SB Item 8 - Mesero Cork & PigCase No. SV21-0024 CASE NO: SV22-0003 S T A F F R E P O R T February 11, 2022 PROJECT: Sign Variance for Mesero and Cork and Pig Tavern EXECUTIVE SUMMARY: Mesero is requesting approval of a variance to Sign Ordinance No. 704, as amended, and to the Shops of Southlake (MSP) for two tag lines attached building signs and to add white neon building white accent lighting along the building and patio roof lines of both Mesero and the Cork and Pig Tavern. Mesero is located at 1471 E. Southlake Blvd., Southlake, Texas. The Cork and Pig Tavern is located at 1451 E. Southlake Blvd., Southlake, Texas. REQUEST DETAILS: The Mesero lease space is generally located approximately 180 feet southwest of Central Avenue and E. Southlake Blvd. intersection and located within the Shops of Southlake. The Cork and Pig Tavern lease space is located west of the Mesero building and approximately 270 feet west southwest of Central Avenue and E. Southlake Blvd. intersection and located within the Shops of Southlake. The purpose of the request for Mesero is to receive approval of a variance to the Sign Ordinance No. 704, as amended, and the Shops of Southlake Master Sign Plan, to allow 2 previously approved tag lines on the north and south attached signs to change to backlit amber LED illuminated tag lines. The approved tag line letters on the south elevation of Mesero are proposed to increase in height approximately 1 inch, from 6 ¼ inch to 7¼ inch, and the width of the tag line increase by approximately 1.5 feet to proportionally to fit within the façade area. The approved tag line letters on the north elevation of Mesero are proposed to increase in height approximately 3 inches, 6 ¼ inch to 9 inch and the width of the tag line increased by approximately 5 feet to proportionally to fit within the façade area. The signs require a variance to the sign width on the façade due to the tag line on each façade exceeding the allowable 75% of the facade width. Mesero and the Cork and Pig Tavern are requesting a variance to the Sign Ordinance No. 704, as amended, to allow LED lighting along the top of the building and patio roof lines. The Mesero building is proposing accent lighting on all 4 sides of the building and the west enclosed patio roof. The Cork and Pig Tavern is proposing accent lighting on the north, east and south roof and east patio roof. The lighting is intended only to create a soft glow and will be low wattage (approximately 4 watts per lineal foot) and a soft white color (3000K). The inclusion of this LED lights at the tops of the buildings is only intended to enliven the area and help make the restaurants successful. The raceway color and backlit LEDs will be required to meet the Sign Ordinance No. 704. Variance Criteria: 9.6.2 VARIANCES a. Variance Authorized. The City Council may authorize variances to any restriction set forth in this ordinance, including but not limited to the number, type, area, height, or setback of signs, or any other aspect involved in the sign permitting process. b. Approval Standards. In granting any variance, City Council shall consider the following criteria: (i) Special conditions exist which are peculiar to the land, Case No. SV21-0024 Attachment A Page 3 structure or building involved and are not applicable to other lands, buildings, or structures in the same zone. The City may attach such conditions to granting all or a portion of any variance necessary to achieve the purpose of this ordinance, and; (ii) The strict interpretation of the provisions of the ordinance would deprive the applicant of rights commonly enjoyed by other properties in the same zone under the terms of the ordinance, and; (iii) The special conditions and circumstances do not result from the actions of the applicant and such conditions and circumstances do not merely constitute pecuniary hardship or inconveniences, and; (iv) Granting the variance will meet the objectives of the ordinance and not be injurious to the adjoining property owners or otherwise detrimental to the public welfare, and; (v) The request will be the minimum variance necessary to alleviate the special hardship or practical difficulties faced by the applicant in meeting the requirements of this ordinance; and; (vi) Granting of the variance will be in harmony with the spirit and purpose of this sign ordinance. (vii) Granting of a variance shall be specific to the subject sign(s). Any modification of the signage approved by the variance or the installation of new or replacement signage that does not meet the specific requirements of the City Council variance approval is prohibited and will be deemed non-compliant. Application Process. Any request for a variance shall be made to the Administrative Official and be accompanied by a completed application and a non-refundable filing fee in the amount specified in the current fee schedule adopted by City Council.
