accessory building of a size or aggregate size greater than permitted.
EXECUTIVE
SUMMARY: Paula Egger is requesting a Special Exception Use per Ord. No. 480, Section
44.12(2) for an accessory structure of a size or aggregate size greater than the size
permitted on property described as Lot 29, Block 3, Vista Trail Addition, an addition to
the City of Southlake, Tarrant County, Texas and located at 708 Overland Trail,
Southlake, Texas. Current zoning: "SF-20B" Single Family Residential District.
REQUEST DETAILS: This request is for a Special Exception Use for an accessory structure of a size or
aggregate size greater than the size permitted to allow an approximately 140 square
foot accessory building to be constructed at 708 Overland Trail. An existing accessory
building of approximately 600 square feet encompasses the area permitted for
accessory buildings on lots within the SF-20B Single Family Residential District.
The applicant lists specific needs in the application as to the reasons for the request.
The structure is proposed to be placed adjacent to the existing accessory building on
a permanent foundation. It will be set back 15' from the side lot line, exceeding the
required 10' from all property boundaries.
ACTION NEEDED: 1) Conduct a public hearing.
2) Consider approval of the requested Special Exception Use.

HISTORY:
- A Final Plat (ZA73-025) for Vista Trail Addition was approved on March 6,
1973 while the property was in the ETJ.
- The property was annexed into the City in 1988
- A principal residence with approximately 2,000 square feet of livable floor
area was built in 1987. (Source: TAD).
- "SF20B" Single Family Residential Zoning was placed on the
property with the adoption of Ordinance No. 480 and the Official Zoning
Map on September 19, 1989
STAFF COMMENTS: The application and exhibits are attached.
The findings necessary for the Board to approve a Special Exception Use
Permit are below:
1) No special exception shall be granted unless the Board finds that the
requested exception is specifically permitted by the zoning ordinance;
2) That the location of the proposed activities and improvements is
clearly defined on the concept plan or plot plan, and
3) That the special exception is wholly compatible with the use and
permitted development of adjacent properties either as filed or subject
to such limitations and requirements as the board deems to be
necessary to protect adjacent properties.

EXPIRATION OF GRANTED REQUEST.
ZONING BOARD OF ADJUSTMENT RULES OF PROCEDURE, Section 7.1
Any special exception or variance granted or authorized by the Board shall authorize the issuance of a
building permit and/or a Certificate of Occupancy, as the case may be, for a period of one year from the
date of the favorable action of the Board unless said Board shall have in its action approved a different
period of time and has so shown such specific period of time in the minutes of its action. If the building
permit and/or Certificate of Occupancy shall not have been applied for within said one year period or
such extended period as the Board may have specifically granted, then the special exception or
variance shall be deemed to have been waived and all rights thereunder terminated. All applications
for a request which have been denied shall be deemed to be denied with prejudice unless stated
otherwise in the Board's written decision.

PROPERTY DESCRIPTION:
BEING a portion of Lot 29, Block 3, of VISTA TRAIL
ADDITION, an Addition to Tarrant County, Texas,
according to the Plat recorded in Volume 399-95, Page 3
Plat Records, Tarrant County, Texas (P.R.T.C.T.), and
being more particularly described as follows:
BEGINNING at a 1/2 inch iron rod found for the
northwest comer of Lot 30 of said Vista Trail Addition;
same being on the east Right -of -Way of Overland Trail;
same being on a curve to the right with a radius of 685.58
feet;
THENCE with the east line of said Overland Trail, an arc
distance of 44.50 feet, a delta angle of 03 degrees 43
minutes 09 seconds, and a chord bearing and distance of
North 06 degrees I I minutes 24 seconds East, 44.49 feet
to a 1/2 inch iron rod with blue •'OTS'• (Old Town
Surveying) cap set for comer, same being the beginning
of a tangent curve to the left with a radius of 735.58 feet;
from which a 1/2 inch iron rod found bears South 81
degrees 32 minutes 49 seconds East, a distance of 1.17
feet;
THENCE with the east line of said Overland Trail, an are
distance of 66.71 feet, a delta angle of 05 degrees I 1
