Case No. ZBA22-0004 S T A F F R E P O R T April 28, 2022 CASE NO: ZBA22-0004 PROJECT: 1559 Sunshine Lane Variance for Fence Height EXECUTIVE SUMMARY: REQUEST: David Joyner is requesting approval of a Variance to Zoning Ordinance No. 480, as amended, Section 39.1 requiring a fence not exceed eight (8) feet in height on property described as Lot 26, F. Throop No. 1511 Addition, an addition to the City of Southlake, Tarrant County, Texas, and located at 1559 Sunshine Lane, Southlake, Tarrant County, Texas. Current Zoning: “SF-1A” – Single Family Residential District. The applicant is requesting approval of a Variance to Zoning Ordinance No. 480, as amended, Section 39.1, requiring a fence not exceed eight (8) feet in height. The applicant is requesting permission to permit a fence that is approximately (9) nine feet height along a certain portion of his property. The applicant contends that efforts to increase privacy in their rear yard have not been successful, and due to the characteristics of the neighboring lot and home, the applicant seeks this variance. Throop No. 1511 Addition LAND USE CATEGORY: Low Density Residential CURRENT ZONING: SF-1A – Single Family Residential District HISTORY: -The property was annexed in 1957.-A Final Plat for the subject property was approved June 28, 2007. Thezoning on the property at that time was SF-1A.-The “SF-1A” – Single Family Residential District zoning was placed on theproperty with the adoption of Ordinance No. 480-16 and the Official Zoning Map on April 17, 1990.-A principal residence with approximately 6,000 square feet of livable floorarea was built in 2007. An additional accessory structure was completed in 2016. STAFF COMMENTS: The Board may grant a variance from the literal enforcement of the zoning ordinance: a.Where the spirit of the ordinance is observed and substantial justice is done;b.Where the Board finds that granting the variance will not be contrary tothe public interest, and; c.Where, due to special conditions, a literal enforcement of theprovisions of this ordinance would result in “unnecessary hardship.” A hardship is considered “unnecessary” where the applicant demonstrates: 1.That special conditions and circumstances exist which are peculiar tothe land, structure, or building involved and which are not applicable toother lands, structures or buildings in the same district; 2.That the literal interpretation of the provisions of this ordinancedeprives the applicant of rights commonly enjoyed by other propertiesin the same district; 3.That the special conditions and circumstances that exist are not theresult of the actions of the applicant;4.That the granting of this variance does not confer on the applicant any special privilege that is denied by the zoning ordinance to other lands,structures or buildings in the same district;5.That the reasons stated in the application justify granting the variance and that the variance will be the minimum necessary to make possiblethe reasonable use of the land, building or structure, and6.That the granting of the variance will be in harmony with the general purpose and intent of the zoning ordinance and will not be injurious tothe neighborhood or otherwise detrimental to the public welfare. Will simply provide privacy along an existing 6' fence with a deteriorating green windscreen. Fence to be built only along the pool/decking/gazebo section and will not be visible Requesting approval for a 9' privacy fence along 120' section of my southern property line. The new property to the south is a 3 story, 38,000 sq ft home with a heavy trafficked service entrance that runs along our property line. We have attempted to plant a privacy shrub barrier but have struggled getting enough sun to allow for adequategrowth. And their new wind screen makes the growth even more challenging. So a combination of the height of the home, heavy traffic along the property line, inabilitygrow a privacy shrub barrier, and lack of effective tree preservation post construction, leavesus no other alternative than to construct a 9' privacy fence. Have not verified but would assume the city has approved theheight of the house and enforced the tree preservation requirements. Since the homeowners do not access the home along the north driveway(only service personnel)and the current lack of privacy/protection with the significant number of service personnel, it certainly seems reasonable and fair to allow for a variance. ZONING BOARD OF ADJUSTMENT RULES OF PROCEDURE, Section 7.1 Any special exception or variance granted or authorized by the Board shall authorize the issuance of a building permit and/or a Certificate of Occupancy, as the case may be, for a period of one year from the date of the favorable action of the Board unless said Board shall have in its action approved a different period of time and has so shown such specific period of I would suggest we are an exception as these circumstances do not exist elsewhere inSouthlake as far as I'm aware.
