EXECUTIVE
SUMMARY: Spry Surveyors, on behalf of Barry and Vicki Dinsmore, is requesting approval of
a Plat Revision for Lots 1 R-1 & 1 R-2, Block 2, of the Brewer Addition, being a
revision of Lot 1 R, Block 2, Brewer Addition, an addition to the City of Southlake,
Tarrant County, Texas. Current Zoning: "SF-1 B" Single Family Residential
District. SPIN Neighborhood #11.
DETAILS: The purpose of this plat revision is to revise the lot boundaries of Lot 1 R in order
to subdivide the lot in accordance with "SF-1 B" Single Family Residential District
standards.
Variance Requested. requesting approval of a variance to Section 5.06 of the
Subdivision Ordinance No. 483, as amended, requiring a 5' sidewalk requirement
along the street frontage of new construction. The request is due to the rural
barrow ditch road frontage, a 50' drainage easement that bisects the property,
does not match character of the neighborhood and no other sidewalks in the
neighborhood. Modification or variations of the Subdivision Ordinance require
approval of the City Council.

CURRENT ZONING: "SF-1 B" Single Family Residential District
HISTORY: - The property was annexed into the City in 1988 and given the "AG"
Agricultural District zoning designation.
-A Zoning change (ZA90-005) request for from "AG" Agricultural District
to "SF-1 B" Single Family Residential District was approved by the City
Council on April 17, 1990.
-A Preliminary Plat (ZA90-006) for Brewer Addition was approved April 3,
1990.
-A Final Plat (ZA90-020) for Brewer addition was approved May 15, 1990
and filed July 18, 1990.
-The existing approximately 3,697 square foot residence was built in 1993
(Source: Building Permit).
- A Plat Revision (ZA15-073) was filed August 18, 2016, in order to reduce
the building line along Brewer Road to 30' in order to allow an
accessory building into conformance.
- A Special Exception Use (ZBA22-0007) to permit a building or buildings
of an aggregate size greater than permitted was approved by the
Zoning Board of Adjustment on May 26, 2022. This request was to
allow an existing accessory building to be in conformance with
accessory building zoning if the applicant were to subdivide the
property in the future.
CITIZEN INPUT: A Public Hearing was held at the September 22, 2022 Planning and
Zoning Commission Meeting.
PLANNING & ZONING
COMMISSION ACTION: Approved; (4-0), September 22, 2022, subject to Staff Report dated
September 16, 2022 and Plat Review Summary No. 1 dated September
16, 2022, and recommending that a sidewalk variance not be granted for
the property.

09/27/22 AND WE OFFER THE FOLLOWING STIPULATIONS. THESE STIPULATIONS ARE
HEREBY MADE CONDITIONS OF PLAT APPROVAL UNLESS SPECIFICALLY AMENDED BY THE
CITY COUNCIL. IF YOU HAVE ANY QUESTIONS OR NEED FURTHER CLARIFICATION, PLEASE

The following changes are needed according to Sections 3.03 & 3.06 of the Subdivision
Ordinance No. 483, as amended.
1. In the dedication paragraph, the real property should be described as Lots 1 R-1 & 1 R-2, Block
2. There is a reference to the property as being a part of "Block 1 ".
2. Please be aware that replatting of this lot will require construction of a minimum 5' wide sidewalk
along the street frontage as part of new home construction per section 5.06, Subdivision
Ordinance No. 483, as amended. In order to waive the construction requirement, a Sidewalk
Variance will need to be considered by City Council prior to granting of a Certificate of
Occupancy for the home.

Tree Conservation/Landscape Review
1. Any future construction is required to comply with the regulations of the Tree Preservation
Ordinance 585-E.
Except as provided by subsection 7.2.b. of the Tree Preservation Ordinance, a Tree
Conservation Analysis or Tree Conservation Plan shall be approved if it will preserve existing tree
cover in accordance with the percentage requirements established by Table 2.0. If the property has
previously received a tree permit related to development, the percentage of existing tree cover at the

time the first such permit was issued shall be used to calculate the minimum existing tree cover that
must be preserved under this section.

The following should be informational comments only
The Development Review Committee (DRC) has determined this pre -submittal is sufficient for
formal submittal to the Planning and Zoning Commission subject to completing the changes
noted above. Please pay the respective fee, and please plan to attend the September 22nd,
Planning and Zoning Commission meeting.
The Plat Revision must conform to the underlying zoning of the property.
All utility easements are required along the perimeter of lots per Section 3.03 of Subdivision
Ordinance No. 483, as amended. Staff recommends providing easements only where needed
to extend services or cover any existing utilities.
Please submit a revised pdf "check print" prior to submitting the blackline mylar and paper copy
with original signatures.
Original signatures and seals will be required on one blackline mylar and one blackline paper
copy prior to filing the plat. The mylar and paper copies will not be accepted if any erasures or
original ink, other than signatures or seals, appear on the plat.
All plats filed must have an original signed and stamped Tax Certificate submitted with it from
each taxing unit with jurisdiction of the real property, indicating that no delinquent taxes are owed
and that taxes for the current year have been paid. After September 1st, a certificate showing
that the taxes for that year are paid, but that the taxes for the upcoming year have yet to be
calculated is required. (House Bills 1563 & 3101). A copy of this information may be obtained
from the Tarrant County Tax Assessor/Collector's Office located at 100 E. Weatherford St. in Ft.
Worth (across from the old red courthouse). There is a service charge of $10 per account for
