KNOW ALL MEN BY THESE PRESENTS:
THA T I, Richard F.Johnston, grantor, for and in consideration of the sum of Ten ($10) Dollars and other good
and valuable consideration in hand paid by Grantee herein, the receipt and sufficiency of which is hereby
acknowledged and confessed, have granted, sold and conveyed, and by these presents do grant, sell and convey to
the City of Southlake, Grantee herein, of Tarrant County. Texas a permanent and perpetual surface easement for the
purpose of installing, repairing, maintaining, replacing, and operating utilities in, into. over, upon, across and under
that land in Tarrant County, Texas described as follows. to-wit:
Being a 15 foot permanent subsurface utility easement and a 20 foot temporary construction easement, described as
follows:

See attached Exhibit 'B' for metes and bounds description together with the right of ingress and egress as
necessary for such purposes.
See attached Exhibit "C" for construction specifications.
See attached Exhibit "D" for terms and conditions of grantor.

appurtenances thereto. anywise belonging unto the said Grantee, its successors and assigns forever; and I do hereby

Exhibit "D" - Terms And 'Conditions
This Permanent Utility and Temporary Construction Easement is granted by Grantor to
Grantee only to accommodate Grantee and the other residences on Jellico Circle and only
if the following terms and conditions are accepted by Grantee.
1. There are irrigation lines that must be repaired or replaced by Grantee, if damaged
during construction.
2, Grantor's fence on the Easement shall remain and continue to be owned and
maintained by Grantor. The Easement granted herein shall be sub-surface only
after construction is completed and no future work except routine maintenance
will be conducted on the surface of the easement by Grantee without first
obtaining Grantors consent, Grantors consent shall not be unreasonably withheld,
3. The 20' temporary construction easement shall expire and revert to Grantor on
April 30, 1999. The IS' permanent subsurface utility easement as described on
Exhibit "B" shall remain.
4. The 10" Bois D Arc tree left cut and uprooted by the S-2 sewer construction shall
be removed by Grantee during construction work on the B-1 S.S. Line under this
easement.
5. The manhole west of ST A. 4+ 15 shall be flush with the surface of the ground or
slightly below so as not to interfere with mowing.
6. Grantor prefers that only rubber tired equipment be used on the easement herein
granted. All ruts left shall be filled with sod and graded and seeded with Bermuda
seed or planted with St. Augustine grass sod to return the surface as nearly as
possible to the condition before work commenced. This applies during initial
construction and at any time thereafter when maintenance is performed.
7. During construction no access will be allowed through the front gate at 139
Jellieo Circle.
8 Grantee shall instruct and require Contractor to bore the sewer line from ST A.
0+02,22 to STA. 2+00 and STA. 2+35 to STA. 4+19.07.
9, Grantee shall locate the septic tanks behind Grantors home at 139 Jellico Circle
and construct a 4" service connection in the B-1 sewer line in order that a straight
run can be made from the septic tank to the B-1 4" service connection without
interfering with Grantors patio or the Post Oak trees
