SB Item 7 - LenscraftersCase No. SV22-0001 S T A F F R E P O R T February 11, 2022 CASE NO: SV22-0001 PROJECT: Sign Variance for LensCrafters EXECUTIVE SUMMARY: LensCrafters is requesting approval of a variance to Sign Ordinance No. 704, as amended, and to the Shops of Southlake (MSP) to allow an illuminated lifestyle image sign. LensCrafters is located at 1251 E. Southlake Blvd., Suite 333, Southlake, Texas. REQUEST DETAILS: LensCrafters is generally located approximately 300 feet east of the southeast intersection of S. Carroll Avenue and E. Southlake Blvd. inthe Shops of Southlake. The proposed lifestyle image sign is located at the south entry, facing the interior parking and pedestrian area, and will be programed to change once a day. PROPERTY SITUATION: 1251 E. Southlake Blvd., Southlake, Texas LEGAL DESCRIPTION: Lot 5, Block 1, Shops of Southlake CURRENT ZONING: “S-P-2” Generalized Site Plan District STRATEGIC LINK: C4 – Attract & keep top-tier businesses to drive a dynamic & sustainable economic environment HISTORY: City Council approved a Conditional Sign Permit for the Shops of Southlake on October 18, 2005. (SP05-258) City Council approved the Conditional Sign Permit for monument signs for the Shops of Southlake on February 7, 2006. (SP06-081) City Council approved a sign variance request for Nordstrom Rack on May 5, 2009. (SV09-006) City Council approved revisions to the shops of Southlake Conditional Sign Permit (MSP) for building blade signs, pedestrian blade signs, awning signs, light pole banner signs, umbrella signs, sandwich board signs, and fascia signs on June 7, 2011. (MSP11-002) City Council approved a sign variance request for St. Bernard an attached building sign with a back lit backer plate located on the west elevation and not within the required middle 75% of the façade on May 18, 2021. (SV21- 0010) City Council approved a sign variance request for Nordstrom Rack for an attached building sign with larger that permitted individual internally illuminated channel letters and that the applicant can consider face lit or back lit channel letters in an approved color or any sign type that meets the Sign Ordinance on May 18, 2021. (SV21-0011) City Council approved a Sign Variance for Mesero to allow 3 attached signs on the north, south and west elevations that have larger than permitted letter heights with push thru amber face lit and backlit channel letters and a tag line using white acrylic letters ½ inch thick. The sign letters appear white during daylight but will appear orange with an orange halo at nighttime with the proposed amber LED lights within the sign structure on November 16, 2021 (SV21-0024) STAFF COMMENTS: The application exhibits are hyper-linked to this report. City Council approval of the request does not eliminate the requirement for an appropriate sign application submittal prior to sign installation. The City Council may authorize variances to any restriction set forth in this ordinance, including but not limited to the number, type, area, height, or setback of signs, or any other aspect involved in the sign permitting process. b. Approval Standards. In granting any variance, City Council shall consider the following criteria: (i) Special conditions exist which are peculiar to the land, structure or building involved and are not applicable to other lands, buildings or structures in the same zone. The City may attach such conditions to granting all or a portion of any variance necessary to achieve the purpose of this ordinance, and; (ii) The strict interpretation of the provisions of the ordinance would deprive the applicant of rights commonly enjoyed by other properties in the same zone under the terms of the ordinance, and; (iii) The special conditions and circumstances do not result from the actions of the applicant and such conditions and circumstances do not merely constitute pecuniary hardship or inconveniences, and; (iv) Granting the variance will meet the objectives of the ordinance and not be injurious to the adjoining property owners or otherwise detrimental to the public welfare, and; (v) The request will be the minimum variance necessary to alleviate the special hardship or practical difficulties faced by the applicant in meeting the requirements of this ordinance; and; (vi) Granting of the variance will be in harmony with the spirit and purpose of this sign ordinance. (vii) Granting of a variance shall be specific to the subject sign(s). Any modification of the signage approved by the variance or the installation of new or replacement signage that does not meet the specific requirements of the City Council variance approval is prohibited and will be deemed non-compliant. Application Process. Any request for a variance shall be made to the Administrative Official and be accompanied by a completed application and a non-refundable filing fee in the amount specified in the current fee schedule adopted by City Council. The sign Board’s recommendation will be forwarded to the City Council for their consideration.
