EXECUTIVE
SUMMARY: Boyufood, LLC is requesting approval of a variance to Sign Ordinance No. 704,
as amended, for an attached building sign for Boba Chicken located at 2801 E.
Southlake Blvd., Suite 100, Southlake, Texas.
REQUEST
DETAILS: Boba Chicken is located in a multi-tenant building that is set back approximately
227 feet from East Southlake Blvd. The applicant’s original request was for an
attached building sign with variances for maximum letter height, maximum logo
height, sign area, logo area, sign type, and illumination color. Following the Sign
Board meeting on February 9, 2023, the applicant has provided additional options
which have differing variance requests. The proposed options outlining the
specific variances requested for the attached sign are as follows:

BACKGROUND INFORMATION

CURRENT ZONING: “S-P-2” Generalized Site Plan District
HISTORY: City Council approved a sign variance for Snookie’s Bar & Grill (Suite 100)
for increased letter size and increased area on January 7, 2002.
City Council approved a sign variance for Snookie’s Bar & Grill (Suite 100)
for increased sign area on June 3, 2003.
City Council approved a sign variance for Tweeter Home Entertainment
(Suite 180) for increased letter height on June 3, 2003.
City Council approved a sign variance for Casual Living (full building) to
allow two signs on the front elevation and to allow 36 inch letters on
September 16, 2014. (SV14-013)
SIGN BOARD: February 9, 2023; Approved (4-2) subject to the Staff Report dated
February 2, 2023 and noting specifically recommendation for approval of
the letter height variance, sign area variance, logo area variance, and
asking the applicant to bring back to Council an additional option on the
logo height variance as well as the sign type and specifically mentioning
to the applicant to consider individual letters as opposed to a channel box.
Also recommending the applicant bring an additional option forward on
the illumination option. Consider removing the colors and once again
consider individual letters. With the overarching recommendation to bring
at least one additional option and preferably two more options to City
Council. Amendment to the recommendation for letter height is 27 inches
but should the applicant choose to include an option for individual letters
that the applicant can go up to 36 inches in letter height. With the
overarching recommendation to bring three options to City Council.
STAFF COMMENTS: City Council approval of the request does not eliminate the requirement
for an appropriate sign application submittal prior to sign installation.

9.6.2 VARIANCES

a. Variance Authorized. The City Council may authorize variances to
any restriction set forth in this ordinance, including but not limited to
the number, type, area, height, or setback of signs, or any other
aspect involved in the sign permitting process.
b. Approval Standards. In granting any variance, City Council shall
consider the following criteria:
(i) Special conditions exist which are peculiar to the land,
structure or building involved and are not applicable to other
lands, buildings or structures in the same zone. The City may
attach such conditions to granting all or a portion of any
variance necessary to achieve the purpose of this ordinance,
and;
(ii) The strict interpretation of the provisions of the ordinance
would deprive the applicant of rights commonly enjoyed by
other properties in the same zone under the terms of the
ordinance, and;
(iii) The special conditions and circumstances do not result from
the actions of the applicant and such conditions and
circumstances do not merely constitute pecuniary hardship or
inconveniences, and;
(iv) Granting the variance will meet the objectives of the ordinance
and not be injurious to the adjoining property owners or
otherwise detrimental to the public welfare, and;
(v) The request will be the minimum variance necessary to
alleviate the special hardship or practical difficulties faced by
the applicant in meeting the requirements of this ordinance;
and;
(vi) Granting of the variance will be in harmony with the spirit and
purpose of this sign ordinance.
(vii) Granting of a variance shall be specific to the subject sign(s).
Any modification of the signage approved by the variance or
the installation of new or replacement signage that does not
meet the specific requirements of the City Council variance
approval is prohibited and will be deemed non-compliant.
Application Process. Any request for a variance shall be made to the
Administrative Official and be accompanied by a completed application
and a non-refundable filing fee in the amount specified in the current fee
schedule adopted by City Council. The sign Board’s recommendation will
be forwarded to the City Council for their consideration.
