax. This is 2.8%, or $65,962 above the projected amounts to date. The following table shows actual FY1998-99, plus the budget and actual to date for eight months (through May) collections for FY1999-2000. Revenues from permits and fees are $1,667,438, or 86.1% of the budgeted amount of$1,937,565. This is more than the $1,484,781 collected as of May 31, 1999. MISCELLANEOUS. This category includes amounts received for copies of ordinances. revenue from tower leases, the 10% administrative fee retained from Municipal Court State taxes remitted quarterly to the Comptroller, and fees received for police accident reports. The City has received $178,979 to date. Revenues from miscellaneous income will meet or slightly exceed the $182,954 budgeted. INTEREST INCOME. Interest earnings to date total $155.813. The total collected is on target with the $190,000 budgeted for the year. GENERAL FUND EXPENDITURES For the first eight months, or 66.67% of the fiscal year. General Fund total expenditures are $10,977,171, or 65.5% of the $16,768,018 amended budget. A brief discussion of each department will follow, providing a summary explanation of major expenditure trends. General Government Department. Department expenditures for the City Secretary's Office, Human Resources, City Manager's Office, and Support Services total $2,406,146, which is 64.5% of budget. Personnel, legal services and utility expenditures are on target with budget. Therefore it is anticipated that expenditures in General Government will be within the amount budgeted. Finance Department. For the Finance, Municipal Court, and Teen Court Divisions, total expenditures to date are $611,649 or 66.7% of the $917,218 budgeted. Personnel, operations and capital expenditures are within budget. Public Safety Department. Total expenditures for Police Services, Fire Services, Public Safety Support, and Building Inspections are $5,109,978, which is 71.2% of the $7,179,314 budgeted. Currently, overtime expenditures are running slightly ahead of budget. This is due to the under- 5D-3 expenditure for personnel services resulting from understaffing at the beginning of the year. It is anticipated that total Operations and Capital expenditures will finish the year within budget. Public Works Department. Budgeted within this department are Streets/Drainage, and Public Works Administration. Expenditures to date are $1,137,513 or 64.2% of the $1,770.749 budgeted. Personnel, operations and capital expenditures are within budget. Planning Department. The department has expended $320,428, or 58.7% of the $545,420 budgeted for the year. Expenditures in the Department are within budget. Economic Development Department. The department has expended $140,010, or 59.9% of the $233,815 budgeted for the year. Expenditures in the Department are within budget. Community Services Department. Total expenditures for Community Services, Parks and Recreation, and Library Services are $1,251,447 or 52.3% of the $2,390,769 budgeted. Personnel expenditures are on target with budget. There is $109,000 allocated for contract mowing during the summer months, consequently minimal expenditures have been made on this line item. Many of the recreation programs are planned for the summer months, therefore only $102,357 of the $200,000 budgeted for revenue-supported contract instructors has been spent through May. In Community Services, the contracts for the community service groups have been executed and disbursed, with $54,213 spent to date. Expenditures in the Department are expected to be within budget projections. WATER AND SEWER ENTERPRISE FUND Revenues. As of May 31, 2000, the City has received $5,933,630 or 57.1%, in revenues of the $10,395,527 estimated. This is compared to $5,595,466 received through May of last year. The majority of revenue is received in the summer months. Total revenues for the year will most likely be within budget amounts. Expenses. The City has expended $5,196,646 or 55.0%, of the $9,444,237 budgeted for personnel, operations, capital, and debt services expenses. Of the total expenses, $1,475,098 has been paid to the Cities of Fort Worth and Trophy Club for treated water, while $856,540 has been paid to the Trinity River Authority for debt service, together accounting for over 45% of total expenses to date. DEBT SERVICE FUND The City has received $2,829,780 in current and delinquent ad valorem taxes through May 2000. There has been $16,224 interest earned and $816,445 transfers from other funds for debt service. These amounts are within budget. The remainder of annual debt service requirements will be paid in August, according to the bond payment schedules. 5D-4 s SOUTHLAKE PARKS DEVELOPMENT CORPORATION Operating Fund. As of May 31, 2000, $1,194,965 in the % cent sales tax has been collected. SPDC sales tax receipts are 6.0% above estimates, or $67,585. $327.791 has been transferred to the SPDC Debt Service Fund for debt service payments. CRIME CONTROL AND PREVENTION DISTRICT Operating Fund. Through May, $1,128,382 in the '/ cent sales tax has been collected. Sales tax receipts are 5.97% above estimates, or$63,525. PARK DEDICATION FEE FUND Revenues. The City has collected $55,925 of the $100.000 budgeted for the year. Ordinance No. 756-A, 'S` Reading, Amending Ordinance No. 756, amending FY 99-00 Annual Budget. Action Requested: City Council consideration of Ordinance No. 756-A to amend the FY1999-2000 Annual Budget. Background Information: Ordinance No. 756-A is presented to the Council to reflect the proposed mid year changes to the Adopted FY1999-2000 Budget. The amendments to the budget reflect a decrease in revenues and expenditures of $134,853 and $630,965, respectively. "Exhibit A" is an attachment to the ordinance, and includes a summary of the proposed revenue and expenditure revisions titled "Proposed Mid Year Budget Revisions FY 1999-2000". Division 100, City Secretary reflects a proposed increase of $12,932 for additional cost associated for the recent election. Division 103, City Manager reflects a proposed increase of $6,496 due to additional SPIN mailings and personnel cost. Staff has also proposed an increase of $54,205 for Division 105, Support Services, for an additional technical service technician. The change does not increase total personnel adopted in the 1999-2000 budget. The council approved the new position; ROW agent in division 146 for fiscal year 1999-2000, as of May 31, 2000 the position was still vacant. Staff is recommending transferring the personnel cost approved for the ROW agent ($57,113) to support service to fund an additional technical service technician. Financial Considerations: The proposed amendment decreases budgeted revenues and expenditures. It is expected, as stated in the Mid-Year Review documents, that revenues will continue to come in at or slightly above budget estimates with the exception of the revenue accounts amended. It is anticipated that fund integrity will be maintained, as the expenditure adjustments reflect the general fund balance at 15.3%. That any and all ordinances, resolutions, rules, regulations, policies or provisions in conflict with the provisions of this Ordinance are hereby repealed and rescinded to the extent of conflict herewith. Background Information: The "Project Prioritization" process has been utilized as a management tool for several years to best match staff work with the priorities of Council. It allows City Council, board members and individual advocates of projects an opportunity to place their item before City Council for collective ranking. This process has provided clear direction to staff as to the Council's desires and has greatly aided in the productivity of staff due to our ability to focus on the higher priorities. Note that the attached Master Schedule shows the actual distribution of rankings in the left five (5) columns, and the results of this distribution in the far right two (2) columns. The score (far right column) is derived by multiplying the frequency of response by the priority level, summing, and dividing by the number of responses. Then all items are ranked (second column from right) based on the score. As such, a great emphasis lies in the collection of data that can be accumulated to monitor trends related to growth. Annual traffic counts have proven to be a useful tool for both municipal and private development planning purposes. This report will present the basic traffic volume data recently collected in Southlake. To maintain accurate counts throughout the City, updated traffic count data will be added to the report as it is received by the City via Traffic Impact Analysis (TIA) submittals for developments. Purpose of the Report The main focus of this report is to serve as a"snapshot" of the traffic volume conditions in a fixed point in time. Traffic data from different time periods can be used to analyze trends and assist in correcting problem areas. Traffic data is the foundation of many specialized studies, such as warrant studies, and is used in part when updating the city's Master Thoroughfare Plan(MTP),which is the basis for acquiring the appropriate amounts of right-of-way necessary to accommodate the ultimate roadways needed in the city. This report also serves as a valuable economic development tool for real estate brokers, lenders, developers, and others with similar interests. Traffic volume is a critical factor associated with many of the decision points made by these companies when looking to locate businesses in a particular region. This traffic report will also provide current traffic data for any area of interest in the city to residents, property owners, and other interested parties. Methodology In May 2000, the City of Southlake contracted with Quality Counts, a traffic counting firm located in Dallas,Texas, to place the traffic counters in Southlake. The data was downloaded to a raw data file, and a printed copy of this data was provided to the City. Between May 8 and May 18, 2000, traffic counters were placed at 64 locations throughout the City, with counts taken from both directions of traffic flow. Total traffic volumes were compiled in 15-minute intervals over a 24-hour period. Figures for the 24-hour total and a.m./p.m.peak hour totals are compiled in Table 1. A map depicting the locations of these counts is attached as Figure 1. The raw data sheets, with 15-minute intervals and peak hours defined for each segment, can be obtained for the cost of reproduction. Segment—A particular area of roadway,with a beginning point("From") and an end point("To") location. Direction—The direction of traffic flow for each location. Each location has two directions, each listed in a separate row in Table 1, for both northbound and southbound(NB,SB)or westbound and eastbound(WB,EB). 24-Hour Totals—The total traffic volume(each direction) counted during the 24-hour period from 12 a.m. (midnight)to 12 a.m. (midnight)the following day.
