PROJECT: Sign Variance for EVO Entertainment EXECUTIVE
SUMMARY: 5G Studio, on behalf of EVO Entertainment, is requesting approval of variances
to the Southlake Town Square (MSP) for EVO Entertainment (former Harkins
Theater building) for an attached building sign on the northeast elevation (moved
north of the previously approved location), a relocation and resize of the previous
approved media display to east patio wall, and an additional media display (5
televisions) on the northwest patio wall. EVO Entertainment is located at 1450
Plaza Place.
REQUEST
DETAILS: The proposed EVO Entertainment is generally located approximately 230 feet
south of the northwest intersection of the SH 114 access road and Central
Avenue and located within Southlake Town Square.
The report is structured such that the proposed signage is evaluated against the
Town Square Sign Master Plan and the City’s Sign Ordinance 704-J, as
amended. Previously, EVO was granted approval to the Southlake Town Square
Master Sign Plan requirements and the Sign Ordinance No. 704, as amended,
for the current EVO Entertainment signage (SV21-0012). The approved signs
included:
• The attached trellis with the attached EVO sign at the northwest entry.
• The attached Fun, Film and Games sign located on the northwest patio
wall.
• The attached EVO and Fun, Film and Games building signs at the
northeast elevation and the (fronting E. SH 114).
• The attached Press Play Sign at the southwest elevation.
• The two attached vertical wall washer signs on the northwest elevations
(north and south of the patio).
• The attached internally lit exterior perimeter vertical lights at the building
corners.
• The 8 attached movie poster sign on the northwest elevation north of the
entrance.
• The large media display sign on the north elevation of the patio as
permitted in the Town Square Master Sign Plan.

BACKGROUND INFORMATION
APPLICANT: 5G Studio
PROPERTY SITUATION: 1450 Plaza Place
LEGAL DESCRIPTION: Lot 4, Block 14, Phase IV of the Southlake Town Square Addition
LAND USE CATEGORY: Town Center
CURRENT ZONING: “DT” Downtown District
HISTORY: October 5, 2004; City Council approved a site plan for Southlake Town
Square, Phase IV, Grand Avenue District; subject to Site Plan Review
Summary No. 2, dated September 17, 2004; granting the requested
variances to driveway spacing and stacking; granting the variance to the
orientation of the hotel and theatre to the street; and requiring City Council
review and approval of theater building elevations prior to issuance of a
building permit (ZA04-067).
November 15, 2005; City Council approved a plat revision for the
Southlake Town Square Avenue District for Blocks 3R2, 4R1, 12-14, 17
and 18 (ZA06-004).
April 19, 2016; City Council approved a Site Plan with a variance request
to allow two prohibited paint colors to be used in the repainting of the
existing Harkins Theater building. The variance was to allow two
prohibited paint colors, deep crimson, and gumball purple, to be used in
the paint palette in the repainting the existing building (ZA16-014).
June 29, 2021; City Council approved a sign variance for EVO granting
the variances and approving the signs, as presented, without any
modifications (SV21-0012).
STAFF COMMENTS: The application exhibits are hyper-linked to this report. City Council
approval of the request does not eliminate the requirement for an
appropriate sign application submittal prior to sign installation. Please

Variance Criteria:
9.6.2 VARIANCES
a. Variance Authorized. The City Council may authorize variances to
any restriction set forth in this ordinance, including but not limited to
the number, type, area, height, or setback of signs, or any other
aspect involved in the sign permitting process.
b. Approval Standards. In granting any variance, City Council shall
consider the following criteria:

(i) Special conditions exist which are peculiar to the land,
structure or building involved and are not applicable to other
lands, buildings, or structures in the same zone. The City may
attach such conditions to granting all or a portion of any
variance necessary to achieve the purpose of this ordinance,
and;
(ii) The strict interpretation of the provisions of the ordinance
would deprive the applicant of rights commonly enjoyed by
other properties in the same zone under the terms of the
ordinance, and;
(iii) The special conditions and circumstances do not result from
the actions of the applicant and such conditions and
circumstances do not merely constitute pecuniary hardship or
inconveniences, and;
(iv) Granting the variance will meet the objectives of the ordinance
and not be injurious to the adjoining property owners or
otherwise detrimental to the public welfare, and;
(v) The request will be the minimum variance necessary to
alleviate the special hardship or practical difficulties faced by
the applicant in meeting the requirements of this ordinance;
and;
(vi) Granting of the variance will be in harmony with the spirit and
purpose of this sign ordinance.
(vii) Granting of a variance shall be specific to the subject sign(s).
Any modification of the signage approved by the variance or
the installation of new or replacement signage that does not
meet the specific requirements of the City Council variance
approval is prohibited and will be deemed non-compliant.
Application Process. Any request for a variance shall be made to the
Administrative Official and be accompanied by a completed application
and a non-refundable filing fee in the amount specified in the current fee
schedule adopted by City Council. The sign Board’s recommendation will
be forwarded to the City Council for their consideration.
