loud music. Hours will be seven days
per week. From 11 to 10 during the
week and from 11 to 12 on the weekends.

We have reviewed the above referenced plat on a preliminary basis and
would like to offer the following comments:
1. It is not clear how the flow will be carried between lots
19 & 20, and lots 13 & 14, a drainage easement will most
likely be required in these two locations
2. The storm drainage calculations indicate velocities of 16-18
feet per second in most areas, erosion of the highly sandy
soil is a potential problem, also the culverts will be prone
to silt badly in this area. It is recommended that some
measures be taken to prevent excessive erosion and these
measures be presented to the City for approval.
3. Construction plans should be submitted prior to construct-
ion with culvert sizes, velocity of flow, measures to
control erosion, street grades, etc. indicated.
4. The R.O.W. width should be indicated for F.M. 1709 (South -
lake Blvd.) it is not clear if additional dedication is
required. The future R.O.W. width requirement is 100 feet.
5. The legal description of the property is not shown on the
plat, also dedication blocks, signiture blocks, etc. should
be added.
6. The zoning of the surrounding area should be indicated, also
it is not clear if all of this tract is to be zoned the
same or if different uses are planned for some of the lots.

7. Is the increased concentration of run-off going to cause
any problems for the downstream landowners, below lots
19 & 20, and lots 13 & 14? It might be necessary to get
approval from these landowners consenting to the proposed
improvements.
8. It would be our recommendation that a stub -out street be
dedicated for future extension South, this would allow
for better traffic circulation, better distribution of
water supply, better fire and ambulance protection and
a general indication of future planning.
9. Any structures which are now existing and proposed to
remain should be indicated on the plat, and there intended
use should also be indicated.
10. Any water impoundments upon the property should be indicated
on the plat.
11. Is the bridal and utility easement to be open to the public,
or private?
Hopefully, these comments will assist you in your review of the
subject plat. We would appreciate the opportunity to review the
Final Plat prior to consideration of the City for approval.

Jack Petty, represented the owner and
TBL Corporation. He explained he wishes
to build in heavy commercial or light

building of approximately 20 to 30,000
square feet in order to assemble

and program his computers. He said
they currently employ 25 locally and
expect to increase to 35. Their
current office is approximately 250
yards south of the proposed site.
Mr. Petty answered questions from

Bob Lyford (not adjacent) objected
to traffic. Gordon Martin (not
adjacent) an employee of TBL was
curious about how Southlake wanted
to grow. Gary Fickes was concerned
about additional buildings that can
be built on the zoned property.

that owners of property were required

airport noise when they bought the lot

Ben Flannigan (not adjacent) presented
a petition bearing 39 signatures
against the zoning. Ann Flannigan

questioned some uses other than
Mr. Petty. Sonny James spoke
saying he was not informed of the

Billy J. KNox discussed the planned

use map and said he felt prior
councils had deserted the plan and
we are now paying for it.
Gerald Thompson (an adjacent property
owner) spoke against the zoning.
Janice Miller was against the zoning.

Richard Eakins felt compelled to speak
even though he preferred to remain
neutral. When Woodland Heights was zoned
the Pettys were against it because
of their future plans. He also felt
that aircraft noise would not be a
problem to residential property.
Mrs. Petersen felt Petty should have
gotton zoning at time of purchase.

A discussion was held concerning an
increase in the "Special Use" uses
for Agricultural zoned property.
Joe Gregory feels the city needs to
expand the legal uses in Agricultural
by special use permits in order to
eliminate inequities. A number of
others in the room echoed this idea.
The commission agreed to place this
item on its next agenda for considera-
tion and recommendation to the City
Council.

Richard Eakins and Jim Burger were
present as was their engineer, Bob
Raley.
During the discussion, it was mentioned

that Block 1, Lots 14,15,20,21 and
Block 2, Lot 6, the lots have less than
100' frontage, however, at the building

line, these lots the width would be
at least 100'. Consensus of the
Commissioners is to waive this
requirement. Although the problem
should be addressed with Council.
In the engineer letter dated 3-4-83,

the commission felt as follows:

3. Waived.
4. Eakins felt it was impossible to
accomplish. Burger and Eakins agreed

that they could live with perk tests
prior to sale. Commissioners except

AG - AGRICULTURAL DISTRICT
PURPOSE AND SCOPE: The AG District is intended to be used pri-
marily in areas where agricultural uses should be retained,
where scattered non -farm growth should be prevented, and as a
temporary classification for newly annexed lands.
10.00 PRINCIPAL PERMITTED USES: No building, structure, or land shall
be used and no building or structure shall be erected, altered,
or enlarged which is arranged, intended, or designed for other
than one of the following uses:
10.001 AGRICULTURE: Any customary agricultural use, building, or
structure, including nurseries, greenhouses, orchards, truck
farms, and animal farms.
10.002 RESIDENTIAL: Single-family detached dwellings containing a
minimum of thirteen hundred (1300) square feet.
10.003 INSTITUTIONAL: Churches and parish houses; cemeteries and
crematories for the human dead; school and colleges, including
dormitories; public buildings and structures of the recreational,
cultural, administrative and public service type; parks, play-
grounds, neighborhood recreational centers.
10.004 PRIVATE RECREATION: Private non-commercial recreation areas,
including country clubs, riding stables, swim clubs, and
similar uses.
10.005 DAIRIES and related establishments for processing milk products,
not including retailing.
10.006 PUBLIC UTILITIES and railroad right-of-way and tracks not
including terminals, railroad yards, reservoirs, water towers,
pumping plants, or storage yards.
10.01 CONDITIONAL USES: The following uses shall be permitted only
f expressly authorized by the City Council.
10.011 COMMERCIAL MINING: In accordance with the provision of Article
66.
10.012 HOSPITALS: Hospitals for human care and veterinary hospitals
of any kind provided that the hospital grounds shall be distant
at least two hundred (200) feet from any residential district.

10.013 DISPOSAL of garbage and refuse, including sanitary landfills
and sewage disposal by the County or City or their authorized
+� agents, subject to Health Department approval.
10.014 UTILITY STATIONS AND COMMUNICATIONS: Static transformer
stations, booster stations, transmitters and utility stations,
when operating requirements necessitate locating in the
' district; provided there is no yard or garage for service
or storage, and provided further that the premises upon which
utility station is erected and maintained shall be appropriately
landscaped and screened so as to be in harmony with the general
appearance of the neighborhood and not objectionable as to
noise, odor, vibration or other disturbances.

10.023 SWIMMING POOLS: Private swimming pools subject to the provisions
of Article 65, Ordinances.423 and 776, and subsequent revisions.
10.024 REAL ESTATE AND PROFESSIONAL SIGNS: Real estate, small announce-
ment and professional signs subject to the same provisions as
the R-1 Single Family District (Paragraph 20.07) and Ordinance
741.

ZA 83-7 Final plan for the Rain Forest Addition. John
Levitt, engineer, representing developer Wayne Lee. Mr.
Levitt stated that he had no objection to any of Engineer
or City Official comments, however, they did prefer to
leave the pecan tree in the roadway but would guard same
with curb all the way around the tree.
After discussion and upon motion made by Jim Vorhis,
seconded by Rick Stacy, the final plan approval was approved 5-0.
ZA 83-19 Zoning request for lot 2, block A, of the White Chapel
Place Addition. Current zoning R.E. (residential estates)
request is for Agricultural. This was a continuation of a
public hearing. Johnny Widner, representing the owner,
appearing in person, there was one written reply in favor. Mr.
Widner explained that originally he did not want to build a 2000
square foot house as required by the R.E. zoning. Also stated
that he intended to make his primary source of income from agric-
ultural, and that it was his opinion that taxes would be less.
After discussion, Billy J. Curb moved for approval,
seconded by Jim Vorhis, approved 5-0.
ZA 83-23 A replat of lot 12 of the Cedar Oaks Addition, making
lot 12A and 12B. This is a public hearing. It was established
that fees were paid, notices given, there were no written
responses. Mary O'Brien, present, representing the owner.
After review of the plan, Ed Norman moved for approval
of 83-23 with the following conditions:
1. Existing 60 ft. access and utility easement
between lot 13 and lot 12 be abandoned.
2. Lot 12A be modified to include the 30 ft. access
running from the property line north of the cul de sac.
3. A 72 ft. utility easement be furnished on each
side of lot 13 and new lot 12A from the cul de sac

requested for equestrian riding club. Zoning is heavy commercial.
' This is a public hearing. Lowell Jones, speaking for the
applicant, stated that they plan to build a 24 stall horse barn,
build new fencing, a horse arena, install jumping equipment, a
tack room and that they plan to staff facility 24 hours a day.
After answering commissioners questions, the meeting was opened
to the public.
Dr. Reutlinger, D.V.M., was present as an adjacent owner.
Dr. Reutlinger requested that safeguards be applied so that
the stables could not be left to deteroriate to the state of
the stables across from the TCJC, NE Campus. Mr. Jones assured
the Dr. that they would run a first class operation. The Dr.
stated that he would like to see a large turning area into the
stables due to a hill at the property entrance. He stated that
if the owners do what they say, then this use would be an
asset to the city.
There were no other replies. By limitation of law the
barn could not be larger than a 30 horse barn.
After further discussion, Rick Stacy moved for approval,
seconded by Billy J. Curb. Approved 5-0.
The commissioners requested that the City Council
review the street construction report, which is attached hereto.

ZA 83-25 A zoning request for a 184.858 acre tract of land
out of the John Childress Survey and the A.A. Freeman Survey.
Present zoning is agricultural. Request is for A2 single
family district, the owners Ten Bar Properties. This is a
public hearing. It was established that fees were paid,
notices were given, there were no written replies. John
Levitt, representing the owner, answered questions concerning
the zoning action. It was established that phase one of the
Cross Timber Hills Addition has now been completed and that the
owner wishes to begin this phase. Mr. Levitt stated that Deed
restrictions would call for a minimum of 2300 sq. ft. houses,
which is more restrictive than the A2 request.
After discussion, Jim Vorhis moved for approval, seconded
by Billy J. Curb and approved 4-0.
ZA 83-25 A preliminary plat approval for phase two of the Cross
Timber Hills Addition. On the preliminary plat is was noted
that the streets are 60 foot right of way for Peytonville.
John Levitt stated that the developer was trying to minimize
tree removal. David McMadon, President of Ten Bar, stated
that there would be ingress developed first from Peytonville.
After review of the preliminary plat, the basic problem
with members of the commission was traffic flow and limited
ingress -egress. Mr. Levitt stated that this seemed to be an
advantage in that the streets would not be made into freeways,
also stated that the comments from the City engineer, Cheatham,
would be adhered to on the final plat with the exception of

Discussion Advanced Mobile Phone Service, Inc. request of Robert
H. Power. The City of Southlake zoning ordinance makes no
provision for the commercial radio antenna and related
facilities through area zoning and/or special uses, therefore
request is being made for a hardship determination. The

Present was Karmen Blankenship. The general concept
is a tower on a base with a small concrete building housing
radio equipment and computer equipment. The property in
question is on the Miron Subdivision. Commissioners questioned
whether the property was in the noise cone of the airport
and whether it would be subject to height restrictions for
the airport.
It was established that the zoning of this property is
heavy commercial, and that this is probably the correct zoning
for towers of this kind. Since this item is a discussion item,
the commissioners requested that council consider the following
steps:
1. That specific exception uses for towers be
included in heavy commercial.
2. That there be a public hearing process at the
P & Z level at the earliest possible date.

This is a continuation of a public hearing from the prior
P & Z meeting which had been tabled in order that clarification
be provided on whether a used car lot can exist without a new
car agency, and proof that the total plat (approx. one acre) is
divided in the manner presented to P & Z.
The clarification issue was answered by City Attorney,
Bill Smith. In his opinion used car lots can be included in
the special exception use 6.12-6i without a new car agency since
used car lots are not covered elsewhere in the ordinance.
The question concerning the total plat of ground and the
use of the land was answered by referring to city tax records.
No After further discussion, Ault moved to approve ZA 83-27
Decision special exception, subject to:
1. Vehicles sold limited to used cars and 3/4
ton pickups or less.
2. That no more than 8 vehicles be offered for
sale on the property.
3. That access be only from Bluebonnet, and no
signs or advertising be on 1709.

It was noted that there were no final plan reviews made

final plat made available before the meeting. Mr. McPherson,
owner, was present and presented the Commission with the original
mylar.

After reviewing the mylar, the Commission had considerable
discussion on the following: The residence of Mr. McPherson had
been deleted from the tract to be known as Alamo Estates, and
the street dedication on East Dove and Whites Chapel, which
includes the McPherson residence, had been deleted. All other
items requested by P & Z at the preliminary level have been done.
The Commission spent considerable time reading the sub-
division ordinance and definitions therein, as well as discussing
prior action concerning matters similar to the one before it.
All agreed that P & Z has consistently required street dedica-
tions on subdivided property.
Final Plat After further discussion, Samaratin moved for denial of
Denied the final plat since:
1. All known subdivisions as defined in
160-A Section 20.a (p.27) have been required
to dedicate the streets fronting on the sub-
divided property, and council has consistently
upheld these requirements.
2. The definition of a subdivision in P & Z's
opinion includes the entire property being

residence.

John Levitt, Engineer, was present. Mr. Levitt agreed

' Mr. Levitt explained that utility easements for some of
the lots on the plat would be handled after the power company
determined the pole sites. It is possible that some easements
may lay within an entire lot instead of being split down the
property line.

A. The planned use map is actually secondary to the proposed
street system in that development will generate around
available roads and/or access to major streets.
B. In the past zoning & plat approvals for residential have
met with little opposition while industrial and commercial
actions have been met with less enthusiastic responses.
C. The problem of zoning a city that is not exclusively
residential becomes one of finding a compatable mix or
fit of residential with commercial and industrial and
how to buffer these different areas. One method of
achieving this buffering is to utilize a selective zoning
by use instead of the general catagory presently available.
A number of related sub catagories within commercial and
industrial zoning catagories seems even more appropriate.
2. Specifically addressing the Proposed Planned Use Map presented by the
Citizens Advisory Committee, the following comments are offered:
' A. A decision must be made as to whether we want commercial
development to proceed along major roads, such as 114
and 1709, in strip form or to fall into a cluster type
' forming around major intersections or other strategic
areas.
' B. The Proposed Planned Use Map does not differenciate between
commercial and industrial zoning which presents a problem
with determining buffering zones to residential. Since
industrial zoning already exists within the city, these
areas should be considered for expansion including roads
from these areas leading to major highways. Also, industrial
areas planned along 114 and 1709 should include the necessary
' commercial buffering.
C. The City should request available information from the State
Highway Department regarding future plans for overpasses,
access and service roads and traffic control devices for 114
and 1709. Information should also be requested from the
Airport and FAA regarding planned runways, noise cones, etc.

Carmen Blankenship, present, explained that tower
would be 117 feet tall and self supporting. A 26 x 22 foot
masonary building will also be built. Probably not visible
from 1709. The tower is one of 15 to be built in area by a
sub. of AT & T. The tower is monopole design similar to
light standards at LBJ interchange.
There will be no interference with other radio and
T.V. antennas, nor would other installations interfere
with their installation. FAA has issued a clearance letter
for the tower.

All members of the P & Z felt that residential areas in
Southlake required more concentration and study. Concerning
commercial or industrial zoning the Commission generally agreed
that uses in commercial or light industrial should be grouped
by related activities. If the use does not fit the related
activity and there is no other group, then the use should be
by special exception. In this manner undesirable uses can be
controlled. This method should alleviate some of the citizens
concerns whereby they are not against the user but against the
zoning. Under current conditions the user could lease and the
next use could do anything within the zone. Examples might be:
Commercial One: would have dry cleaners, drug stores and other
small merchandise shops. Commercial Two: might be restaurants.
Commercial Three: might be convenience stores and so on.

Present: Stacy, Vorhis, Ault, Norman, Kasper, Samaratin,
Curb. Sandy LeGrand, City Secretary, and Lloyd Latta, Councilman,
also present.
Meeting called to order. Minutes approved as amended.
ZA-83-33 Zoning request for Lot 1, Block B of the Briarwood Estates
addition. Present zoning is A-6 -.two Family district, request
is for the heavy commercial zoning district.
Owner: Bob Almon - Public Hearing. Fees were paid, notice
given. Two written replies - Hines and Poteet both against zoning
change.
' Bob Almon, owner, stated that it was his plan to change the
property to heavy commercial in order to make his lots (A & B
already zoned heavy commercial) more efficient. He does not intend
to build any structures on the lot but will use it as a lateral
field.
During discussion and while comparing this plat to the entire
plat of Phase one of Briarwood Estates, it was noted that this plat
presented to P&Z did not show the correct boundry line of Lot B.
Stacy questioned the need to rezone solely for the purpose
of lateral lines.
' During public hearing, Rex Poteet, an owner in Briarwood,
pointed out that Deed Restrictions are more stringent than city
ordinances, and was opposed to any further heavy commercial zoning.
P&Z explained deed restrictions are a civil matter.
Robert Hines spoke - against due to traffic circulation
' problems. Any east bound traveler on 114 will have to go up
Briarwood and down Cherry to arrive at the property.
Mrs. Poteet - concerned that insurance rates will
' increase.
Dan Howell - no problem with lateral lines but opposed
to zoning change.
Jeff Chapman - opposed to zoning change.
Larry Bowers - opposed to zoning change.
Tom Parity - not opposed to lines but opposed to
zoning change.
On question of lateral lines - Mr. Poteet not opposed
to using the lot for lateral lines.

The suggestion was made that the adjacent property owners
and Mr. Almon get together and see if a solution can be worked out.
There was some question about zoning of lots surrounding
the property, but P&Z felt the correct zoning could be obtained
by council meeting.
Denial After discussion, Stacy moved for denial, seconded by
Norman. Discussion concerned the problems of: Can a lateral
field be placed in A-6 and if not why not since the adjacent
owners seemed to have no problem with them?
Motion carried - 7-0.
Item 2 Replat of Lots A, B and 1 of Block B of the Briarwood
83-33 Estates addition to the City of Southlake.
Onwer: Bob Almon - Public Hearing.
Due to the decision to not rezone Lot 1, Block B, it was
felt that P&Z in good conscience could not approve a replat.
Denial Kasper moved to deny, seconded by Samaratin - Carried 7-0.
Item 3 Action taken after Item 4.

J.A. Freeman Survey, Abstract 529. Present zoning is heavy comm-
ercial and neighborhood service commercial - request is for all
heavy commercial zoning district.
Owner: S&B Enterprises - Don Botik - Public Hearing.
The front part of property is zoned heavy commercial, back
is neighborhood service commercial.
Mr. Botik stated that it needed to be all heavy commercial.
Mr. Botik agreeable to a 15 foot utility easement along the
east line of his property running south from highway and 71-2 foot
utility easement line along the north side of south property line.
In P&Z opinion and after looking at his plans for this
development, no other easements necessary. There were no other
R.O.W. problems. Mr. Richard Zembrod, an adjacent owner, stated
that he had no objections.
Approval After further discussion, Norman moved for approval,
seconded by Samaratin - Motion carried 7-0.

Minutes of meeting of City of Southlake held
held October 25, 1983.
Present were Stacy, Vorhis, Ault, Norman, Kasper
and Curb. Samaratin was absent.
Minutes approved as written.
Item 1 Discussion of zoning ordinance 261. The Planning and
Zoning Commission discussed possible revisions to the ordinance
including redefining the uses in special catagories, possibly
extending the special exception use and adding office park
zoning. Chairman Norman offered several different catagories
from which to build..
After two hours of discussion, the members agreed to work
on the ordinance individually and report back at the next
meeting.
