PUBLIC SEWER EASEMENT

KNOW ALL MEN BY THESE PRESENTS:
That W & B KIDD FAMILY L.P., a Texas limited partnership ("Grantor"), for and in
consideration of the sum ofTen ($10.00) Dollars and other good and valuable consideration
in hand paid by Grantee, the receipt and sufficiency of which is hereby acknowledged and
confessed, has granted, sold and conveyed, and by these presents does grant, sell and convey
to the CITY OF SOUTlll..AKE ("Grantee"), of Tarrant and Denton Counties, Texas, a
permanent and perpetual non-exclusive easement for the purpose of installing, repairing,
maintaining, altering, replacing, relocating, and operating a sanitary sewer line in, into, upon,
over, across and under that land in Tarrant County, Texas, described as follows, to-wit:
A non-exclusive 15-foot wide permanent Public Sewer Easement as more
particularly described on Exhibit "A" attached hereto and shown on Exhibit
"B" attached hereto, together with the right of ingress and egress as necessary
for such purposes.
Grantor covenants and agrees that Grantee shall have the right to excavate and fill upon said
permanent easement and to remove from said permanent easement, any fences, buildings or
other obstructions as may now be found upon said permanent easement.
Grantor has this day additionally granted, sold and conveyed and by these presents does
hereby grant, sell and convey to Grantee an additional contiguous temporary construction
easement for a period of one (1) year or until completion of the installation, for the purpose
of installing utilities on the property known and described as follows, to-wit:

A temporary 40- foot wide Construction Easement, said easement being
located immediately adjacent to the above described permanent easement in
a configuration as shown on the attached Exhibit "B".
Grantor covenants and agrees that Grantor's heirs, representatives, successors and
assigns shall at no time erect, place or construct, or cause to be erected, placed or
constructed any temporary or permanent structure in, into, upon, over, across or
under the permanent easement granted herein, or the temporary easement granted
herein (during the time said temporary easement shall be in effect).
TO HAVE AND TO HOLD the above-described permanent easement forever and the
above-described temporary easement for the period stated above, together with all
and singular, the rights and appurtenances hereto, anywise belonging unto Grantee,
its successors and assigns; and Grantor does hereby bind itself, and its successors and
assigns, to warrant and forever defend all and singular the premises unto the said
Grantee, its successors and assigns, against every person whomsoever lawfully
claiming or to claim same or any part thereof, by, through or under Grantor, but not
otherwise.

City of Southlake, Tarrant County, Texas, and being port of a tract of land
conveyed to W & B Kidd Family, L.P. by deed recorded in Volume 11587,
Page 692 of the Deed Records of Tarrant County, Texas. and being more
particularl y described os follows:
BEGINNING at a 1/2 inch iron rod found at a common point of Lot 5, per
Plat Showing Lots 5 and 6, W. R. Eaves No. 500 Addition and said W & B Kidd
