Members: Chuck Fettinger, Don Light, Eddie Pierce, Bobby Harrell, David Carpenter, MEMBERS ABSENT: STAFF PRESENT: Building Official, Paul Ward; City Attorney, Betsy Elam; Code Enforcement Officer, Glenda Jaynes; and Secretary, Debbie Coomer. Agenda Item #2, Approval of the Minutes A motion was made to approve the minutes of the Regular Meeting, October 23, 1996 as written. Motion: Bobby Harrell Second: Don Light Ayes: Maykus, Lease, Light, Fettinger, Pierce, Carpenter, Harrell Nays: None Approved: 7- vote Agenda Item #3, Administrative Comments No comments. Agenda Item #4, BBA Case #015 BBA Case # 015, Substandard Building, being 1535 Brumlow Ave. Tract 2 E6, Abstract 591 out of the J. N. Gibson Survey, Southlake, TX. Owner: Mr. & Mrs. Thruman Head. Board member Eddie Pierce stepped down for this agenda item. A presentation was from Paul Ward, Building Official according to the inspection report dated 09/28/95. Photograph's were presented at the hearing by Glenda Jaynes, Code Enforcement Officer. Fire Marshall, Roger Stewart has determined the structure to be a fire hazard. PUBLIC HEARING Regular Meeting Building Board of Appeals January 22, 1996 cont. Mr. Joe Wright, property owner was present to speak. Mr. Wright request 60 days until he can decide if he is going to repair the structure or demolish it. There was no other person wishing to speak either in favor or in opposition of the request. PUBLIC HEARING CLOSED A motion from the Building Board of Appeals based from the following specific finding regarding the subject property was made that the conditions of standards set forth by the Building Officials Report exist to the extent that life, health, property or safety of the public and or occupants of building are endangered; further we find that the property owner has established that the work cannot be reasonably performed within 30 days that we therefore, ORDER that the building be repaired in conformance with requirements of the codes of the City of Southlake, or, demolished and the debris removed from the, property, and that the repairs or demolition of property be commenced in 60 days or demolished at that time; and we further ORDER the building be secured immediately to prevent unauthorized entry and all utilities shut off immediately except as necessary to effectuate the repairs. B.B.A. Case #016 B.B.A. Case# 016, Substandard Building, being 1029 North Kimball Ave., Tract 5A1, Abstract 595 out of the S. Freeman Survey, Southlake, TX. Owner: Clinton Berry. Eddie Pierce returned to the Board table of this agenda item. A presentation was made from Paul Ward, Building Official according to the inspection report dated 11/28/95. Photograph's were presented at the hearing by Glenda Jaynes, Code Enforcement Officer. Fire Marshall, Roger Stewart has determined the structure to be a fire hazard. Code enforcement Officer, Glenda Jaynes sent notice to the property owner. Sandra LeGrand, the City Secretary filed notice with Tarrant County. PUBLIC HEARING 2 Regular Meeting Building Board of Appeals January 22, 1996 cont. Lane Yeargin was present to represent the owner Clinton Berry who is deceased. Mrs. Yeargin is the daughter of Virginia Yeargin, Mr. Berry's sister. Mrs.Yeargin stated she knew the conditions of the property were bad and requested more time. There was no other person wishing to speak either in favor or in opposition of the request. A motion from the Building Board of Appeals based from the following specific finding regarding the subject property based on the evidence made at the hearing that conditions set forth in the building official's report exist to the extent that life, health, property or safety of the public are endangered; we therefore further find if the building is not repaired within thirty (30) days, that there is no reasonable probability that the building will be repaired within a reasonable period of time if additional time is given. We therefore ORDER that the building be repaired in conformance with requirements of the codes of the City of Southlake, or demolished and the debris be removed within 30 days and all utilities shall be shut off immediately except as necessary to effectuate the repairs. If the property owner chooses to repair rather than demolish the property, the building must be must be immediately secured to prevent unauthorized entry. The refrigerators on the premises must be removed or made safe and secured immediately.
