This letter is a request for the City Council to pass an ordinance to rename a street, is consistent with prior City Council votes and promises made at Council meetings and is supported by the people who would be most affected by the proposed change. Our primary goal is to keep FM 1709 and commercial traffic out of a residential neighborhood and away from a school crossing. Below and attached is the information I believe will be needed to draft the ordinance. Also, enclosed is a check for $105.00 payable to the City of Southlake for the application fee. The residential area most affected by the proposed item is Northwood Park, one of the 17 neighborhoods of Timarron. I am a neighborhood representative of Northwood Park to our HOA (Timarron) and have been representing my neighbors on this issue to the City for many years. Parkwood Drive (“residential Parkwood”) has 5 homes on it. The other Parkwood Drive (“commercial Parkwood”) is in a commercial area, with soon to be three businesses and land designated as a City park. Any form of the name Parkwood Drive is not used by the two existing businesses for mail or advertising or elsewhere based on internet and Tarrant Appraisal District searches. Once the third business is built, they will need an address which is why we want to change the name now. Also, our recommendation is based on talking and working with the developer beginning at the SPIN meeting on April 26, 2022, during which the developer considered recommendations from homeowners regarding screening and lighting, amongst other things. After the meeting the developer visited with the most affected homeowner, walking the property. The neighborhood views the SPIN process as having been very successful in this instance. While we understand various processes are being reconsidered by the City, and not related to our current request, we would hope SPIN would be retained in its essential form. 1. Requested Item a. Rename one of the two disconnected Southlake streets currently named Parkwood Drive to Olivia Court and update public maps as well as ESRI maps with the changes i. Rename the portion running south from FM 1709 to a cul-de-sac adjacent to the former Senior Center (“commercial Parkwood”), changing the name to Olivia Court from Parkwood Drive ii. Leave unchanged the portion of Parkwood Drive running west from Byron Nelson Parkway (across from Rockenbaugh Elementary) and terminating at the intersection with Northwood Trail (“residential Parkwood”) iii. See attached TAD map for current layout iv. ESRI maps used by developers show the roads connected, confusing people and causing angst in the residential neighborhood. See various examples of erroneous maps in City presentations attached b. we could not find a record of any other Olivia Court anywhere in Southlake (nearest similar named street appears to be in the Johnson County part of Burleson per Tarrant Appraisal District) c. the property owners adjacent to the proposed “Olivia Court” have consented to the name change. The City of Southlake’s consent is being requested through the ordinance. We are deferring to the developer who preferred “…a more generic name and not the name of a business entity on the street. That would be a more timeless solution.” d. The use of “Court” designates ‘dead-end’ or ‘cul-de’sac’, which the street is and to which prior City Councils have committed. 2. Reason for Requested Change a. Street name Parkwood Drive in a residential neighborhood has the same name as a commercial area street and, though no commercial business is using the name yet, has caused and could continue to cause confusion. i. Initially after the completion of the Calloway’s retail store, 18-wheeler trucks would try to deliver via the residential neighborhood, often at pre- dawn times. After realizing they could not get through, they would back up down ‘residential’ Parkwood Drive, with corresponding back up warning beeping. b. City Council voted to NOT connect the two streets and a stated intention to rename the commercial portion of Parkwood Drive (per City Council minutes, various meetings, relevant sections attached) i. 10/5/99 City Council Meeting, then Mayor Stacy committed to put on a future agenda whether to complete the extension of Parkwood Drive from the residential area into the commercial area and requested a study of alternatives about whether Parkwood Drive should be extended and connected, or separated. As background, apparently the original plat with Parkwood Drive extending to FM 1709 was made in April 1996 and Timarron’s developer later decided to NOT build all the way to Southlake Boulevard (i.e., FM 1709), selling the land to the City. ii. 1/4/00 City staff presented to Council its research and various alternatives. One of the options, “option B” is roughly what exists today. iii. 2/1/00 Council voted 7-0 to NOT connect the two portions of Parkwood Drive (see attached City Council Minutes), choosing Option B, “…to protect the residents from the through traffic.” iv. 1/16/01 City Council meeting, then Director of Planning Bruce Payne promised to rename “commercial Parkwood” something else c. Final construction in the commercial area is about to start at what is currently 300 Parkwood Drive (approved by City Council August 6, 2022), so we want to change the street name before anyone starts using it i. Medical offices developer has requested a ‘neutral’ name, not tied to any existing businesses ii. In the Site Plan Narrrative Letter in the City Council Package for the 8/6/23 meeting, the developer stated in item 4 we “…do not wish for the two Parkwood streets to be connected. We are also not opposed to renaming of the street if that helps with any confusion regarding the streets.” d. ESRI maps used by developers portray the street layout incorrectly (shows it connected), which is inconsistent with prior votes and promises of the City Council 3. Consent of the Affected Properties a. The developer of the new medical office building, Calloway’s, and Providence Bank (recently renamed Great Plains Bank) have consented in writing (see all three attached). b. The City of Southlake is the other property affected. Approval of the ordinace will serve as the City’s consent. c. Northwood Park residents, the most directly affected neighborhood, recommended changing the name at the SPIN meeting. Please let me know what else you need me to do. The building will consist of leasable medical office spaces. The exterior architectural details aim to tie into the surrounding building design fabric commercially, as well as not to intrude on the residential behind the lot. The preservation area/ no disturbance area per site plan 2007, ZA 07-108 is to remain intact. A retaining wall is to be built between the preservation area and the development to allow for any grade changes required and to also shield car lights and activity from both the tree preservation and residential area behind by extending up three feet from higher grade. A SPIN meeting was held April 26 and we addressed their concerns as follows: 1. We will have no site pole lighting on the property except for building mounted wall packs and sconce lighting. All sconces and wall packs will be on a timer. 2. A traffic study worksheet was provided for the site plan submission showing minimal traffic being generated by this facility. 3. The building use is planned to be medical office. If a secondary use would be introduced, it would only be a business allowed by the current zoning. In no scenario would a use be allowed in the building which would have medical or other hazardous waste on the exterior or in the dumpster. 4. The neighbors noted that there are currently two Parkwood streets that are not connected. We will be located at the end of the Parkwood that connects to Southlake Blvd. The other Parkwood connects to a side street and leads to the residential neighborhood behind. Our development will have minimal traffic generation, and none should impact the residential community behind us. The residents requested renaming the street and not connecting the two streets in the future. We view our access as from Southlake Blvd and do not wish for the two Parkwood streets to be connected. We are also not opposed to renaming of the street if that helps with any confusion regarding the streets. 5. We removed the sidewalk from the cul-de-sac to the parking lot. 6. The proposed building is 158 feet from the corner property line of the nearest residential neighbor. 7. We have provided a retaining wall along the back and a slight turn up for screening of vehicles as well as landscape screening along the street. 8. I used to do M&A for a living so I can imagine how busy you must be. The Great Plains name is fine, though Timarron OA would prefer Court. We prefer Court to anything else since it is associated with a cul de sac or ‘dead end’ street, whereas “Drive” might sound like it connects through. We are trying to get rid of the connec-ng concept since it does cause confusion some-mes with drivers and truck deliveries. PreXy much everyone adjacent to the exis-ng (what we call) “commercial Parkwood Drive” has been saying “as long as it does not use a compe-tor’s name we’re OK.” We were going to recommend Calloway’s Court. It is the longest standing business in that immediate area and would provide a useful ‘landmark’ address for the new medical offices going in behind Calloway’s. Let me know what else you might need. Mr. Head stated he would hopefully get the City Council support on the reconsideration of Northwood Trail. He read a petition with signatures of 49 out of 53 of the residents in the Northwood Park area. He stated their concern is the proposed through-road from Northwood Park to F.M. 1709. He stated last August this issue came forward at the Planning and Zoning Commission whereby letters were sent to residents within 200' and at the time there were no residents within 200'. Over the last year all of the homes have been built. He stated the residents feel this will be another cut-through onto F.M. 1709. To avoid the school zone, people will follow this path to get onto Byron Nelson Parkway from F.M. 1709. He read the petition to the Councilmembers and audience, which expressed their concern is for the safety of the children in the area. He asked to have this issue re-addressed by the City Council. Mayor Stacy responded that because there were a lot of people present for this issue, the goal of the Council would be to put this item on a future agenda for discussion. He stated this is all that can be accomplished at this meeting. Comments from the audience stated this issue was brought to a head by a sign that recently went up in the neighborhood that said, "Future Through Street." Mayor Stacy informed the audience that this transaction happened before any of the current Councilmembers were elected to Council. It is an issue that was voted upon much earlier. When Council gets the informational packet they will be able to review the information prior to this issue being placed on the council agenda. Councilmember Kendall asked to have this item on a future agenda. Councilmember Edmondson asked staff to put together an informational packet regarding this issue. Daniel Brady, 603 Northwood Trail, Southlake. Mr. Brady asked if the citizens could get a copy of the informational packet when City staff prepares it. He stated that another concern residents have is with the heavy congestion going up F.M. 1709 and everyone Regular City Council Meeting of October 5, 1999 Page 13 of 26 10/5/99 City Council Meeting trying to get to SH 114. Not only is this a cut-through during rush hour when all the kids are getting on the buses, but there is a tremendous amount of traffic on Byron Nelson Parkway trying to get to Brumlow Avenue to try and cut-through to bypass SH 114 traffic congestion. The natural flow will be going through Northwood Trail if the road is allowed to be built. Vicki Niblo, 400 Parkwood Court, Southlake. Ms. Niblo stated her house is on the comer of Parkwood Court and Northwood Trail, and that her house is for sale and this issue is scaring people away. Jim Correl 507 Northwood Trail, Southlake. Mr. Correl stated when he first came here in May, people were cautious about driving slow, and now the City is planning on putting this road in and will be expanding the risk factor. Mr. Correl commented, "The City is fortunate that we have police officers and enforce the speed zone and there are citations that are given out almost daily. By increasing the risk factor, by adding the street, it is not worth risking the safety of our children. There are 89 children in their community, with 79 under twelve years old." Ray Semadeni, 501 Northwood Trail, Southlake. Mr. Semadeni stated they were new to Southlake and have only lived here about three months and they love the city. They are very disturbed about what could happen with this road. When he came home today on F.M. 1709, he was at the stop light at Byron Nelson Parkway and saw three or four cars trying to make the short cut through the Village at Timarron. He stated he knows that is what will happen with the road coming that way. The thought of a street coming through there scares them a lot. He asked Council, "If this were happening in your neighborhood what would you do?" He stated they want this on an agenda and want the City Council to find an alternate road. Mayor Stacy stated, "When the property was first purchased, it was purchased for a city hall to be located on that property and there were some contractual obligations regarding this road. Since the city hall is not going to be built there, there may be some alternate ways to deal with this proposed through-roadway. It is working fine for the use by the senior center and [the city] may not need a road there if we are not obligated to put the road there. I know in the developer agreement, the developer of the office buildings, is actually building the road at his expense." Background Information:The alignment of this roadway began in 1995 as part of a three -way land negotiation with Timarron, Dr. Richards, and the City. The City desired to purchase approximately 15 acres and Timarron desired to enlarge their tract at the southwest corner of Byron Nelson Parkway (BNP) and FM 1709. Dr. Richard's resulting ownership was shifted west with the understanding that there would be a loop road connecting back to BNP. All this was accomplished and the city purchased the property. As a result, the Municipal Campus Concept `A' was prepared (see attached). Since April 18, 1996 when preliminary plats for both the municipal complex and Timarron, Phase V (later named Northwood, Phase Two) were approved, Street `A' (later platted as Parkwood Drive) has been shown as a proposed 60 -foot R.O.W. extending from F.M. 1709 to Byron Nelson Parkway. A Site Plan was approved October 6, 1998 for French Square Office Complex, located on the west side of Parkwood Drive and north of Timarron Addition, Northwood Park, Phase Two. Driveway access was approved and restricted to Parkwood Drive only. A condition of the plan approval was that Parkwood Drive be constructed prior to issuance of a building permit. Staff has provided a pro and con analysis of the alternatives presented to date. Mr. Harper presents options "A" through "E" and explained each option to the City Council noting that staff feels Option B is the best, with the abandonment of the existing right -of -way. Councilmember Wayne Moffat stated he feels the important thing at this time is to protect the residents from the through traffic. Ken Head, 501 Clayton Court, Southlake. Mr. Head stated he feels Option `B" will minimize the traffic and that approving it would be a positive step in the right direction. Ray Semadini, 501 Parkwood Drive, Southlake. Mr. Semadini stated he feel Option `B" will accomplish what they feel is best for the neighborhood and that he speaks for the entire neighborhood. As you go forward there is potential here as well as a park, or selling that land back to the developers, finishing out the neighborhood, and for the senior center, and the entire neighborhood it is a win -win situation for everyone." On January 20, 2000, the Planning and Zoning Commission approved (7 -0) this case subject to the Site Plan Review Summary #3, Dated January 14, 2000, deleting Item #1 but noting that the applicant will try to move the building back as far south as possible without encroaching into the southernmost bufferyard and existing trees; deleting Item #2.a (minimum driveway spacing), and deleting Item #3 (parking). Terry Wilkinson, owner, applicant. Mr. Wilkinson discussed the issues of parking on the back of the building vs. parking in the front of the building next to F.M. 1709. He stated he prepared the site plan with parking in the rear because he though that is what the Council wanted to see on F.M. 1709. Dr. Rick Radenham. Dr. Radenham described the use of the building to the Council stating basically these are primarily insured patients that are referred to them for a CAT scan or other tests. He noted the patients are single visit patients. Mr. Wilkinson stated when this came to the SPIN meeting, the group was very adamant about the driveway in the front stating they did not want traffic off of F.M. 1709. Mr. Gibbons stated he was speaking for the applicant and that a Dallas restaurant, the "Rooster," was interested in locating on this property. He indicated it was a "fourstar" restaurant with approximately 5,300 square feet in the building. The parking on the plan meets the requirements of the ordinance. Kenny Anderson, builder, was present to answer questions from Council. Todd Tracy, owner of Rooster, 331 South White Chapel Boulevard, Southlake. Mr. Tracy stated, "The Dallas location is built like a plantation style home. The restaurant is one of four "Four Star" restaurants in Dallas and is open for lunch and dinner with Sunday brunch and that the quality is equal to the Classic Cafe in Southlake." PUBLIC COMMENTS: Ray Samendini, 501 Northwood Trail, Southlake. Mr. Samendini stated he did not have a problem with a professional building being built on this site, but he did have a problem with a restaurant because of traffic, noise issues and a buffer issue. He stated he and his neighbors are opposed to a restaurant at that location. Kim Wolfe, 601 Parkwood Drive, Southlake. Ms. Wolfe stated she had issues with the naming of Parkwood Drive in the area off Southlake Boulevard. She said she lives on Parkwood Drive and it seems to her it should be named something different. Director of Planning Bruce Payne said after he had talked with Ms. Wolfe they decided it would be best to name that section of the street something other than Parkwood Drive, and it would be changed on the plat. Mike Manella, 614 Northwood Trail, Southlake. Mr. Manella stated he had no objections to locating a restaurant as the one named in Southlake, but does have a concern with the long -term use of the property and was opposed to a restaurant in that location. Mayor Stacy commented that everyone agrees this use does not fit the Land Use Plan. He stated he would love to see the Rooster Restaurant in Southlake, but not in this location. Councilmembers Fawks and Kendall agreed this was not the location for a restaurant. Mr. Gibbons asked if the zoning could be approved for "0-1" Office District uses, and that he understood that he had a lot of work to do before this case is presented to Council at the next meeting. City Attorney E. Allen Taylor Jr., explained the process to the applicant and Council.
