AN ORDINANCE AMENDING ORDINANCE NO. 480, AS
AMENDED, THE COMPREHENSIVE ZONING ORDINANCE OF
THE CITY OF SOUTHLAKE, TEXAS; GRANTING A ZONING
CHANGE ON A CERTAIN TRACT OR TRACTS OF LAND
WITHIN THE CITY OF SOUTHLAKE, TEXAS BEING LEGALLY
DESCRIBED AS LOT 2, T. J. THOMPSON NO. 1502 ADDITION,
CITY OF SOUTHLAKE, TARRANT COUNTY, TEXAS BEING
APPROXIMATELY 2 ACRES, AND MORE FULLY AND
COMPLETELY DESCRIBED IN EXHIBIT "A" FROM "C-3"
GENERAL COMMERCIAL DISTRICT TO "S-P-1" DETAILED
SITE PLAN DISTRICT WITH "C-3" USES, AS DEPICTED ON
THE APPROVED SITE PLAN ATTACHED HERETO AND
INCORPORATED HEREIN AS EXHIBIT "B", SUBJECT TO THE
SPECIFIC REQUIREMENTS CONTAINED IN THIS ORDINANCE;
CORRECTING THE OFFICIAL ZONING MAP; PRESERVING
ALL OTHER PORTIONS OF THE ZONING ORDINANCE;
DETERMINING THAT THE PUBLIC INTEREST, MORALS AND
GENERAL WELFARE DEMAND THE ZONING CHANGES AND
AMENDMENTS HEREIN MADE; PROVIDING THAT THIS
ORDINANCE SHALL BE CUMULATIVE OF ALL ORDINANCES;
PROVIDING A SEVERABILITY CLAUSE; PROVIDING FOR A
PENALTY FOR VIOLATIONS HEREOF; PROVIDING A
SAVINGS CLAUSE; PROVIDING FOR PUBLICATION IN THE
OFFICIAL NEWSPAPER; AND PROVIDING AN EFFECTIVE
DATE.
WHEREAS, the City of Southlake, Texas is a home rule City acting under its Charter
adopted by the electorate pursuant to Article XI, Section 5 of the Texas Constitution and
Chapter 9 of the Texas Local Government Code; and,
WHEREAS, pursuant to Chapter 211 of the Local Government Code, the City has the
authority to adopt a comprehensive zoning ordinance and map regulating the location and use
of buildings, other structures and land for business, industrial, residential and other purposes,
and to amend said ordinance and map for the purpose of promoting the public health, safety,
morals and general welfare, all in accordance with a comprehensive plan; and,
WHEREAS, the hereinafter described property is currently zoned as "C-3" General
Commercial District under the City's Comprehensive Zoning Ordinance; and,

WHEREAS, a change in the zoning classification of said property was requested by a
person or corporation having a proprietary interest in said property; and,
WHEREAS, the City Council of the City of Southlake, Texas, at a public hearing called
by the City Council did consider the following factors in making a determination as to whether
these changes should be granted or denied: safety of the motoring public and the pedestrians
using the facilities in the area immediately surrounding the sites; safety from fire hazards and
damages; noise producing elements and glare of the vehicular and stationary lights and effect
of such lights on established character of the neighborhood; location, lighting and types of signs
and relation of signs to traffic control and adjacent property; street size and adequacy of width
for traffic reasonably expected to be generated by the proposed use around the site and in the
immediate neighborhood; adequacy of parking as determined by requirements of this
ordinance for off-street parking facilities; location of ingress and egress points for parking and
off-street loading spaces, and protection of public health by surfacing on all parking areas to
control dust; effect on the promotion of health and the general welfare; effect on light and air;
effect on the over-crowding of the land; effect on the concentration of population, and effect on
transportation, water, sewerage, schools, parks and other public facilities; and,
WHEREAS, the City Council of the City of Southlake, Texas, further considered among
other things the character of the districts and their peculiar suitability for particular uses and the
view to conserve the value of the buildings, and encourage the most appropriate use of the
land throughout this City; and,
WHEREAS, the City Council of the City of Southlake, Texas, does find that there is a
public necessity for the zoning changes, that the public demands them, that the public interest
clearly requires the amendments, and that the zoning changes do not unreasonably invade the
rights of those who bought or improved property with reference to the classification which
existed at the time their original investment was made; and,

WHEREAS, the City Council of the City of Southlake, Texas, does find that the changes
in zoning lessen the congestion in the streets, helps secure safety from fire, panic, and other
dangers, promotes the health and the general welfare, provides adequate light and air,
prevents the over-crowding of land, avoids undue concentration of population, and facilitates
the adequate provision of transportation, water, sewerage, schools, parks and other public
requirements; and,
WHEREAS, the City Council of the City of Southlake, Texas, has determined that there
is a necessity and need for the changes in zoning and has also found and determined that
there has been a change in the conditions of the property surrounding and in close proximity
to the tract or tracts of land requested for a change since the tract or tracts of land were
originally classified and therefore feels that the respective changes in zoning classification for
the tract or tracts of land are needed, are called for, and are in the best interest of the public at
large, the citizens of the city of Southlake, Texas, and helps promote the general health, safety
and welfare of the community.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
SOUTHLAKE, TEXAS:
SECTION 1.
That Ordinance No. 480, the Comprehensive Zoning Ordinance of the City of Southlake,
Texas, passed on the 19th day of September, 1989, as originally adopted and amended, is
hereby amended so that the permitted uses in the hereinafter described areas be altered,
changed and amended as shown and described below:
Being described as Lot 2, T. J. Thompson No. 1502 Addition, City of Southlake,
Tarrant County, Texas being approximately 2 acres, and more fully and
completely described in Exhibit "A" from "C-3" General Commercial District to "S-
P-1" Detailed Site Plan District with "C-3" General Commercial District uses as
depicted on the approved Site Plan attached hereto and incorporated herein as
Exhibit "B", and subject to the following conditions:

Project Narrative:
Bluestone Partners, LLC. is working with Carnation Auto Spa to improve their newly acquired
property at 955 Davis Boulevard (formerly Krystal Clean Car Wash).
The overall scope of the improvements can be summarized as such:
• The first improvement will be at the Point-of-Sale, where customers enter and pay for
a service. The large canopy currently on the rear side of the building will be removed,
and two new automated Point-of-Sale stations will be installed. A large portion of the old
canopy area will be turned into a landscaped area with new trees and grass.
• The second improvement will be to the employee parking, which is currently along the
North border of the property. This will be relocated into two different areas so that the
current parking area can become part of the fire lane.
• Third, self-service vacuum parking will be added to the rear of the property, with wide
parking stalls and canopies where customers can park and vacuum their car. These
improvements are all to the site, and not the building, but will greatly improve the
operations and offerings of the car wash.
Regarding Bufferyard regulations, we request that the current bufferyard configuration be
maintained and unaltered. A small portion of the northern property line has an existing paved
area within the bufferyard, and this is needed to remain to allow for the proper fire lane to
continue around the site.
Regarding canopy columns, the new behind the building, we request that regulations for S-P-
1 zoning allow for the metal columns. The metal columns will be kept looking professional and
in good condition. Having to provide masonry around these columns would greatly restrict the
ability of vehicle flow through the site, and also increase the likelihood of damage to customer
vehicles.
Regarding canopy fabric color, we also request that all new and existing fabric canopies be
Navy Blue colored canopies. Current existing canopies are green, which will be replaced. New
fabric canopies in the rear of the property will have new Navy Blue canopies.
Carnation Auto Spa, upon purchasing the carwash from Krystal Clean, will operate the carwash
Monday through Saturday 8am-7pm and Sunday 8am-6pm. Krystal Clean currently operates
as a full-service only car wash and Carnation Auto Spa would like to continue to operate the
site with full-service as the main source of business, but intends to add express services as
well so the public has more options to choose from.
Carnation Car Spa Stacking Information: Based on the latest site layout I have shown the
amount of stacking bays that we could utilize if needed. 9 bays at the point of sale and a further
19 bays on the drive if needed on a busy day. Below is the timeline of how cars will be
processed through this car wash. Average daily traffic count on Davis Blvd is +/- 25000. The
car wash anticipates capturing 1.5% of this traffic — 375 per day. The car wash has a 100'
conveyor system which will process 100 cars per hour. Based on this — if the car wash is
operating for 10 hours a day on average 38 cars an hour will be processed which is well under
the capabilities of the wash. This calculation shows that stacking will never impact any
roadways even on a busy day.

Summary Narrative with meeting with the Neighbor to the South of the Site 5-10-22
"Carnation Auto Spa's executive team met with Ms. Stephanie Lomme on Friday, May 6th to
discuss the resident's concerns about the proposed changes at 955 Davis Boulevard. The
discussion was productive and beneficial for both parties. The primary areas of concern were
noise and excess water spill over onto 2300 W Continental Boulevard. Carnation Auto Spa's
attorneys are currently drafting a formal agreement between the two parties detailing Carnation
Auto Spa's commitment for a city approved stone facade wall along the south side of the
property line to mitigate noise, and an improvement in the current water runoff situation. In
exchange for the proposed changes discussed above, we anticipate Ms. Lomme's support of
the changes at 955 Davis Boulevard."
City Council Motions:
1st Reading on May 17, 2022:
Approved (6-1) at 1st Reading, subject to the Staff Report dated May 10, 2022 and
the Site Plan Review Summary #3 dated April 29, 2022; approving of up to 17 self-
service vacuums under two navy blue shade canopies located in the northeast
portion of the site; noting that the self-service vacuum equipment will be fully
enclosed and screened by a masonry wall with metal gates; noting that the canopies
covering the full service "detail" areas located between the building and Davis Blvd.
and the new proposed point of sales location will be covered by a navy blue canopy;
noting that the applicant is working with the property owner to the south to construct
a stone façade wall to address noise concerns. At second reading the applicant shall
provide and present a south property line "wall exhibit" depicting the wall height,
materials and location and also provide an exhibit that shows what modifications (if
any) that the wall will have on the south bufferyard or on the tree conservation plan;
per the PZ Commission motion - Hours of operation will be Monday-Saturday 8 am
to 8 pm and Sunday 8 am to 7 pm (Daylight Savings Time or if this becomes year
around standard time); Hours of operation will be changed to Monday-Saturday 8
am to 7 pm and Sunday 8 am to 6 pm when or if Daylight Savings ends in the fall of
the year; noting that prior to final approval, the applicant will verify that the operation
of all vacuums on site operating at 100% capacity will meet all City Noise ordinance
requirements and need to provide documentation to the City. Verification shall be
provided by an acoustic engineer or other qualified professional; and noting that this
zoning action does (not) approve any signage or façade color changes and any new
signage or color facade changes must meet City ordinance requirements; and noting
the applicant's agreement to provide greater detail at 2nd Reading, with regards to
the currently proposed the traffic flow options, volume of cars, how they are able to
move cars through the process and potentially, alternative traffic flow options to be
considered.
2nd Reading on June 21, 2022 :
Approved (6-0) at 2nd Reading, subject to the Staff Report dated June 14 , 2022 and
Site Plan Review Summary No. #5, dated June 14, 2022; noting the approval of up
to 17 self-service vacuums under two navy blue shade canopies located in the
northeast portion of the site; noting that the self-service vacuum equipment will be
fully enclosed and screened by a masonry wall with metal gates; noting that the

existing canopies covering the full service "detail" areas located between the building
and Davis Blvd. and the building will be removed; noting that the applicant will
construct an 8' masonry wall along its south property line along the adjacent
residential property and the masonry material of the wall should be consistent with
one of the three options presented this evening and the applicant's preference of the
stone material option is approved; the hours of operation will be Monday-Saturday
8 am to 8 pm and Sunday 8 am to 7 pm (Daylight Savings Time or if this becomes
year around standard time); Hours of operation will be changed to Monday-Saturday
8 am to 7 pm and Sunday 8 am to 6 pm when or if Daylight Savings ends in the fall
of the year it happens; noting approval of the "S-P-1" regulations as submitted and
presented; noting approval of the traffic circulation plan presented this evening and
also, providing the zoning administrator the ability to allow the applicant to make
administrative modifications to the site if the stacking of vehicles ever results in the
queuing of cars on Davis Blvd.; noting that prior to final approval by the City on these
improvements, the applicant will verify that the operation of all vacuums on site
operating at 100% capacity will meet all City Noise ordinance requirements and will
be able to provide documentation to the City. Verification will be provided by an
acoustic engineer or other qualified professional; and also noting, this approval
includes the outdoor pergola with seating area and fans near the vacuum area
presented this evening and will meet all accessory building standards and
regulations; and finally noting this zoning approval action does approve any signage
or façade color changes and any new signage or color façade changes must meet
City ordinance requirements.
Site Plan Review Summary No. 5 dated June14, 2022
Planning Review
1. Provide drawings and/or pictures of the point of sale stations prior to the City Council
meeting. The point of sale canopy colors will need to meet the Section 33.21
Supplemental District Regulations pertaining to color. This is not noted on the site
plan.
2. Show and label the full service vacuum and detail area (or where will this occur?)
3. For the north bufferyard, provide a variance request on the north property line to allow
the bufferyard to be as shown on the site plan. Regulation provided.
4. The existing canopies are proposed as navy blue canopies. The navy blue color will
need to comply with the Zoning Ordinance Section 33.21, Supplementary District
Regulations for building color standard for non-residential buildings. Regulation
provided for Navy Blue fabric.
5. In Section 43, Corridor Overlay, under 43.9.c.1.e, Exposed Columns (for the shade
structures), the columns are required to be masonry wrapped in the principle building
material. Provide a regulation in the "S-P-1" zoning to allow the canopy columns to as
metal (not masonry wrapped) or request a variance to this requirement. Regulation
provided.

Tree Conservation/Landscape Review
TREE CONSERVATION COMMENTS:
1. Revise the submitted Tree Conservation Plan to match the Revised Site Plan. The
proposed dumpster enclosure will cause the removal of tree #128, 19" Bradford Pear.
The existing tree cover calculations were not provided on the Tree Conservation Plan,
but the proposed tree preservation would comply with the Existing Tree Cover
Preservation Requirements of the Tree Preservation Ordinance.
Three (3) existing landscape trees totaling 39" diameter are proposed to be removed.
There is a note provided on the Tree Conservation Plan which says, "Trees shall be
planted for mitigation purposes for the 39" trees to be removed. Owner may plant trees
on site or pay into City tree fund for the adequate amount of trees to equal the 39".
LANDSCAPE COMMENTS:
1. The proposed request for change in zoning is to allow for express self-service vacuums
on the premises. Any request for changes in zoning to any district other than agriculture
or single-family residential districts shall require that all required bufferyards and
associated plant material and irrigation be installed prior to the issuance of a certificate
of occupancy for the proposed use. Please provide all required bufferyards, plant
material, and irrigation. Existing plant material may be counted as required bufferyard
plant material.
2. Correctly identify and label all required bufferyard types. The required bufferyards are
as follows. No bufferyards are required adjacent to the north and east 11 zoned
properties.
North — 5' —A. Where adjacent to the C3 zoned automotive repair.
South 1 — 5' —A. Where adjacent to C2 zones dry cleaners.
South 2 — 10' — F1. Where adjacent to residential properties.
West— 15' — S. Where adjacent to Hwy. 1938.
3. Each individual parking lot landscape island shall contain a minimum of one (1) canopy
tree with the remain area in shrubs, ground cover, ornamental grasses, seasonal color,
or a combination of these plant materials. This includes landscape areas at the ends of
rows of parking.
4. When canopy trees are required to be provided 50% shall be 4" caliper and the
remaining 50% may be 2" caliper.
5. There is a note on the Tree Conservation that states the three (3) trees being removed
will be mitigated by either planting on site or payment into the City Reforestation Fund.
Please state how the tree removal mitigation will be handled. If planting back on site
show the mitigation plantings on the Landscape Plan. If paying into the Reforestation
Fund, the amount is $149.50/inch @ 39". $5830.50.

6. For all lots greater than 30,000 square feet, the Landscape Plans shall be prepared and
stamped by a Registered Landscape Architect.
7. Any existing landscaping that is removed and/or destroyed during the construction must
be replaced with similar landscaping prior to the final inspection for a Certificate of
Occupancy.

GENERAL COMMENTS:
1. Update the Drainage Area Map and associated calculations for proposed conditions for
the additional parking lot that was added.

GENERAL COMMENTS:
No comments based on submitted information.
General Informational Comments
* No review of proposed signs is intended with this site plan. A separate building permit
is required prior to construction of any signs.
* All mechanical equipment must be screened of view from right-of-ways and residential
properties in accordance with the Zoning Ordinance No. 480, as amended.
* All lighting must comply with the Lighting Ordinance No. 693, as amended.
* All development must comply with the Drainage Ordinance No. 605 and the Erosion and
Sediment Control Ordinance No. 946, as amended.

SECTION 2.
That the City Manager is hereby directed to correct the Official Zoning map of the City
of Southlake, Texas, to reflect the herein changes in zoning.
SECTION 3.
That in all other respects the use of the tract or tracts of land herein above described
shall be subject to all the applicable regulations contained in said Zoning Ordinance and all
other applicable and pertinent ordinances for the City of Southlake, Texas. All existing
sections, subsections, paragraphs, sentences, words, phrases and definitions of said Zoning
Ordinance are not amended hereby, but remain intact and are hereby ratified, verified, and
affirmed.
SECTION 4.
That the zoning regulations and districts as herein established have been made in
accordance with the comprehensive plan for the purpose of promoting the health, safety,
morals and the general welfare of the community. They have been designed, with respect to
both present conditions and the conditions reasonably anticipated to exist in the foreseeable
future; to lessen congestion in the streets; to provide adequate light and air; to prevent over-
crowding of land; to avoid undue concentration of population; and to facilitate the adequate
provision of transportation, water, sewerage, drainage and surface water, parks and other
commercial needs and development of the community. They have been made after a full and
complete hearing with reasonable consideration among other things of the character of the
district and its peculiar suitability for the particular uses and with a view of conserving the value
of buildings and encouraging the most appropriate use of land throughout the community.

SECTION 5.
That this ordinance shall be cumulative of all other ordinances of the City of Southlake,
Texas, affecting zoning and shall not repeal any of the provisions of said ordinances except in
those instances where provisions of those ordinances are in direct conflict with the provisions
of this ordinance.
SECTION 6.
That the terms and provisions of this ordinance shall be deemed to be severable and
that if the validity of the zoning affecting any portion of the tract or tracts of land described
herein shall be declared to be invalid, the same shall not affect the validity of the zoning of the
balance of said tract or tracts of land described herein.
SECTION 7.
Any person, firm or corporation who violates, disobeys, omits, neglects or refuses to
comply with or who resists the enforcement of any of the provisions of this ordinance shall be
fined not more than Two Thousand Dollars ($2,000.00) for each offense. Each day that a
violation is permitted to exist shall constitute a separate offense.
SECTION 8.
All rights and remedies of the City of Southlake are expressly saved as to any and all
violations of the provisions of Ordinance No. 480, as amended, or any other ordinances
affecting zoning which have accrued at the time of the effective date of this ordinance; and, as
to such accrued violations and all pending litigation, both civil and criminal, whether pending in
court or not, under such ordinances, same shall not be affected by this ordinance but may be
prosecuted until final disposition by the courts.
SECTION 9.
The City Secretary of the City of Southlake is hereby directed to publish the proposed
ordinance in its entirety on the City website together with a notice setting out the time and place

for a public hearing thereon at least ten (10) days before the second reading of this ordinance,
and it this ordinance provides for the imposition of any penalty, fine or forfeiture for any violation
of any of its provisions, then the City Secretary shall additionally publish this ordinance in the
official City newspaper one time within ten (10) days after passage of this ordinance, as
required by Section 3.13 of the Charter of the City of Southlake.
SECTION 10.
This ordinance shall be in full force and effect from and after its passage and publication
as required by law, and it is so ordained.
