KNOW ALL MEN BY THESE PRESENTS:
That we, Westerra Southlake LP , for and in consideration of the sum ofTen ($10)
Dollars and other good and valuable consideration in hand paid by Grantee herein, the
receipt and sufficiency of which is hereby acknowledged and confessed, have granted,
sold and conveyed, and by these presents do grant, sell and convey to the City of
Southlake, Grantee herein, of Tarrant County, Texas a permanent and perpetual easement
for the purpose of installing, repairing, maintaining, altering, replacing, relocating, and
operating utilities in, into, upon, over, across and under that land in Tarrant County,
Texas described as follows, to-wit:
Being a permanent utility easement and temporary construction easement, described as
follows:
See attached Exhibit 'A' for graphic depiction
See attached Exhibit 'B' for metes and bounds description together with the right of
ingress and egress as necessary for such purposes.
TO HAVE AND TO HOLD the above described easement, together with all and
singular, the rights and appurtenances thereto, anywise belonging unto the said Grantee,
its successors and assigns forever; and We do hereby certify that We are the owners of
the property described herein and bind ourselves, our heirs and assigns, to warrant and to
forever defend all and singular the premises unto the said Grantee, its successors and
assigns, against every person whomsoever lawfully claiming or to claim same or any
thereof.

Exhibit 'B'
Being a 0.514 acre tract of land in the Thomas Mahan Survey, Abstract No. 1049, City of
Southlake, Tarrant County, Texas, and being a portion ofa tract conveyed to Westerra
Southlake, LP, as recorded in Volume 12615, Page 339 (D.R.T.C.T.) and being more particularly
described as follows:
COMMENCING at a 1" iron pin found for the southwest corner of said Westerra tract;
THENCE N 00000' 37" W, along the west property line of said Westerra tract, for a distance
of 450.38 feet to a point, said point being the POINT OF BEGINNING;
THENCE N 000 00' 37" W, along the north property line of said Westerra tract, for a distance
of 18.17 feet to a point, said point being in the north property line of said Westerra
tract;
THENCE S 540 11' 15" E, for a distance of 742.45 feet to a point for a corner;
THENCE N 650 57' 53" E, for a distance of359.35 feet to a point for a corner, said point
being in a north property line of said Westerra tract;
THENCE S 890 01' 54" E, along the north property line of said Westerra tract, for a distance
of 389.24 feet to a point for a corner, said point being in the east property line of
said Westerra tract and in the west right-of-way line of North Kimball Road;

15.00 feet to a point for a corner, said point being in the east property line of said
Westerra tract and in the west right-of-way line of North Kimball Road;
