Mission Hills Estates (Lot 17, Block 1) - Permanent Sewerline Easement 'r \J City of Southlake Permanent Sewerline Easement Temporary Construction Easement The State of Texas OFFICIAL RECORD County of Tarrant KNOW ALL MEN BY THESE PRESENTS: That we, Eddie A. Williams and Cherie Anna Williams, Grantors, for and in consideration of the City of Southlake relinquishing applicable sewer impact fee for one single family residential or commercial connection, and sewer connection charges for one single family residential or commercial service, and other good and valuable consideration in hand paid by Grantee herein, the receipt and sufficiency of which is hereby acknowledged and confessed, have granted, sold and conveyed, and by these presents do grant, sell and convey to the City of Southlake, Grantee herein, of Tarrant County, Texas a permanent and perpetual easement for the purpose of installing, repairing, maintaining, altering, replacing, relocating, and operating a sewerline under that land in Tarrant County, Texas described as follows, to wit: Being a permanent sewerline easement and temporary sewerline construction easement described as follows: See attached Exhibit 'A', one page dated November 4, 1997, and signed by Eddie Cheatham for graphic depiction See attached Exhibit 'B', labeled G:\001-430\PHASE_2\ESMTS\430-mI7wpd, dated December 10, 1996, for metes and bounds description together with the temporary right of ingress and egress as necessary for such purposes. The following provisions are part of this easement: The Grantee agrees to return the current septic system charge lines and field lines to their current functioning condition on the same day any damage is done. The Grantee agrees to return the current sprinkler heads and in-ground sprinkler system to their current functioning condition within one month of any damage. The Grantee agrees to compact the excavated area after it is back filled. The Grantee agrees to resod all the excavated areas with Bermuda grass with metal clips inserted to 8" deep to avoid erosion. Temporary hay bales or silt fences will be used until the sod is laid. TO HAVE AND TO HOLD the above described easement, together with all and singular, the rights and appurtenances thereto, anywise belonging unto the said Grantee, its successors and assigns forever; and We do hereby certify that We are the owners of the property described herein and bind ourselves, our heirs and assigns, to warrant and to forever defend all and singular the premises unto the said Grantee, its successors and assigns, against every person whomsoever lawfully claiming or to claim same or any thereof.
