Item 6BCase No. SV22-0014 S T A F F R E P O R T November 29, 2022 CASE NO: SV22-0014 PROJECT: Sign Variance for The Capital Grille EXECUTIVE SUMMARY: First & Main Signs is requesting approval of sign variances to Sign Ordinance No. 704, as amended, for The Capital Grille located at 1201 E. SH 114, Suite 100/110, Southlake, Texas. DETAILS: The property is located at the southeast corner of the intersection of N. Carroll Avenue and E. SH 114. The applicant is requesting variances to allow: • Allow a total of 6 attached signs (north, east, and west facades) for a lease space where only two are permitted: 4 signs on the east façade (Signs A, Sign B and E1 and E2); 1 sign (Sign C) on the west facade; 1 sign (Sign D) on the north building façade; • Allow a sign attached to an awning sign (Sign A); • Allow larger than permitted letter heights and sign area on the east and (Sign B) and west (Sign C) facades of the building; • Allow a sign on the north façade (Sign D) to have a wider than permitted sign width extending outside of the middle 75% of the façade plane; and • Allow two signs (E1 and E2) that are not defined in the Sign Ordinance. The proposed attached Signs A and D will have face lit white channel letters. Signs B and C will have halo lit channel letters. Signs E1 and E2 will be unlit aluminum wall plaques attached to entry sculpture bases. The proposed monument sign panels Sign F and Sign G are for the existing multi-tenant monument signs and follow the Sign Ordinance. PROPERTY SITUATION: 1201 E. State Highway 114 LEGAL DESCRIPTION: Lot 1R, Greenway-Carroll Addition CURRENT ZONING: “C-3” General Commercial District STRATEGIC LINK: C4 – Attract & keep top-tier businesses to drive a dynamic & sustainable economic environment HISTORY: October 7, 2014; City Council approved a Master Sign Plan for Carroll Pointe for Chuy’s for attached building signs , the development monument signs, and a blade sign for Chuy’s. (MSP14-003) March 18, 2018; City Council approved an amendment to the master sign plan for Chuy’s to relocate an existing attached sign located on a recessed façade on the east elevation to the adjacent facade at a higher level. The size remained the same. (MSP18-001) SIGN BOARD: November 17, 2022; Approved (6-0) subject to the Staff Report dated November 11, 2022; noting the recommendation for approval for all signs; and noting for Sign D that the applicant make a choice from both options; and noting Commission Rothmeier’s preference for the word “Grille” be spaced closer together. STAFF COMMENTS: City Council approval of the proposed signs does not eliminate the requirement for appropriate sign application submittal prior to the installation of the sign. Variance Authorized. The City Council may authorize variances to any restriction set forth in this ordinance, including but not limited to the number, type, area, height, or setback of signs, or any other aspect involved in the sign permitting process. b. Approval Standards. In granting any variance, City Council shall consider the following criteria: (i) Special conditions exist which are peculiar to the land, structure or building involved and are not applicable to other lands, buildings or structures in the same zone. The City may attach such conditions to granting all or a portion of any variance necessary to achieve the purpose of this ordinance, and; (ii) The strict interpretation of the provisions of the ordinance would Case No. Attachment A SV22-0014 Page 2 deprive the applicant of rights commonly enjoyed by other properties in the same zone under the terms of the ordinance, and; (iii) The special conditions and circumstances do not result from the actions of the applicant and such conditions and circumstances do not merely constitute pecuniary hardship or inconveniences, and; (iv) Granting the variance will meet the objectives of the ordinance and not be injurious to the adjoining property owners or otherwise detrimental to the public welfare, and; (v) The request will be the minimum variance necessary to alleviate the special hardship or practical difficulties faced by the applicant in meeting the requirements of this ordinance; and; (vi) Granting of the variance will be in harmony with the spirit and purpose of this sign ordinance. (vii) Granting of a variance shall be specific to the subject sign(s). Any modification of the signage approved by the variance or the installation of new or replacement signage that does not meet the specific requirements of the City Council variance approval is prohibited and will be deemed non-compliant. Application Process. Any request for a variance shall be made to the Administrative Official and be accompanied by a completed application and a non-refundable filing fee in the amount specified in the current fee schedule adopted by City Council. The sign variance will be considered by the City Council following a recommendation by the Sign Board. The Sign Board’s recommendation will be forwarded to the City Council for their consideration.
