SB Item 5Case No. SV22-0005 S T A F F R E P O R T April 29, 2022 CASE NO: SV22-0005 PROJECT: Sign Variance for Starbucks at District 114 EXECUTIVE SUMMARY: Priority Signs and Graphics is requesting approval of a sign variance to Sign Ordinance No. 704, as amended, for Starbucks located at 2102 E. SH 114, Suite 113, Southlake, Texas. DETAILS: The property is located approximately 575 feet west of the E. SH 114 and N. Kimball Avenue intersection. The following variances are requested: • Allow 2 attached signs on the south elevation. (Signs A and E) • Allow a logo larger than permitted on the south and east elevations. (Signs A and B) • Allow an illuminated window sign. (Sign C) On the south elevation fronting on the E. SH 114 access road, the applicant is requesting a variance to allow two signs on the same elevation. The proposed logo sign (Sign A) and attached (Sign E) on the south elevation are two attached signs on the same elevation and will exceed the allowable one sign for a building elevation. The proposed Starbucks sign (Sign E) will have 6-inch backlit black channel letters. The proposed Starbucks logo sign (Sign A) will have internal illumination and exceeds the allowable logo height for the street frontage. The east logo sign (Sign B) exceeds the height for an internal drive. A proposed interior illuminated logo sign(Sign C) is less than 10 ft. from the lobby which classifies it as a window sign and will require a variance . Window signs cannot be illuminated. SH 114, Suite 113 HISTORY: - A Zoning Change from “O-1” Office District to “C-3” General Commercial District for Lot A, Block A, Briarwood Estates, Phase I was approved in 1991 for Lake Cities Animal Clinic. - A Zoning Change and Concept/Site Plan (ZA12-067) from “I-1” Light Industrial District to “S-P-2” Generalized Site Plan District for Victory Lane was approved by City Council on September 4, 2012. - A Zoning Change and Concept/Site Plan (ZA13-135) from ““S-P-2” Generalized Site Plan District to “S-P-2” Generalized Site Plan District for Kimball Park was approved by City Council on March 4, 2014. - A Preliminary Plat (ZA13-136) for Kimball Park was approved by City Council on March 4, 2014. - A Final Plat for Kimball Park was approved by the Planning and Zoning Commission on May 8, 2014. - A Zoning Change and Site Plan (ZA15-032) from ““S-P-2” Generalized Site Plan District to “S-P-2” Generalized Site Plan District for revisions to the Cambria Hotel Site Plan and Elevations was approved June 2, 2015. - A Zoning Change and Site Plan (ZA15-142) from “S-P-2” Generalized Site Plan District to “S-P-2” Generalized Site Plan District for The Offices at Kimball Park to revise the previously approved S-P-2 Zoning and Concept Plan for Kimball Park and to seek approval of a Site Plan for an approximately 116,484 square foot four-story office building and a one-level parking garage was approved March 1, 2016. - A Site Plan (ZA17-002) for Kimball Park Lot 5 Retail/Restaurant, which includes an approximately 9,176 square foot, one-story building on approximately 1.27 acres was approved February 21, 2017. - A Zoning Change and Concept/Site Plan (ZA18-0057) for District 114 at Kimball Park was approved February 19, 2019. - A Zoning Change and Concept/Site Plan (ZA20-0016) to amend the “S-P- 2” regulations for Kimball Park to add “corporate office with associated events and internal showroom/gallery for displays” as permitted uses to Lot 5 only was approved by City Council on May 19, 2020. - A Zoning Change and Concept/Site Plan was approved on February 23, 2021 for District 114 at Kimball Park (ZA20-0066) to revise the north façade garage elevation and to add a sidewalk connect on Cherry Lane. STAFF COMMENTS: City Council approval of the proposed signs does not eliminate the requirement for appropriate sign application submittal prior to the installation of the sign. Variance Criteria: Case No. Attachment A SV22-0005 Page 2 9.6.2 VARIANCES a. Variance Authorized. The City Council may authorize variances to any restriction set forth in this ordinance, including but not limited to the number, type, area, height, or setback of signs, or any other aspect involved in the sign permitting process. b. Approval Standards. In granting any variance, City Council shall consider the following criteria: (i) Special conditions exist which are peculiar to the land, structure or building involved and are not applicable to other lands, buildings, or structures in the same zone. The City may attach such conditions to granting all or a portion of any variance necessary to achieve the purpose of this ordinance, and; (ii) The strict interpretation of the provisions of the ordinance would deprive the applicant of rights commonly enjoyed by other properties in the same zone under the terms of the ordinance, and; (iii) The special conditions and circumstances do not result from the actions of the applicant and such conditions and circumstances do not merely constitute pecuniary hardship or inconveniences, and; (iv) Granting the variance will meet the objectives of the ordinance and not be injurious to the adjoining property owners or otherwise detrimental to the public welfare, and; (v) The request will be the minimum variance necessary to alleviate the special hardship or practical difficulties faced by the applicant in meeting the requirements of this ordinance; and; (vi) Granting of the variance will be in harmony with the spirit and purpose of this sign ordinance. (vii) Granting of a variance shall be specific to the subject sign(s). Any modification of the signage approved by the variance or the installation of new or replacement signage that does not meet the specific requirements of the City Council variance approval is prohibited and will be deemed non-compliant. Application Process. Any request for a variance shall be made to the Administrative Official and be accompanied by a completed application and a non-refundable filing fee in the amount specified in the current fee schedule adopted by City Council. The sign variance will be considered by the City Council following a recommendation by the Sign Board. The Sign Board’s recommendation will be forwarded to the City Council for their consideration.
