That I, Louise Garrett, GRANTOR herein, for and in consideration of the
sum of Ten ($10.00) Dollars and other good and valuable consideration in
hand paid by the CITY OF SOUTHLAKE, home rule municipal corporation
of the County of Tarrant, State of Texas, GRANTEE herein, the receipt and
sufficiency of which is hereby acknowledged and confessed, do hereby grant,
sell and convey unto the said GRANTEE a permanent and perpetual
easement for the purpose of installing, repairing, maintaining, altering,
replacing, relocating, rebuilding, removing, and operating Drainage facilities
in, into, upon, over, across, under and through all that land in Tarrant
County Texas described as follows, to-wit:
A five foot wide Permanent Drainage & Utility Easement containing
approximately 0.02 acres, as more particularly described in Exhibit
"B" and shown on Exhibit "A" attached hereto and incorporated
herein.
together with the right of ingress and egress as necessary for such purposes.
GRANTOR covenants and agrees that GRANTOR and GRANTOR's heirs,
representatives, successors and assigns shall at no time erect, place or
construct, or cause to be erected, placed or constructed in, into, upon, over,
across or under any easements granted herein any temporary or permanent
structures, and it is further agreed that GRANTEE shall have the right to
excavate and fill upon said permanent easement and to remove from said
permanent easement, any fences, buildings or other obstructions as may now
be found upon said permanent easement.
It is further intended that the Permanent Drainage & Utility Easement
herein granted to the GRANTEE shall run with the land and forever be a
right in and to the land belonging to GRANTOR, and GRANTOR'S
successors and assigns, and said grant is expressly excepted from any right of
reversion of said premises under any prior deeds in GRANTOR's chain of
title. The Permanent Drainage & Utility Easement, rights and privileges
granted therein are exclusive, and GRANTOR covenants that it will not
convey any other easement or conflicting rights within the area covered by
the grant to any other person.

5.0' PERMANENT DRAINGE & UTILITY EASEMENT
BEING a portion of a called 0.673 acre tract of land out of the Francis Throop Survey,
Abstract Number 1511, conveyed by deed to the Walter D. and Louise Garrett, et al, in
Volume 9698, Page 235, Deed Records, Tarrant County, Texas, (DRTCT), and being
more particularly described by metes and bounds as follows:
COMMENCING at a found 1/2" iron rod in the west line of Shumaker Lane, said point
being the southeast corner of a called 1.46 acre tract of land (Tract 1) conveyed by deed
to Walter D. and Louise Garrett in Volume 3847, Page 433, DRTCT;
THENCE North 39 degrees 41 minutes 25 seconds West, along said west line and the
east line of said 1.46 acre tract, a distance of 343.78 feet to a point for southeast corner of
the herein described easement and the POINT OF BEGINNING;
THENCE South 62 degrees 49 minutes 35 seconds West, 5.0 feet from and parallel to
the south line of Block 1, Hunter's Ridge Addition, an addition to the City of Southlake
recorded in Volume 388-134, Page 16, Plat Records, Tarrant County, Texas (PRTCT), a
distance of 200.00 feet to a point for easement corner in the east line of a tract of land
conveyed by deed to Donna Lea Wallace in Volume 9698, Page 235, DRTCT;
THENCE North 39 degrees 41 minutes 25 seconds West, along said east line, a distance
of 5.12 feet to a point for easement corner in said south line of Block 1, Hunter's Ridge
Addition;
THENCE North 62 degrees 49 minutes 35 seconds East, along said south line, a
