Sign Variance for Southlake Professional Plaza
PROJECT:

SUMMARY: Crescendo Commercial Realty, LLC is requesting approval of a variance to
Sign Ordinance No. 704, as amended, to allow two monument signs less than
500 feet apart on one lot where there is currently one monument sign for 6
professional buildings. The property is located is 3055 – 3081 W. Southlake
Blvd., Southlake, Texas.
REQUEST
DETAILS: The proposed monument sign will be located west of the existing monument sign
on W. Southlake Blvd. and will be constructed to mirror the design, number of
sign panels (6), address numbers, and masonry materials as the existing sign.
The specific variance requested for the attached sign is as follows:

The proposed monument sign meets all requirements of the Sign Ordinance 704,
as amended, except for the monument sign being located 201-feet from the
existing monument sign. The existing monument sign was installed in 2013.

BACKGROUND INFORMATION
APPLICANT/OWNER: Crescendo Commercial Realty, LLC

LEGAL DESCRIPTION: Lot 15, J.G Allen No. 18 Addition
CURRENT ZONING: “S-P-2” Generalized Site Plan District

HISTORY: Annexed into Southlake in 1987 under Ordinance No. 379
“AG” Zoning District was approved for the two tracts (J.G Allen Survey,
Abstract No.18, all of a 2.094 acre tract of land described in a deed to
Century Partners, LLC, Volume 16590, page 321 and a portion of a 2.998
acre tract described in a deed to century Property Partners, Volume
14180, page 534, Deed Records, Tarrant County) with the adoption of the
Zoning Ordinance No. 480 and the official Zoning Map on September 19,
1989.
March 6, 2007; City Council approved the Zoning Change and Site Plan
for the Southlake Professional Plaza from “AG” Agricultural District to “S-
P-2” Generalized Site Plan District with “O-1” Office District Uses subject
to the recommendations of the Planning and Zoning Commission;
requiring the spacing for rock columns at no more than 20’ apart; requiring
applicant to complete the access easements to the property line,
however, not constructing the wall at those locations but with temporary
barriers at the easements; requiring all trees to be 4” caliper; requiring the
change of EFIS to masonry/concrete stucco; subject to Site Plan Review
Summary No. 6, dated February 13, 2007, and approving a variance to
the driveway spacing (ZA06-153).
February 2, 2017; City Council approved a zoning change and site plan
to amend the existing uses to include an ambulatory surgery center and
a covered drop-off and pick-up parking space for the building located at
3075 W. Southlake Blvd., accepting the amended site plan which
indicated a covered drop-off and pick-up parking space for patients, a
generator yard, and a concrete pad for HVAC equipment; approving that
all other zoning regulations and variances associated with the existing S-
P-2 zoning for this site plan will remain in effect. (ZA16-099)
STAFF COMMENTS: City Council approval of the request does not eliminate the requirement
for an appropriate sign application submittal prior to sign installation.

Variance Criteria:
9.6.2 VARIANCES
a. Variance Authorized. The City Council may authorize variances to
any restriction set forth in this ordinance, including but not limited to
the number, type, area, height, or setback of signs, or any other
aspect involved in the sign permitting process.
b. Approval Standards. In granting any variance, City Council shall
consider the following criteria:
(i) Special conditions exist which are peculiar to the land,
structure or building involved and are not applicable to other
lands, buildings or structures in the same zone. The City may
attach such conditions to granting all or a portion of any
variance necessary to achieve the purpose of this ordinance,
and;
(ii) The strict interpretation of the provisions of the ordinance
would deprive the applicant of rights commonly enjoyed by
other properties in the same zone under the terms of the
ordinance, and;
(iii) The special conditions and circumstances do not result from
the actions of the applicant and such conditions and
circumstances do not merely constitute pecuniary hardship or
inconveniences, and;
(iv) Granting the variance will meet the objectives of the ordinance
and not be injurious to the adjoining property owners or
otherwise detrimental to the public welfare, and;
(v) The request will be the minimum variance necessary to
alleviate the special hardship or practical difficulties faced by
the applicant in meeting the requirements of this ordinance;
and;
(vi) Granting of the variance will be in harmony with the spirit and
purpose of this sign ordinance.
(vii) Granting of a variance shall be specific to the subject sign(s).
Any modification of the signage approved by the variance or
the installation of new or replacement signage that does not
meet the specific requirements of the City Council variance
approval is prohibited and will be deemed non-compliant.
Application Process. Any request for a variance shall be made to the
Administrative Official and be accompanied by a completed application
and a non-refundable filing fee in the amount specified in the current fee
schedule adopted by City Council. The sign Board’s recommendation will
be forwarded to the City Council for their consideration.
