MEMBERS PRESENT: David Yelton, Secretary; Janet Murphy, Gary Fickes, Ralph Evans,

MEMBERS ABSENT: Stephen Apple, Chairman; and, Rod Johnson.

Coordinator; LouAnn Heath, Director of Finance; and, Sandra L. LeGrand, City Secretary
The Regular meeting of the Southlake Park Development Corporation was called to order at 6:05
p.m. by David Yelton, Secretary, in the absence of the chairman.
Agenda Item #2, Approval of the Minutes- March 7. 1995. meeting
Motion was made to approve the Minutes of the March 7, 1995, SPDC meeting.

Agenda Item #3. Audit Report
LouAnn Heath, Director of Finance, presented to the group a copy of the Audit of the entire
city, explaining the combined balance sheet, outlining the SPDC sections for operating, debt
service, capital improvements. A copy of the information provided is hereby attached to the
minutes.
Agenda item #4. Discussion: Update on Sales Tax Receipts.
LouAnn Heath, Director of Finance presented a break -down of the sales tax revenues adding,
the city has a six (6) months collection this year. In April $87,400 was collected.
Agenda Item #5. Discussion: Update on Contract for Gymnasium
Kim McAdams, Parks Coordinator, presented information from Warren Anderson with regard
to the contract for the gymnasium. McAdams stated both gymnasiums will be open by the time
school starts in 1995.

Agenda Item #5. Continued
David Yelton asked the City Manager when should we try joint funding the gymnasium for
Durham Elementary. Mr. Hawk replied, it depends on the growth and our ability to do things.
The Southlake Park Development Council has a two -three year plan and we should continue
operating under it. Mr. Yelton stated he wants the SPDC to be pro -active in joint use.
Agenda Item A. #7 & #8 Discussion: Update on Bicentennial Park Expansion Progress:
Rain Days and Change Order #3 Turf Options with Contractor for Bicentennial Park
Expansion #1.
Kim McAdams, Parks Projects Coordinator, introduced Marty Halpern, Contractor with Dean
Construction. The board asked him to be present, in order for the board to be able to ask
questions of him regarding progress on the park expansion. Ms. McAdams stated we are
moving forward with the project, half of the road has been poured, and we are starting to see
more visibility of progress.
Rain days for construction at Bicentennial Park were discussed. According to McAdams, the
contract allows for 50 rain days. Thirty days have already been approved and they asked for
another 20 days. The calendars were presented, which showed from the beginning of the
project, the rain/bad weather days for this project.
Walter Shore, City inspector for the Park project, stated he was present to discuss
the rain days with the board. Shore stated the contractor has worked when no
one in the whole city was working.
Gary Fickes asked the question, are we going to be able to play on the ballfields
in the fall or have we given up on that? The big issue is having everything ready
in the spring of 1996.
With the rain days, it is getting more and more critical to make an August 15, deadline for
bermuda grass, if we want to play on the ballfields and soccer fields in the Spring of 1996. At
this point, the contractor is willing to reconsider his construction plan of action to get irrigation
to the fields sooner than in his normal scheme of construction so grass can be planted by August
15. This will cause the irrigator to come to the job site twice, instead of once, as he had bid.
Marty Halpern guaranteed he could put grass down by August 15, 1995 for $34,780. David
Yelton asked what his guaranteed delivery date without the agreement and cost of $34,780 would
be? Mr. Halperin stated October 8, 1995 would be the guaranteed date.

SUBJECT: Bicentennial Park Expansion Project - Phase I
CMS Gym / Recreation Center Project
We will first visit with the contractor about the progress of the park as the Board requested. Then
we need to consider some action on the following.
Rain Delays for Construction at Bicentennial Park
Attached are calendars from the beginning of the project that show the rain/bad weather days for
this project. From October 17 to April 11 there has been 91 bad weather days. Attached is the
normal bad weather days to be calculated in his calendar day contract. SPDC has authorized an
extension of 30 days to date. Calculations will be reviewed and discussed with the contractor,
Monday, and further extensions will be considered.
Turf Options for Construction at Bicentennial Park
With the rain delays, it is getting more and more critical to make an August 15 deadline for

in mind that grass for the ballfields was not in the original contract because of so many variables
and unknown conditions when it is time to plant the grass. We felt at the time we could do it in
house or sub it out ourselves if the contractor was finished, but conditions now warrant a change
in strategy. At this point, the contractor is willing to reconsider his construction plan of action
to get irrigation to the fields sooner than in his normal scheme of construction so grass can be
planted by August 15. This will cause the irrigator to come to the job site twice instead of once
as he bid. The contractor will have to confine his concrete pouring access to a single entry,
requiring use of special equipment to pump in concrete. All of this cost more. The contractor
and JT Dunkin & Associates will be available to discuss the options and prices, Monday.
CMS Gym/Recreation Center Construction
Attached are the contingency items and budget that are part of the initial contract. Staff is
exploring some options on retracting some of the basketball goals, letter attached. Sample color
boards will be available for your review. The last grade beam was poured yesterday, then slab
and then walls will go up within 3 weeks. The construction completion is scheduled for end of
August 1995. This item is for discussion only, no action necessary.

SC 12.2 - Abnormal Weather Conditions
Amend Paragraph 12.2 of the General Conditions by adding to the end of the paragraph the following:
'Definition of abnormal weather conditions and requirements for extensions of Time due to abnormal
weather conditions are as follows:
12.2.1 The contract time may be.extended in whole days equal to the number of abnormal
weather days. Abnormal weather days are defined as follows:
a. Rain Days'- the number of days each month, in excess of the number shown in
Column 'A' of the weather table, that rain at the project site causes a delay in a
significant portion of the work.
b. Drying Days - the number of days that muddy conditions at the project site cause
a delay in a significant portion of the work.
C. Freeze Days - the number of days each month, in excess of the number shown
in Column 'B' of the Normal Weather Table, that the temperature at the project
site is below freezing and causes a delay in a significant portion of the work.
12.2.2 Column 'A' of the Normal Weather Table indicates the number of rain days to be
considered normal for the area of the project site. Column 'B' indicates the number of
days below freezing to be considered normal for the area of the project site. This data
was collected from the U.S. Weather Bureau.

RE: Carroll Middle School Gymnasium
Dear Warren:
At the Carroll job site meeting on April 30, 1995, the owner proposed to change the basketball
backstops to adjustable 8'-10' height frames. According to our specifications and the shop drawing
submittals the Porter backstop model #90213-102 has these features.
Also, the owner proposed to change the fixed basketball backstops to electrical, folding basketball
backstops. Willie Lehrmann of The Ridgemont Company has investigated this change and the price
per unit would be an additional $649 each. Please review this proposal and try to determine which
basketball backstops we would like to keep as fixed basketball backstops and which ones we would
like to change to the electrical, foldup basketball backstops.

Attached is change order #3 for Bicentennial Park Expansion - Phase I. Change Order #3 directs
the contractor to make adjustments in the work components and sequencing to enable planting of
both hydromulched bermuda and solid sod Tifway 419 by August 15, 1995. The contractor, Dean
Construction, has submitted a price of $34,780.00 in additional cost to make these adjustments.
Following is the contractor's analysis of the construction activities affected by these changes and
his proposed cost for each element:
1. Increase in labor due to accessing plaza area from the
perimeter rather than from adjacent fields.

SUBJECT: Bicentennial Park Expansion Project - Phase I
CMS Gym / Recreation Center Project
We will first visit with the contractor about the progress of the park as the Board requested. Then
we need to consider some action on the following.
Rain Delays for Construction at Bicentennial Park
Attached are calendars from the beginning of the project that show the rain/bad weather days for
this project. From October 17 to April 11 there has been 91 bad weather days. Attached is the
normal bad weather days to be calculated in his calendar day contract. SPDC has authorized an
extension of 30 days to date. Calculations will be reviewed and discussed with the contractor,
Monday, and further extensions will be considered.
Turf Options for Construction at Bicentennial Park
With the rain delays, it is getting more and more critical to make an August 15 deadline for
bermuda grass, if we want to play on the ballfields and soccer fields in the Spring of 1996. Keep
in mind that grass for the ballfields was not in the original contract because of so many variables
and unknown conditions when it is time to plant the grass. We felt at the time we could do it in
house or sub it out ourselves if the contractor was finished, but conditions now warrant a change
in strategy. At this point, the contractor is willing to reconsider his construction plan of action
to get irrigation to the fields sooner than in his normal scheme of construction so grass can be
planted by August 15. This will cause the irrigator to come to the job site twice instead of once
as he bid. The contractor will have to confine his concrete pouring access to a single entry,
requiring use of special equipment to pump in concrete. All of this cost more. The contractor
and JT Dunkin & Associates will be available to discuss the options and prices, Monday.
CMS Gym/Recreation Center Construction
Attached are the contingency items and budget that are part of the initial contract. Staff is
exploring some options on retracting some of the basketball goals, letter attached. Sample color
boards will be available for your review. The last grade beam was poured yesterday, then slab
and then walls will go up within 3 weeks. The construction completion is scheduled for end of
August 1995. This item is for discussion only, no action necessary.

SC I Z2 - Abnomtal Weather Conditions
Amend Paragraph 12.2 of the General Conditions by adding to the end of the paragraph the following:
'Definition of abnormal weather conditions and requirements for extensions of Time due to abnormal
weather conditions are as follows:
12.2.1 The contract time may be.extended in whole days equal to the number of abnormal
j weather days. Abnormal weather days are defined as follows:
a. Rain Days'- the number of days each month, in excess of the number shown in
Column 'A' of the weather table, that rain at the project site causes a delay in a
significant portion of the work.
b. Drying Days - the number of days that muddy conditions at the project site cause
a delay in a significant portion of the work.
C. Freeze Days - the number of days each month, in excess of the number shown
in Column 'B' of the Normal Weather Table, that the temperature at the project
site is below freezing and causes a delay in a significant portion of the work.
12.2.2 Column 'A' of the Normal Weather Table indicates the number of rain days to be
considered normal for the area of the project she. Column 'B' indicates the number of
days below freezing to be considered normal for the area of the project site. This data
was collected from the U.S. Weather Bureau.

RE: Carroll Middle School Gymnasium
Dear Warren:
At the Carroll job site meeting on April 30, 1995, the owner proposed to change the basketball
backstops to adjustable 8'-10' height frames. According to our specifications and the shop drawing
submittals the Porter backstop model #90213-102 has these features.
Also, the owner proposed to change the fixed basketball backstops to electrical, folding basketball
backstops. Willie Lehrmann of The Ridgemont Company has investigated this change and the price
per unit would be an additional $649 each. Please review this proposal and try to determine which
basketball backstops we would like to keep as fixed basketball backstops and which ones we would
like to change to the electrical, foldup basketball backstops.
