Current Zoning: "SF-1 B" Single Family Residential District. SPIN Neighborhood #11. DETAILS: The purpose of this plat revision is to revise the lot boundaries of Lot 1 R in order to subdivide the lot in accordance with "SF-1 B" Single Family Residential District standards. Variance Requested. requesting approval of a variance to Section 5.06 of the Subdivision Ordinance No. 483, as amended, requiring a 5' sidewalk requirement along the street frontage of new construction. The request is due to the rural barrow ditch road frontage, a 50' drainage easement that bisects the property, does not match character of the neighborhood and no other sidewalks in the neighborhood. Modification or variations of the Subdivision Ordinance require approval of the City Council. This request was to allow an existing accessory building to be in conformance with accessory building zoning if the applicant were to subdivide the property in the future. CITIZEN INPUT: A Public Hearing was held at the September 22, 2022 Planning and Zoning Commission Meeting. PLANNING & ZONING COMMISSION ACTION: Approved; (4-0), September 22, 2022, subject to Staff Report dated September 16, 2022 and Plat Review Summary No. 1 dated September 16, 2022, and recommending that a sidewalk variance not be granted for the property. In the dedication paragraph, the real property should be described as Lots 1 R-1 & 1 R-2, Block 2. There is a reference to the property as being a part of "Block 1 ". 2. Please be aware that replatting of this lot will require construction of a minimum 5' wide sidewalk along the street frontage as part of new home construction per section 5.06, Subdivision Ordinance No. 483, as amended. In order to waive the construction requirement, a Sidewalk Variance will need to be considered by City Council prior to granting of a Certificate of Occupancy for the home. Please pay the respective fee, and please plan to attend the September 22nd, Planning and Zoning Commission meeting. The Plat Revision must conform to the underlying zoning of the property. All utility easements are required along the perimeter of lots per Section 3.03 of Subdivision Ordinance No. 483, as amended. Staff recommends providing easements only where needed to extend services or cover any existing utilities. Please submit a revised pdf "check print" prior to submitting the blackline mylar and paper copy with original signatures. Original signatures and seals will be required on one blackline mylar and one blackline paper copy prior to filing the plat. The mylar and paper copies will not be accepted if any erasures or original ink, other than signatures or seals, appear on the plat. All plats filed must have an original signed and stamped Tax Certificate submitted with it from each taxing unit with jurisdiction of the real property, indicating that no delinquent taxes are owed and that taxes for the current year have been paid. After September 1st, a certificate showing that the taxes for that year are paid, but that the taxes for the upcoming year have yet to be calculated is required. (House Bills 1563 & 3101). A copy of this information may be obtained from the Tarrant County Tax Assessor/Collector's Office located at 100 E. Weatherford St. in Ft. Worth (across from the old red courthouse).
