PROJECT: Sign Variance for Zales
EXECUTIVE
SUMMARY: Priority Signs and Graphics is requesting approval of a variance to Sign
Ordinance No. 704, as amended, and to the Shops of Southlake (MSP) for four(4)
attached building signs for Zales located at 1221 E. Southlake Blvd., Southlake,
Texas.
REQUEST
DETAILS: The Zales lease space is generally located approximately 300 feet east of the
southeast intersection of S. Carroll Avenue and E. Southlake Blvd. and located
within the Shops of Southlake.
The applicant is requesting a sign variance to allow four unlit tag lines to be
located under the four existing signs on the building. The proposed signs will
include a new unlit tag lines for each sign, “The Diamond Store” under each
existing sign. The Zales current lease space has four attached signs (two on each
façade) on both the north facade facing Southlake Boulevard and the south
facade facing the internal drive on the current four facades. These signs were
previously approved under a sign variance (SV10-013) with “Zales Outlet” on
each sign. The “outlet” lettering has been removed as the store is no longer an
outlet store. The four signs “Zales” sign are internally lit white faced letters.

City Council approved a sign variance for Zales to allow two signs on each
front and rear façade on July 20, 2010. (ZA10-013)
City Council approved revisions to the Shops of Southlake Conditional Sign
Permit (MSP) for building blade signs, pedestrian blade signs, awning signs,
light pole banner signs, umbrella signs, sandwich board signs, and fascia

Southlake Blvd. to allow a 42-inch logo and 26-inch letter height for the ‘C’

Southlake for Fans United; granting the 15 decorative panel areas as long
as they are the same size as what is currently shown; the applicant has

City Council approved a sign variance for Hollywood Feed to allow an
existing sign from a previous location in Southlake to be located on the
front south elevation lease space and allowed a revised compliant sign
to be located on the north elevation on June 2, 2020. (SV20-0008)
City Council approved a sign variance request for St. Bernard an attached
building sign with a back lit backer plate located on the west elevation and
not within the required middle 75% of the façade on May 18, 2021. (SV21-

City Council approved a sign variance request for Nordstrom Rack for
an attached building sign with larger that permitted individual internally
illuminated channel letters and that the applicant can consider face lit or
back lit channel letters in an approved color or any sign type that meets

change to backlit amber LED illuminated tag lines for Mesero and to add
white neon building white accent lighting along the building and patio

STAFF COMMENTS: The Sign Ordinance No. 704, as amended allows one attached sign per
street front with a maximum of two signs per tenant/lease space. The
Shops of Southlake Conditional Sign Permit allows one attached sign on
each façade visible from a street or internal driveway for a total of two
signs per lease space.

Variance Criteria:
9.6.2 VARIANCES
a. Variance Authorized. The City Council may authorize variances to
any restriction set forth in this ordinance, including but not limited to
the number, type, area, height, or setback of signs, or any other
aspect involved in the sign permitting process.
b. Approval Standards. In granting any variance, City Council shall
consider the following criteria:

(i) Special conditions exist which are peculiar to the land,
structure or building involved and are not applicable to other
lands, buildings or structures in the same zone. The City may
attach such conditions to granting all or a portion of any
variance necessary to achieve the purpose of this ordinance,
and;
(ii) The strict interpretation of the provisions of the ordinance
would deprive the applicant of rights commonly enjoyed by
other properties in the same zone under the terms of the
ordinance, and;
(iii) The special conditions and circumstances do not result from
the actions of the applicant and such conditions and
circumstances do not merely constitute pecuniary hardship or
inconveniences, and;
(iv) Granting the variance will meet the objectives of the ordinance
and not be injurious to the adjoining property owners or
otherwise detrimental to the public welfare, and;
(v) The request will be the minimum variance necessary to
alleviate the special hardship or practical difficulties faced by
the applicant in meeting the requirements of this ordinance;
and;
(vi) Granting of the variance will be in harmony with the spirit and
purpose of this sign ordinance.
(vii) Granting of a variance shall be specific to the subject sign(s).
Any modification of the signage approved by the variance or
the installation of new or replacement signage that does not
meet the specific requirements of the City Council variance
approval is prohibited and will be deemed non-compliant.
Application Process. Any request for a variance shall be made to the
Administrative Official and be accompanied by a completed application
and a non-refundable filing fee in the amount specified in the current fee
schedule adopted by City Council. The sign Board’s recommendation will
be forwarded to the City Council for their consideration.
