KNOW ALL MEN BY THESE PRESENTS:
That we, Ludwig P. Pietz and Pauline A. Pietz , for and in consideration of the
sum of Ten ($10) Dollars and other good and valuable consideration in hand paid by
Grantce herein, the receipt and sufficiency of which is hereby acknowledged and
confessed, have granted, sold and conveyed, and by these presents do grant, sell and
convey to thc City of Southlake, Grantee herein, of Tarrant County, Texas a permanent
and perpetual cascment for the purpose of installing, repairing, maintaining, altering,
replacing, relocating, and operating utilities in, into, upon, over, across and under that
land in Tan-ant County, Texas described as follows, to-wit:
Being a permanent sanitary sewer easement described as follows:
See attached Exhibit 'A' for graphic depiction
See attached Exhibit 'B' for metes and bounds description together with the right
of ingress and egress as necessary for such purposes.
TO HAVE AND TO HOLD the above described easement, together with all and
singular, the rights and appurtenances thereto, anywise belonging unto the said Grantee,
its successors and assigns forever; and We do hereby celiify that We are the owners of
the property described herein and bind ourselves, our heirs and assigns, to warrant and to
forever defend all and singular the premises unto the said Grantee, its successors and
assigns, against every person whomsoever lawfully claiming or to claim same or any
thereof.
Additional conditions are as follows:
1. Should the Grantee need to access the Grantors propeliy at 920 N. Peytonville Ave.,
Southlake, Texas (the Propeliy) in order to access the above-described easement, the
Grantee will call prior to initiating access, except in case of emergency. Upon
notification, Grantee will enter the Property from the north side of the residence
located on the Property.
2. The Grantee will provide sanitary sewer service to the Propeliy.
3. The Grantee will waive the sanitary sewer connection fee upon Grantor's connection
to the Grantee's sanitary sewer line.
4. The Grantee agrees to not install any above ground app enances on the easement.

EXHIBIT' B'
15' Permanent Sanitary Sewer Easement
Being a 0.033 acre parcel of land in the A.A. Freeman Survey, Abstract No. 522, City of
Southlake, Tarrant County, Texas and being a strip of land, over, through, and across a
tract of land conveyed to Ludwig P. Pietz and Pauline A. Pietz, as recorded in Volume
9907, P.2125, (D.R.T.C.T.) and being more particularly described as follows:
COMMENCING at a W' iron rod found for a corner, said point being the northwest
property corner of said Pietz tract, and the northeast corner of Lot 23, Block 3, of the
Cross Timber Hills Addition, as recorded in Volume 388-152, P.63 (P.RT.C.T.);
THENCE
N 890 19' 30" E, a distance of 46.12 feet along the north property line of
said Pietz tract to a point for a corner, said point being the POINT OF
BEGINNING;
THENCE
N 890 19' 30" E, a distance of 18.57 feet along the north property line of
said Pietz tract to a point for a corner;
THENCE
S 350 27' 59" W, a distance of 110.16 feet to a point for a corner, said
point being in the west property line of said Pietz tract;
THENCE
N 000 29' 59" W, a distance of 25.54 feet along the west property line of
said Pietz tract to a point for a corner, said point being in the west property
line of said Pietz tract and in the east property line of said Lot 23;
THENCE
N 35027' 59" E, a distance of 78.53 feet to the POINT OF BEGINNING,
containing within these metes and bounds 0.033 acres or 1,415 square feet
of land, more or less.
