SH 114, Southlake, Texas on approximately 6.82 acres. Current Zoning: “S-P-1” Detailed Site Plan District. SPIN Neighborhood #4. DETAILS: OWT Architects is requesting approval of a Specific Use Permit for electric vehicle (EV) charging spaces consisting of 6 dual EV charging stations installed at 12 dedicated parking spaces. Two of the parking spaces will be handicapped accessible spaces. The EV charging spaces will be located at the southeast end of the existing parking lot located at Grace Lane and the west bound frontage road of E. SH 114. The EV stations will be located on the existing sidewalk with a 36-inch clearance on the sidewalk for accessibility behind the EV stations. The charging station will be utilized as electric vehicle charging spaces for the guests’ electric vehicles. SH 114, Southlake LEGAL DESCRIPTION: Lot 1, Block 4, Gateway Church-114 Campus, Southlake LAND USE CATEGORY: Mixed Use CURRENT ZONING: “S-P-1” Detailed Site Plan District TRANSPORTATION ASSESSMENT: This request does not affect traffic on or around the property. SOUTHLAKE 2030: This initiative aligns with Southlake’s 2030 Mobility Master Plan recommends adding non-residential charging stations as a use in Tier 1. The Sustainability Master Plan Energy Resources recommends policies that encourage private investment in alternative energy technologies within the City in Tier 2. HISTORY: On June 17, 1997 the City Council approved a Zoning Change and Concept Plan for “NR-PUD” Non-Residential Planned Unit Development District (ZA96-132) (Ordinance No. 480-222). On August 21, 2007 the City Council approved a Preliminary Plat for the Gateway Church campus. (ZA05-113) On August 21, 2007 the City Council approved a Zoning Change and Concept Plan for the Gateway Church campus from “NR-PUD” Non- Residential Planned Unit Development District to “NR-PUD” Non- Residential Planned Unit Development District with religious institutions as the primary use under Planning Case ZA05-112 (Ordinance No. 480- 222a). On May 8, 2008 the Planning & Zoning Commission approved a Final Plat (ZA08-029). On April 1, 2014, the City Council approved a Zoning Change and Concept Plan for the Westin Hotel from “NR-PUD” Non-Residential Planned Unit Development District to “S-P-1” Detailed Site Plan District with “HC” Hotel District Uses.(ZA14-006) (Ordinance No. 480-660). On May 3, 2016, the City Council approved a Zoning Change and Site Plan for the Westin Hotel amending the previously approved S-P-1 Detailed Site Plan. (ZA16-022) (Ordinance No. 480-714). On August 18, 2020; City Council approved a master sign plan for the Westin Hotel subject to the Staff Report dated August 11, 2020; approving Case No. Attachment A ZA21-0103 Page 2 the MSP as presented. (MSP20-0005) CITIZEN INPUT: No meetings were held for this request. STAFF COMMENTS: The Specific Use Permit Review Summary No. 2 dated April 1, 2022 Note: A specific use permit shall automatically expire if a building permit is not issued and construction begun within six (6) months of the granting of the specific use permit or if the use shall cease for a period of six (6) months. 45.20 SPECIFIC REGULATIONS FOR ELECTRIC VEHICLE CHARGING SPACES 1) Electric vehicle charging equipment may only be installed when accessory to the primary permitted use. 2) No more than 10% of the total number of required parking spaces may be designated as electric vehicle charging spaces. 3) Each charging space shall be posted with signage indicating the space is only for electric vehicle charging purposes. Days and hours of operations shall be included if time limits or tow away provisions are to be enforced by the owner. Information identifying voltage and amperage levels or safety information must be posted. 4) Design should be appropriate to the location and use. Facilities should be able to be readily identified by electric vehicle drivers but blend into the surrounding landscape/architecture for compatibility with the character and use of the site. 5) Equipment shall be located so as not to impede pedestrian travel, create trip hazards on sidewalks, or interfere with accessibility requirements. 6) Regulations for the electric vehicle charging equipment and spaces shall be established in the specific use permit. These regulations may include but are not limited to location; size of equipment; signage, including directional signage (if any); and lighting (if any). 45.5 FACTORS TO BE CONSIDERED - In granting or denying an application for a specific use permit, the City Council shall take into consideration the following factors: a. Safety of the motoring public and of pedestrians using the facility and the area immediately surrounding the site. b. Safety from fire hazard, and measures for fire control. c. Protection of adjacent property from flood or water damage. d. Noise producing elements; and glare of vehicular and stationary lights and effect of such lights on established character of the neighborhood. e. Location, lighting and type of signs; and relation of signs to traffic control and adverse effect on adjacent properties. f. Street size and adequacy of pavement width for traffic and reasonably expected to be generated by the proposed use around the site and in the immediate neighborhood. g. Adequacy of parking, as determined by requirements of this chapter for off-street parking facilities for similar uses; location of ingress and egress points for parking and off-street loading spaces; and protection of the public health by all-weather surfacing on all parking areas to control dust. Such other measures as will secure and protect the public health, safety, morals and general welfare. i.City Council may grant variances to specific regulations associated with a specific use set forth in Sections 45. SH 114, BEING DESCRIBED AS LOT 1, BLOCK 4, GATEWAY CHURCH-114 CAMPUS AS DEPICTED ON THE APPROVED SITE EXHIBIT ATTACHED HERETO AND INCORPORATED HEREIN AS EXHIBIT “A” AND PROVIDING AN EFFECTIVE DATE.
