15' PERMANENT SEWER EASEMENT
Being an easement of land situated in the Francis Troop Survey, Abstract Number 1511,
Tarrant County, Texas, and being a part of that tract of land as described by deed to
Fulgencio C. LeVrier, Jr. and Rose LeVrier as recorded in Volume 12403, Page 348,
Deed Records, Tarrant County, Texas, and being more particularly described by metes
and bounds as follows:
BEGINNING at an lIz" iron rod found at the southeast comer of said LeVrier tract, said
iron rod also being the northeast comer of Lot 15, the southwest comer of Lot 16, Block
1, Hunter's Ridge Addition, as recorded in Volume 388-134, Page 16, Plat Records,
Tarrant County, Texas, and in the northerly right-of-way line of Fox Hollow Cir. (50'
radius);
THENCE N 71 022'28" W with the south line of said LeVrier tract and a north line of said
Hunter's Ridge Addition a distance of 410.47 feet to a 1/2 inch iron rod found at the

Property Owner Requirements
The following stipulations have been generated as a result of previous negative
experience by the Owner, on providing the Utility Easement on property located on the
West Side of Dove Creek to the City of Southlake. For your information on said past
experience please see attached page #4 of this document.
The requested permanent Sanitary Sewer Easement to be located on the LeVrier
property as described on attached Exhibit A & B shall be granted with the following
stipulations. Said stipulations shall become part of the permanent Sanitary Sewer
Easement agreement entered into between the City of Southlake and said property
Owner.
1. No ingress I egress shall be allowed to contractor or City through property front
gate located on Dove Road to said utility easement during or after completion of
construction phase. All future ingress I egress shall occur through Fox Hollow
Circle ONLY. The City shall be allowed emergency ingress I egress through
front gate and property Owner shall be notified each time such entry is required.
2. A construction 3'-0" high orange safety fence shall be installed and maintained
along the requested 35-foot temporary construction easement for the duration of
project. The construction period on said property shall not exceed (4) four
months, without expressed written permission from property Owner.
3. Stockpile of construction materials, Le., dirt, gravel, pipe, nor equipment will not
be allowed outside the proposed 35' temporary construction easement.
4. All proposed manhole covers shall be installed flush with existing finish grade.
5. All trees, shrubs and plants, which are removed and or damaged, shall be
replaced with equal type. All damaged trees shall be replaced with a 4" minimum
trunk size with the number of trees equal to damaged tree trunk caliper size.

6. Any pipe installation whJd1 falls within any existing tree drip line shall be bored,
and said tree guaranteed 10 survive for a minimum of one year after completion
of said construction. All tree replacement shall be per Item #5 above. No trees
shall be pruned or cut wi1hout prior written consent from the property Owner.
7. Any damage to the existing fence and concrete ribbon shaJl be repaired back to
existing or better conditioo..
8. Any damage to existing underground gas, water and electrical shall be repaired /
replaced to existing or better condition.
9. All existing finish grades shall be re-established to match existing after
completion of all proposed work.
10. Upon completion of project, the entire site affected by construction shall be fine
graded with good clean (clay free) top soil material and hydromulched with
Bermuda seed.
11. All surface gravel spillage on entire site affected by construdion shall be
removed and affeded site reconstructed to its original condition.
12. Any damage to the existing small rear pond shall be repaired and restored to its
present condition, to Indude bank location, size and existing finish grade
restored to continue the e:cisting engineered drainage design.
13. The Owner shall be issued a set of 11" X 17" construdion documents for review,
prior, to any final agreement is entered to between the Owner and the City of
Southlake. The property Owner shall be notified and allowed to be present at the
pre-construction meeting pertaining to said utility work.
14. All notations in any legal and construction documents indicating the term "Utility
Easement or Drainage Easemenr for the LeVrier property shall be changed to
only read "Sanitary Sewer Easemenr.

. 15. The City of Southlake agrees to pay the property Owner the sum of .$~.eOO.06
T W(;LV~(Piftl&R Thousand Dollars) for said requested permanent Sanitary Sewer
Easement and for the use of the 35' temporary construction easement for a
period not to exceed (4) four months.
