KNOW ALL MEN BY THESE PRESENTS:

($10) Dollars and other good and valuable consideration in hand paid by Grantee herein,
the receipt and sufficiency of which is hereby acknowledged and confessed, have granted,
sold and conveyed, and by these presents do grant, sell and convey to the City of
South lake, Grantee herein, of Tarrant County, Texas a pem1anent and perpetual easement
for the purpose of installing, repairing, maintaining, altering, replacing, relocating, and
operating utilities in, into, upon, over, across and under that land in Tarrant County,
Texas described as follows, to-wit:
Being a permanent utility easement and temporary construction easement described as
follows:
See attached Exhibit 'A' for graphic depiction
See attached Exhibit IB' for metes and bounds description together with the right
of ingress and egress as necessary for such purposes.
TO HAVE AND TO HOLD the above described easement, together with all and
singular, the rights and appurtenances thereto, anywise belonging unto the said Grantee,
its successors and assigns forever; and We do hereby certify that We are the owners of
the property described herein and bind ourselves, our heirs and assigns, to warrant and to
forever defend all and singular the premises unto the said Grantee, its successors and
assigns, against every person whomsoever lawfully claiming or to claim same or any
thereof.

35' Temporary Construction Easement
Being a 0.095 acre tract ofland in the Thomas Mahan Survey, Abstract No. 1049, City of
Southlake, Tarrant County, Texas and being a strip of land, over, through, and across a
portion of a tract of land conveyed to NCI Building Systems, as recorded in Volume
12318, Page 1338 (D.R.T.CT.) and more particularly described as follows:
Being a 15 foot wide strip of land having a centerline beginning in the north property line
of said NCI Building Systems tract and being a distance of 34.69 feet from the northeast
comer of said tract and the centerline of North Kimball Avenue;
THENCE
Commencing in a southerly direction, parallel to the east property line of
said NCI Building Systems tract, a distance of 275.24 feet to a point being
34.31 feet from the east property line of said tract and 42.44 feet from the
south line of said tract.
