Bolton and wife, Dorothy N. Bolton, GRANTOR herein, for and in consideration of the sum of Ten ($10.00) Dollars and other good and valuable consideration in hand paid by the CITY OF SOUTH LAKE, a home rule municipal corporation in Tarrant County, Texas, GRANTEE herein, the receipt and sufficiency of which is hereby acknowledged and confessed, do hereby grant, sell and convey to GRANTEE a temporary construction easement for the purpose of water utilities installation on that land in Tarrant County, Texas, described and shown on Exhibit "A" and Exhibit "B" attached hereto and incorporated herein. The temporary construction easement shall commence upon 30 days following the notice to proceed date given to the contractor of the project and shall terminate 30 days after completion of the construction of the 42" water distribution line. The temporary construction easement shall include the right to excavate and fill upon the temporary easement, but GRANTEE shall replace any fences or other fixtures upon the temporary easement with cost to GRANTOR, and shall restore the property which is subject to the temporary easement as closely as possible to its condition prior to entry thereon.
